The New York judge, Charles D. Wood, in the case of Project Veritas -vs- New York Times, has ordered the newspaper to explain how they obtained access to the legal correspondence between James O’Keefe and his attorneys. [Source Harmeet Dhillon]
The FBI raided James O’Keefe’s apartment, seized his cell phone and other devices, and then days later the New York Times was publishing privileged legal information which appears to have been obtained from FBI leaks. The judge in the case is ordering the New York Times to defend its position before he grants the requests of O’Keefe’s legal team.

Assuming a NY Order to Show Cause has the same effect as in CA, this will be the order unless the NYT can establish legal reasons to convince the judge otherwise.

These lib journalists and FBI are colluding against PV.
This is interesting if you find “jurisdiction” interesting. It is important to remember that neither the DOJ nor the FBI are parties to this state court litigation. The judge does not have personal jurisdiction over them as he does over the NYT.
The lawsuit was brought by PV last year and accused the NYT of defamation, not protected by the First Amendment, because of malice, or knowing and willful knowledge of falsity, or reckless disregard for whether the defamatory statements were false. The NYT had described PV’s stories disclosing voter fraud in Minnesota as “deceptive,” and “unverifiable,” among other characterizations. The Court refused to dismiss it, finding solid evidence to support such knowing falsity.
The DOJ and FBI obtained a warrant to raid PV in connection with its separate federal investigation into the theft or loss of Ashley Biden’s diary. Immediately after the raid, the NYT started publishing privileged A-C communications concerning the state court litigation, providing indirect evidence of a leak from the FBI/DOJ to the defendant NYT.
The judge’s order to show cause does not yet order the NYT to do the 3 itemized things, just to show cause why such an order should not be issued, including prohibiting further disclosures of A-C privileged material, after the hearing next week.
I believe Judge Wood, the state court, is exercising his judicial authority to protect the A-C privilege regarding matters pending in his court. However, the defendant already has the communications, so its ability to unfairly gain advantage in the litigation from these communications is a horse out of the barn. The order seeks to contain that use, stop its use, require its return, and not to report it further as the news, raising a federal first amendment issue.
An interesting question here is, does the state court have any jurisdiction over federal officers who unlawfully interfere in its proceedings. I believe any attempt to bring those officers into court would allow the feds to remove the action against them to federal court. So don’t expect the Judge to go there, or want to go there. But he does have jurisdiction over the defamation claim, and the NYT use of A-C privileged material does undermine the judge’s authority, and give him cause to punish it, within the context of determining the outcome of the defamation claims. Hold the Times in contempt. Bar it from making arguments where the breach of A-C privilege disadvantages the plaintiff, discipline its lawyers.
I would expect the NYT and the DOJ/FBI collaborators to seek to take this out of the judge’s hands and into a federal court. If that happens, I doubt we’ll ever learn who leaked, certainly not within several years of appeals. And that may be part of the Deep State/Big Media strategy, to avoid having to answer to a jury for its knowing falsehoods before an unsympathetic judge.
I’m not sure how PV and the State Court can effectively resist this, but I think the key is to narrow the issues, to focus only on the merits of PV’s claims of defamation, and the judge’s authority to supervise the parties in his court. Rather than order the NYT not to publish, or seeking to discover who leaked it (both federal issues), simply take what they’ve done and may do further with the privileged material into account in running the trial.
I think if the NYT holds PV’s attorney client privilege and the state court seeking to enforce it in contempt, that itself is evidence of malice toward the subject they defamed, actual malice toward PV. Keeping the case on track in state court is the best outcome, so better not to mix in federal issues.
Maybe say, I’m not going to order you not to publish what you want to publish, in light of your first amendment issues. I will, however, allow the plaintiff to present evidence of that use, the fact that it violates plaintiff’s privilege, as evidence of malice by the defendant toward him, and of contempt by the defendant of the state court and its lawful processes.
