I used to buy military surplus. The DRMO insists that when you buy it you have to take it. The retired Sgt. Major site manager was telling about a recent incident in which he had to change the “must take” policy. Someone like me had bought a bunch of miscellaneous crates. The buyer was demanding that the site allow him to not take a particular item. The site manager was reciting the rules when the buyer uncovered the crate that he had bought and inside was a brand new M60. Rules can always be changed.
Why not just take it? They will eventually catch you. I bought some stuff at Redstone Arsenal that included old analog volt meters that had been modified by the arsenal. Three years later I got a very serious letter that the meters must be returned or I had to tell them the buyers of every one and guarantee that none had been shipped out of the country. They knew exactly how many I had and when they were bought. They had changed the demil classification and I could no longer own, sell or export them. It seems the Iranians had learned how to use these modified meters to aim missiles. Instant reclassification. Mine were all gone to who knows where. I sold them on eBay. I told them this, and it seemed to satisfy them.
They would have eventually figured out that the M60 was missing and started to investigate. There is a good chance they would have been able to trace the crate to the auction and buyer. Better to just fess up.

When I was growing up we had an anti tank gun in the front yard. No kidding. It was surplus from WWII, I think. My Grandad picked it up. He thought he might use the axel for a wagon. But his kids liked playing on it so much that he just left it as it was. It was still functional too although we didn’t have any ammunition. Don’t have the case in front of me, but court said ‘The guns protected by 2A are those in common use’. I believe the 1930’s NFA case, Miller v USA, said the 2A protects guns ‘Commonly used by the military’, or something to that extent.
If we had an honest SCOTUS (don’t spit yer drink laughing here) they’d rule all AW’s are 2A covered. With the protests outside their houses, maybe Kavanaugh and Phony Barrett will vote that way when the (coming?) AR ban reaches SCOTUS.
Ah, coming back to me. Miller was arrested for bank robbery or attempted bank robbery. He had a short barreled shotgun that wasn’t NFA registered. He was charged with possession of an unregistered SBS. His attorney argued NFA was unconstitutional.
The court ruled that short barreled shotguns weren’t arms of the militias of America’s founding, nor were they arms in common use by the US military. In this declaration we see the court essentially said the kind of guns protected by 2A are those that were/are in common use by, (1) American militias, past and present; (2) the US military.
According to this dicta, select fire weapons such as the M16, M14, Thompson, BAR (early with select fire trigger) are 2A protected. Thus, the federal registration scheme/process and federal tax requirements to own these weapons is certainly an infringement on the right to keep and bear them.
The court continued the case but Miller skipped town and never appeared for his court date. Can’t recall if his atty even appeared at the hearing but the end result was NFA wasn’t challenged and thus, was upheld. The silver lining, however, is the court equating firearms in use past and present, by the US military and militias, are the kind of guns protected by 2A.
