I remember paying $370,000 for a house in swfl. that was assesed at 240,000. Assesed ,appraised and what someone is willing to pay can be like a smorgasbord. NY Executive Law 63 (12) does not require a victim. Furthermore, the judge ruled that the State does not have to prove financial losses were incurred or that the defendant acted with intention to defraud.
Letitia James ran on a platform of “Get Trump.” The Attorney General is suppossed to ensure the equal application of the laws. Obviously, this is Deprivation of Civil Rights Under the Color of Law, a violation of 18 USC § 242. It violates the 14th amendment under equal protection, the 4th amendment under unreasonable search and seizure (they raided Trump’s lawyer’s offices), the 6th amendment (jury of your peers), and the takings clause of the US Constitution. Normally, Letitia James would be prosecuted, but Merrick Garland would have to do that, and he is every bit as crooked as she is. Like the January 6th cases, this is full blown tyranny. Why aren’t the people rising up?

Most likely, once the judge rules that all of the Trump organization is to be dismantled I assume this will be appealed to a federal court as a takings case and, hopefully, when it eventually reaches the federal Supreme Court (if it still exists by the time it gets there) that New York statute will be declared unconstitutional.
Of course, by then the unworthy recipients of the Trump Organization’s assets will have squandered them leaving a value of $0.00 – at least, that seems to be the lawfare long term plan.

I have to admit, creating a “statement of financial condition” was never my forte in Accounting III. However what Allina Haba said was exactly what I was thinking days ago. If this case stands against Trump it will drive every single business out of the state of New York.
There is a such a thing as “forensic accounting.” As far as I know, there is no precedent that allows whoever it is, to bring a case against Trump without bringing similar charges against all of the professionals who appraised Trump’s properties as well as those who created his financial statements, or for that matter the Trump tax returns filed with the IRS. There is no precedent. Period.
For whatever reason, this case reminds me of Ken Lay and Enron. The whole case drove one of the big “six” accounting firms Arthur Anderson out of business, thousands in that accounting firm lost their jobs over the fraud Lay perpetuated.
