There was a lot going on in the Delaware federal court today. One of the topline issues was an admission by federal prosecutors that an additional investigation of Hunter Biden is ongoing, as the tax evasion and federal gun charge deal was brokered.
At the core, we see U.S. District Court Judge Maryellen Noreika noting the terms of the current DOJ plea deal appeared structured to provide immunity to Hunter Biden for any future crimes identified in the ongoing investigation on other matters; so, Noreika asked the DOJ directly. In essence, Judge Noreika called out the DOJ and directly asked them if this was their intent.
When Judge Noreika questioned the prosecution about this immunity implication, the US attorneys said future immunity was not part of this agreement. At that point the Hunter Biden defense team then acted surprised, saying if this is the accurate position of the DOJ then any plea deal is “null and void.”
After those statements, Judge Noreika seemingly dispatched the deal, telling both the DOJ and Biden defense, “I think having you guys talk more makes sense.”
Here’s the non-pretending version. The corrupt U.S. attorney’s office organized, coordinated and colluded with the Hunter Biden team to structure a deal that would provide cover for Hunter Biden for any further crimes. This is corrupt as hell. The judge sniffed this motive and asked the DOJ directly. The DOJ could not make that admission for obvious reasons and denied this intent. Thus, the Hunter defense team then had to say without the previously agreed future immunity, the deal was off.
Poor Hunter. And he was riding on such a HIGH.

I hear some big-name commentators today saying that this “global immunity deal” had, in fact, been agreed to by both sides, but that the prosecution was simply reluctant to admit it to the judge in court today due to the recent firestorm ala IRS whistleblowers, etc.
THAT IS NOT WHAT HAPPENED.
THIS is what happened: The DOJ was planning to refuse to answer any more questions from Congress related to Hunter by claiming the “investigation is ongoing.” This is their favored tactic when they are in the midst of a cover-up: Claim that there is an ongoing investigation and thus that they simply can’t talk about it, for fear of jeopardizing their case. Meanwhile, there is no investigation. The case was closed months or years ago.
Today, when the judge pressed them on whether the plea agreement included all potential current or future FARA violations, they said, no it doesn’t, because otherwise they would have had to admit that the case was closed, which would have enabled Congress to go to town, demanding every email and document related to the closed case.
This temporarily threw the Biden team off, since they had understood in their private talks with the D.A. that the case was closed. So they momentarily objected. Then they conferenced privately with the prosecutors, who explained to them why they had to lie to the judge. Then the Biden team said, okay judge, will take this deal. At that point, she became suspicious of the whole sordid affair and didn’t want to be seen as rubber-stamping such obvious corruption. So she said, no deal, I need more paperwork from you guys.
But rest assured, this case is in fact dead in the water. There will be no more charges. When the two sides return to this judge with the required paperwork, she will accept the deal. Meanwhile, the DOJ will continue to stonewall Congress with claims that they can’t answer any of their questions about Biden family money laundering due to the “ongoing investigation.”
But an “ongoing investigation” needs to come from somewhere, now.

This just in: The judge won’t accept the proposed plea deal at least for now.
Some thoughts: Now we know why DOJ didn’t show us the plea agreement terms. What didn’t they want us to know ahead of time? A) a global immunity deal for Hunter; B) A binding plea (that is, the judge must accept the specific terms if she accepts the agreement); C) Misdemeanor probation; D) Other unusual plea terms.
1. A global immunity deal for Hunter while the overall investigation is “ongoing”, is stunning—a super-sweetheart deal.
2. A binding plea is extremely unusual in the vast majority of federal jurisdictions. It means for example, that if the agreement calls for probation the judge must give Hunter probation. It is binding.
3. That the prosecution and defense would disagree about the terms of the agreement in open court is a joke. Ambiguous terms in a plea agreements are construed against the government! There should be no room for disagreement on the key terms of the agreement. So, this was either astounding incompetence or corruption on DOJ’s part. I think it is corruption. This looks like a wink and a nod deal (as @shipwreckedcrew
has noted) where DOJ would have plausible deniability if the judge asked no questions and accepted the deal. The scope of immunity is the most important feature of a plea deal. It is inconceivable that the prosecutors were incompetent here. Leo Wise has an excellent reputation for competence.
4. Think about this. DOJ was about to sanction a plea deal where Hunter would get misdemeanor probation on serious tax charges plus pretrial diversion (no time served or criminal record) on the felony gun charge. Hunter would also get complete immunity on all other charges. And he would not have to cooperate with the government’s ongoing investigation. Totally disgraceful. Merrick Garland and David Weiss should be ashamed. And where is Lisa Monaco? Why hasn’t she been called to testify?

So much corruption has been dragged out into the sunlight that federal judges are “noticing” things that have been swept under the rug by judges past (eg Emit Sullivan, James Boasberg). TWO, potentially THREE, indictments of Trump = totalitarian police state. Covering up for Hunter = totalitarian police state (remember Saddam Hussein’s boys?).
The courts derive their legitimacy from the Law. They don’t have tanks and infantry. If the DOJ is allowed to act with clear corrupt intent, the entire justice system collapses. (in reality, it already has)

I can’t see it ever going to trial, but any legal proceedings, including appeals, would likely be used as the excuse not to comply with congressional subpoenas.

You can sign a disclaimer, to indemnify another party against a future lawsuit for something that hasn’t happened yet, (civil matter) people do it all the time, for instance before riding a mechanical bull.

Hard to call this a win when he skates on intentionally not paying 1mm plus in taxes that he admits he knew he owed and also skates on a felony gun charge that carries a 10 year maximum sentence by going into a “diversion” program. I don’t think anyone was aware of the immunity from future charges before today. Obviously great they got busted on the immunity deal but the crook walked on charges that anyone else would be doing time for. Am I missing something?
