Something is suspicious about this in the presentation, the timing and even the wording.
Ray Epps was a guy who attended the events in/around Washington DC on January 5th and January 6th, 2021. There is a lot of video footage of Ray Epps instructing people to go to the Capitol building. Despite a rather voluminous amount of evidence, Ray Epps was never charged with any conduct related to the events of January 6th.
According to a lawsuit Epps filed against Tucker Carlson and Fox News claiming the outlet targeted and defamed him, Ray Epps states, “in May 2023, the Department of Justice notified Epps that it would seek to charge him criminally for events on January 6, 2021—two-and-a-half years later.” [lawsuit citation – pg 41]
First, since when does the DOJ inform a suspect in advance they are seeking to charge him? Second, timing. It is now mid-July; where’s the indictment? Third, the wording is suspicious – the DOJ would “seek to charge him criminally.” Meaning, the Dept of Justice told Epps they were going to make efforts to arrest him?
Considering the lawsuit itself if dependent on a very specific narrative; and considering the lawsuit itself if dependent on a sympathy construct within that narrative; and considering the media narrative has been about wrongly targeted Epps by right-wing disinformation white nationalists, something is not passing the sniff test.

Both the FBI & Ray Epps have been adamantly denying he was an agent or asset, including under oath, although they could refuse to talk about that. That means something.
It’s not inconceivable that the FBI would lie under oath. Especially since, they believe, nobody’s going to call them on it or punish them for it.

Their assertion is patently false, and borderline ridiculous once you realize all the people that DOJ HAS arrested and imprisoned. The fact that Epps might be charged 2.5 years later and only AFTER the news media called them out on it, proves that he was not defamed. Presumably a civil case. How much is he suing for? Of course (considering the Dominion case) he is probably assured of some kind of monetary settlement. There will be no discovery on the part of Fox, and we will be none the wiser as to who Epps actually is.

It’s DOJ policy to notify grand jury witnesses that they are “targets” or “subjects” of grand jury investigations, and it’s also policy, when a person is indicted, to give formal notice that DOJ believes they committed a crime. So that part-Epps being notified-isn’t suspicious. However, the existence of any investigation will likely shut down any discovery into whether Epps had any association with any federal actors, which sure is convenient for Epps’ suit against Fox.
What’s really fishy is how he got removed from the most wanted list in the first place. Right after J6, Epps appeared on the FBI’s most wanted list and was quickly removed. According to the NY Times, Epps saw himself on the list and called the FBI and cleared everything up. Right. How many people wanted by the FBI have simply called the FBI and gotten everything cleared up? None of the other J6 defendants had that opportunity. He’ll probably get some Clinesmith-like deal and a big settlement from Fox to compensate him for the trouble.
