At first, I wasn’t sure because Donald Trump is no longer the president. HOWEVER, this case deals with an act that occurred while Donald Trump was the President of the United States and while he was acting in his capacity as president of the United States, something that represents A MASSIVELY RELEVANT POINT. He was found not guilty of that indictment in the US Senate.
This is a violation of the Constitution to submit a citizen to double jeopardy.
Therefore, the judge should dismiss the indictment if his attorney submits the motion to dismiss on Constitutional grounds.
My worthless/no legal training opinion: Impeachment is a political process not a legal one, therefore double jeopardy does not apply here.

Absolutely! I can only imagine how bleak things likely appeared in 1939-42. Hitler was running through Europe like it was nothing, with the Brit’s the only one standing. The Japanese rampaging through the Pacific and Southeast Asia. Some said these were invincible juggernauts. Many felt hopeless.
We are at the same point. And just as “The Greatest Generation” emerged from hopelessness and despair, so will we, with the divine Providence of a sovereign God!
