When Donald Trump won the 2016 election, even before he took office, CTH warned about the permanent bureaucratic class in Washington DC and what it meant for an outside to enter this system. With a consistent question being raised, it is well worth the reminder – because the answer has nothing to do with Donald Trump.
First the question:

The short answer is, it’s not that complicated. There is one permanent bureaucratic class in/around DC (two wings, same bird). The pool of appointees comes from this UniParty system. Donald Trump as an outsider faced animosity from the system itself. There are no MAGA bureaucrats.
That said, the more fulsome answer is the real issue. Because it doesn’t matter who the ‘outsider’ is, they are going to suffer the same fate until a structural change takes place.
If you take a small potential pool of America-First administrators, and then overlay the DC filtration system in the Senate, ‘advise and consent’, what you realize is that any appointment has to be approved by the same system that is opposed to the agenda the nominee would represent.
In essence, the DC system is designed to protect itself.
It doesn’t matter who the next presidential candidate is. If that President wants to advance a policy agenda in favor of the American people, they will face the same problem. So let me give one perspective on how to tackle the issue.
To give one example as a baseline, Senate Majority Leader Mitch McConnell did not block President Trump’s ability to have recess appointments because the republican controlled Senate supported Donald Trump.
Senator McConnell blocked President Trump because the DC system was opposed to President Trump.
Machiavelli said, “It must be remembered that there is nothing more difficult to plan, more doubtful of success, nor more dangerous to manage than a new system. For the initiator has the enmity of all who would profit by the preservation of the old institution and merely lukewarm defenders in those who gain by the new ones.” A prescient and oft repeated quote that is pertinent to the situation.
When our founders created the system of government for our constitutional republic, they built in layers of protection from federal control over the lives of people in the states. Over time those protections have been eroded as the federal bureaucracy has seized power. One of the biggest changes that led to the creation of the permanent political class was the 17th amendment.
Our founders created a system where Senators were appointed by the state legislatures. In this original system the senate was bound by obligation to look out for the best interests of their specific states. Under the ‘advise and consent‘ rules of Senate confirmation for executive branch appointments, the intent was to ensure the presidential appointee -who would now carry out regulatory activity- would not undermine the independent position of the states.
When the 17th amendment (direct voting for Senators) took the place of state appointments, the perspective of ‘advise and consent’ changed. The senate was now in the position of ensuring the presidential appointee did not undermine the power of the permanent bureaucracy, which is the root of power for the upper-chamber.
Senate committees, Homeland Security, Judiciary, Intelligence, Armed Services, Foreign Relations, etc. now consists of members who carry an imbalanced level of power within government. The senate now controls who will be in charge of executive branch agencies like the DOJ, DHS, FBI, CIA, ODNI, DoD, State Dept and NSA, from the position of their own power and control in Washington DC.
In essence, the 17th amendment flipped the intent of the constitution from protecting the individual states to protecting the federal government.
Almost every source of federal issue: ex. spending, intervention and foreign assistance, conflict with the states, burdensome regulation, surveillance and spying on American citizens, the two-tiered justice system and the erosion of liberty & individual rights (see COVID examples), can be sourced back to the problem created by the 17th amendment.
As long as the United States senate is more concerned with retaining their own power, no executive branch office holder can break through that system.
In the balance of power dynamic, the Senate has an inordinate amount of unilateral power within the congressional branch. This power dynamic is a direct outcome of the 17th amendment. Indeed, many have argued – myself included, that no single modification to the constitution was as structurally damaging to the framework of government, specifically the balance of power within it, as the 17th amendment.
The House of Representatives was created to be the voice of the people, ie, “The Peoples’ House.” However, the U.S. Senate was structurally created to be the place where state government had representation in the federal government decision-making. The 17th amendment completely removed state representation, and we have been in an escalating battle over state’s rights ever since.
It doesn’t matter who the President is, they do not choose their cabinet. Ultimately the senate does. That’s the core problem.
Overlay that DC structural issue with the fact that almost all of the bureaucracy created by this skewed DC system is now in place to defend itself from any outside effort to change it, and you get this problem that Donald Trump exposed.
Repeal the 17th amendment and you will see the most significant restoration of freedom, liberty and social balance in our lifetime.

Years ago an acquaintance was arguing for term limits. I stated that the solution they were looking for is the repeal of the 17th amendment. That opened their eyes I think.
With term limits and Article V, we get changed what needs changing to protect what IS OUR PROTECTION. They’re not going to voluntarily give power back. How cute to think so.

The 16th and 17th Amendments are a binary weapon deployed against the People. Eliminate the State sovereignties leaving only the Federal sovereignty, then control the States by the allurement of money – money seized from the People.

President Trump is looking at the long game. Winning the primary is just the beginning — if PA were a deep red state, like say Texas or Florida, then she would probably be a shoo-in. Or if she had strong national name recognition. The question is, are there enough people in a moderate state with big Dem strongholds (like Philly) who will vote in the general for an outspoken MAGA America First candidate? What good is it to get a perfect candidate elected in the primary who has no chance of being elected in November?
And Dr. Oz being a personal friend is not just about doing a favor for a pal — it’s about having people in the Senate that will be loyal to Trump, and that he can work with. I believe he is working from the outside, trying to assemble a coalition in Congress that he can work with, and that he is looking to see how many allies he can get elected in 2022 to determine whether he runs for president in 2024.
There’s time yet for him to switch to Kathy Barnette. Trump needs to get on the MAGA train in PA.

Repealing the XVII Amendment is a grand quest than which none other can compare in politics.
Given the nature of education in this country for the last c. 60 years, and the constant drumbeat that “democracy, more democracy” is the cure for America, such a quest seems quaint, a cripple’s desire to drag himself up Mount Everest.
And yet…what else – outside of a revolution – is to be done? We must try to educate and convince America that the “Senate is a beast.”

And you work down that bench until you get the right person. President Trump now knows the “system” and he better have a plan to work around it. I find it disconcerting with some of PDJT’s endorsements (yes, Dr. Oz comes to mind). Until the 17th Amendment is repealed, the immediate objective is to work around the Deep State. So no surprise that many were, in hindsight, duds. The surprise is that there were as many good ones as there were, given the system.
I know how it happened. They had set up and heavily marketed a website looking for talented people who agree with the MAGA agenda and would like to lend their talents toward working in the Trump administration. There was all this fanfare, and everyone I knew applied and was waiting to hear back and get started.
And then the people in charge of the program DELETED all the information from the no doubt millions of people who applied.
People never mention this, but that was in my opinion the biggest event that doomed the Trump administration. Those were energetic, smart people who wanted to lend their energy to building an ongoing MAGA movement.

I agree that the 17th amendment needs to be repealed. To repeal, an Article V convention might be needed. Odds are unlikely that Congress will propose an amendment to repeal the 17th. I remember when Congress failed to pass the Balanced Budget amendment and send it to the states, and that was in 1992. Last I recall, conservatives were split on an Article V convention, and then there is the danger of WEF forces manipulating a constitutional convention. I’m not saying it’s impossible to repeal the 17th, it’s just that conservatives need a strategy to get the 17th repealed.

If the repeal of the 17th isn’t possible, then the founders of New America, wherever that may be, will have make sure certain Article clauses of the constitution are non- amendable. I disagree that repealing the 17th will solve the problem, though it can’t hurt. Before the 17th amendment, the senate was having trouble regularly filling their positions because legislators would fail to elect anybody for the position. Some reasons were that the legislature simply couldn’t decide who to put on, other reasons were to obstruct senate activities that the state legislature didn’t want. That obstruction was one of the justifications for the 17th amendment.
As the size of the executive branch has grown and thus the power to appoint who heads these agencies, it is simply regulatory capture why the Senate doesn’t represent the people’s interests anymore and won’t allow appointments against their interest. Senators get sequestered in the capital and an endless stream of special interests (many inside the government), lobby and ‘donate’ to them and their families. Everyone scratches each other’s back, screwing the forgotten people.
If we are talking about congress, having the house representative represent 30,000 people at a maximum would also significantly help returning representation back to the people. Gerrymandering would significantly be reduced and citizen representation would improve.
I would also propose eliminating the lame duck session. The new replacement should have to approve any yay vote after the election. Same with the president.

My problem with this solution is that if you do not fix some of the major problems first, then all w’re doing is paying for 11,100 Representatives, all their staffs, building a huge new capitol to accommodate them, etc.
Also the fact that the population grows at at least 2 million a year, which would mean 67 new congressional positions per year. How often do we redistrict? We vote on Representatives every 2 years and there would be 134 new ones every 2 years.

Start locally! We have a state Senator in OK, Nathan Dahm, that would be just the perfect man to get on board with this! Unfortunately, he doesn’t have a big war chest, so I’m not sure of his chances.

Best article I’ve read in a long while. Since I first heard of the plan for an article V convention I’ve been telling everyone within earshot we need to repeal the 17th amendment. This article clearly defines my concerns. The 17th destroyed the 10th.

First, you have to get state representatives into office. And, this same UniParty system has made it clear they will resist at all COST. To include cheating in another election.
Second, have you seen one de-certification of any state, for the 2020 election. How about one person jailed as a direct result.
Third, you must be able to fire a civil servant in order to prevent obstruction.
Forth, you must have enough money left in the National Treasury in order to make changes.
Making a 17th amendment change is a great idea, but what about the presidential orders or the corrupt FBI and CIA. And the list goes on.
I want to see a much more direct approach to this problem. I would start by picking a date. Say 1947 for example and reverse all changes made after that date in the laws. Then I would get serious about fixing the system.

Having your State Legislature select your Senators is like the Electoral College. You elect your reps, your reps elect your senators. Take a state like Nevada. Las Vegas – Henderson metro area has enough population to simply elect who they (or the RNC/DNC) want. Reno isn’t even a counterweight any more (at least not when I left in 2010). With the original Constitutional method, the reps from Elko and Ely have more say in the election.

Assuming fealty, assuming loyalty to the concept of America is the greatest folly lurking in modern America.
Assuming that an American who has been given everything feels any gratitude is precisely that folly. George W. Bush or Liz Cheney are mediocrities who have been handed so much and feel absolutely no gratitude. And no gratitude is the greatest of sins (who said that?).
This empty husk we call the Republican establishment, we call RINOs are the remnant of this privilege (white?). The privilege is (of course) the privilege that flows from being right about everything. Capitalism, liberalism, democracy. Fools who adhere to all the right ideas become geniuses.
And American fools, like AOC, get to be fools every day and rise again. Tomorrow is another day!
OK …. so if Trump or (preferably) DeSantis becomes President in 2024…how do they navigate these treacherous waters?
They can’t unless there is a tsunami of MAGA elected to Congress – particularly the House so that, theoretically, there can be a MAGA Speaker to set the agenda and restore budget order.
State offices – particularly AG – for pushback against the feds, and the House in order to restore budget order are the real priorities in 2022 and 2024. Electing a MAGA president without wholesale changes to Congress is treading water at best.
Some commenters herein have questioned the practical reality of being able to remove the 17th Amendment at this time in history. I cannot address that as it is an entirely different – and lengthy – discussion centered around how to change almost anything and everything that is wrong with our federal government.
However, I have read CTH’s and other explanations about the problems caused by 17A and the benefit of removing 17A and returning to the original provisions in Article I, Section 3.
In all of the anti-17A arguments, I am repeatedly puzzled by a glaring omission of several currently-valid facts that undermine any justification to eliminate 17A and return to state government-chosen senators.
1) If the current Senate is self-serving and strives mostly to protect itself from any changes that might reduce its power, I do not see where that is changed by having state governments chose the Senators versus the state’s voters (who themselves elect the state government office holders). To assume that, once in Washington DC, the state gov’t.-chosen Senators will NOT align with their peers in the Senate and “vote their conscience” on national policies is IMHO a bit of a leap. The Senators are still competing for financially-lucrative and influential committee chairmanships regardless of how they were elected in their states.
2) I believe I am on solid ground observing that many supposedly “red” state governments wherein Republicans hold the majority in the legislature and/or the executive, have proven to be totally in sync with the GOP Establishment RINOs. For example, how many of the “red” states have passed laws invalidating ballot boxes and Dominion or similar forms of vote-rigging machinery & leaky processes for voter registration and voter roll maintenance that have been proven to be convenient tools with which to cheat? (AFAIK, none or at most only a small handful) How many “red” state governments are pro-MAGA? This list of questions could go on much farther.
3) George Soros and other wealthy Leftist/globalists have poured $billions into getting globalist, anti-MAGA candidates elected into key executive positions in state governments, some posing as conservatives in campaigns but proving to be Establishment globalists once in office. Those infiltrators have helped block election reforms in their respective states that might return voting power back to the citizens.
I readily admit that I must be overlooking something that is obvious to others but for whatever reason I am not seeing.
Constructive suggestions are welcomed…
So, if you are faced with one of two choices: 1) Appoint swamp creatures and watch helplessly as they stab you in the back and sabotage your chance for a second term; or, 2) Nominate and get through as many MAGA loyalists as you can, even if it means exposing and fighting the RINOs and building and rallying your base for the next election. Which would you choose?
Honestly, #2 is not a choice at this time. “Nominate and get through as many MAGA loyalists as you can…” that option did not exist for President Trump, nor will it exist for any other “DC outsider”, as noted in Sundance’s article and by historical record. He was told, essentially, ” your pro-MAGA nominee won’t even get even a hearing in the Senate because too many Senators will reject him/her and we don’t want to publicly humiliate the nominee…. So pick a nominee from OUR list of Swamp-approved Big Club members….”
I agree 100% with Sundance, but I would add that the takeover was complete once the US abandoned ‘Constitutional’ money. After that, we turned what was left of a Limited Constitutional Republic into a World Empire after WW2, with all the benefits and vices thereof.
Unfortunately, I don’t see how we can vote our way out of this given Dominion vote flipping, RINO fraud, and ballot stuffing; but I will try nonetheless as voting is the most peaceful form of revolution ever invented. After that, it’s only massive suffering on the part of both the innocent and guilty alike.
History unfortunately has shown, that ‘all’ empires eventually collapse. The question is how long it will take to restore a limited-government republic; only to restart the epic cycle again. A Republic that is always founded and restored by honest men and honest money; the seeds of all happiness and prosperity.
Ironically, I see modern nationalist Russia, emerging from the ashes of the clearly evil Soviet Union, is well ahead of us all. Perhaps the even more evil CCP of China will undergo a similar transition soon?
May our own nation have another new rebirth of freedom as well, and become the beacon on the hill for all nations.
Perhaps the original Thirteenth Amendment, ratified in 1819 and included in the Constitution, until the Civil War should be recognized and reinstated as part of the Constitution. This Amendment makes all British Accredited Registry members ineligible to hold office. Maybe electing an ineligible lawyer such as Abraham Lincoln had something to do with the Southern Succession, since the contract of the Constitution was surely broken. How was the 21st Amendment ratified? A Presidential candidate ran for office who urged repeal of the Volstead Act.
He got elected, Prohibition was repealed and a template was established.
Amendments are made to “ just go away” by the same process that enacts them.
A wise person noted: “There was no Trump Administration, there was just Trump.” To avoid a repeat, the wrong people need to be kept at a safe distance from the next MAGA-oriented President and the agenda. In addition, a huge number of personnel that are protected by federal employment rules will have to be sidelined effectively.
A number of methods will probably be needed. If getting past these evil gatekeepers has any chance of being successful, planning and assessing a host of various game theories should be already underway.
The republican form of government is long in tooth and a failure. It inevitably becomes corrupt. While I don’t think we have the necessary population to go to direct democracy, it would be preferable to autocracy. Social and economic upheaval on a scale we have never experienced as a nation, but it is unavoidable. It will create the platform upon which new government(s) will emerge. It is clear that there is not the leadership present to continue as a republic of 50 states.
Well, a Federal Government, back within the confines of the Constitution would still be useful to the 50 States, but this cannot happen without the State Legislature selecting the Senators and Constitutional money. Both are equally important.
Our Republic was designed to protect minority rights. An individual is the ultimate minority, lest we forget.
An example was given of Democracy being two wolves and a sheep voting on whats for dinner. Where a Republic would have an armed sheep contesting the vote.
Corruption is not a failure of government, but rather a consequence of individual people choosing to give into that. Human nature is inherently flawed as recorded in history and depicted in the Bible.

I am often amazed that Trump was allowed to have the Economic team he had, with Navarro, etc. (in two years past I have forgotten most of the names!). That team did more to release the US Economic engine and Main Street than the rest of the Cabinet put together.
I am hoping those guys will still be around for the next term, or a team of younger people but just as fierce can be assembled.

A prime example of why the Spoils System implemented by Jackson was superior to civil service that has done nothing but entrench life long government employees in positions.
Easy for the “group” to pull this stuff off. They actually pulled off a coup. Look when the citizens are too busy to pay attention over the decades…the citizens at my age level (78. So 65 up). We were raised by the greatest generation (they were great, but they were also gullible. Look how they kept re electing FDR. They believed the garbage coming from the trusted radio and print guys. ) Fortunately, for me I was grew with people who hated commies, were not dems, and they were pretty much out there for their day. I have always been a political watcher. But we let the ball down. The congress has always been a cesspool…they got more powerful and then Trump comes along and points out that all of them have NO CLOTHES. He was taken in. Hard for even hard liners like me to believe what is happening to our country. I am not so sure ALL his endorsements are wrong (Oz). Been reading up on Kathy. She simply does not have it. BUT club for growth is pushing her now. So for me, the fact that the uniparty rinos are pushing so hard against Oz means they feel some heat. I am so glad I don’t live in PA. how Trump was taken in…that easy. It’s political class v the rest of us. Trump is not part of the political class.

In that regard, Trump, himself, early on instinctively knew that covid was a con. His instincts were honed in business where con artists roam. He could have stuck with his instincts. Instead he was overwhelmed by his advisors, inside and out of his administration who, on that score, were all in lock step. Follow the science, whoever the science happened to be.
Nobody would have done anything differently.

The 17th Amendment is only a fraction of the problem of DC beauracracy. The SES (Senior Exec Service) IS THE DEEP STATE. That is who runs DC. Abolish it. Make them all GS positions, with several layers of bosses above them, analagous to pulling a military officer’s commission and making him join the enlisted ranks if he wants to stay.
