U.S. Special Counsel John Durham has released an indictment [pdf here] of Perkins Coie lawyer Michael Sussmann for lying to federal investigators in 2016 about the people and motives behind his FBI contact. He failed to tell them his intent was to spread a false Alfa Bank conspiracy theory on behalf of the Clinton campaign.
Working for the Perkins Coie law firm, while under contract with Hillary Clinton’s campaign, partner Michael Sussmann contacted FBI Legal Counsel James Baker to pitch evidence that a Russian bank was in digital communications with servers in Trump Tower. The Alfa Bank allegation was one of the key components for the ridiculous Trump-Russia narrative put together by the Hillary Clinton campaign. Sussmann wanted the FBI to investigate Donald Trump, so that Hillary Clinton could push a political fabrication about Donald Trump working with Russians to steal the presidential election.
According to the indictment, Sussmann failed to tell the FBI that he was giving them this information on behalf of the Clinton campaign. The FBI investigated the claims and found nothing; however, it was the appearance of the investigation that Clinton needed in order to leak/push the Trump-Russia story to the media and stir up the controversy. There had to be something to the “Trump-Russia” story, because the FBI was investigating it. That fabricated smear served its intended purpose, and the media ran with it.
With the indictment now public, The New York Times also now admits Michael Sussmann was their source for stories they wrote about Alfa bank:
New York Times – […] In early September, the indictment said, Mr. Sussmann met with a New York Times reporter who would later draft a story about Alfa Bank, and also began work on a so-called white paper that would summarize and explain the researchers’ data and analysis, billing the time to the Clinton campaign.
On Sept. 12, the indictment said, Mr. Sussmann called Mr. Elias, the Clinton campaign lawyer, and spoke about his “efforts to communicate” with the Times reporter about the Alfa Bank allegations. Both billed the call to the campaign. And three days later, Mr. Elias exchanged emails with top campaign officials about the matter. (read more)

Perkins Coie is “law firm-1”. Mark Elias is “campaign lawyer 1”. The “US Investigative Firm” is Fusion GPS. “Tech Executive-1” is likely Shawn Henry of Crowdstrike, although there are other possibilities.
In March 2016, Fusion GPS approached Perkins Coie to discuss potential engagement in the development of opposition research on Donald Trump, fully aware that Perkins Coie represented both the Democratic National Committee and the Clinton campaign.
In April 2016, Perkins Coie retained Fusion GPS on behalf of the Clinton campaign and the Democratic National Committee. Towards the end of the month, on April 29, Perkins Coie partner Michael Sussmann contacted Shawn Henry of CrowdStrike Services to hire the organization for the Democratic National Committee after a series of phishing e-mails started to affect their employees.
Before June 14, 2016, Sussmann, CrowdStrike Services and the Democratic National Committee carefully crafted a damage control story with regards to the hacking of the Democratic National Committee, which Dmitri Alperovitch and Shawn Henry released to Ellen Nakashima at The Washington Post.
On June 14, 2016, Nakashima, with contributions from Tom Hamburger, published the article “Russian government hackers penetrated DNC, stole opposition research on Trump” in The Washington Post.
After the article’s publishing, a number of bipartisan computer scientists — which included “John McCain Republicans” — started to search for Russian infiltrators. The members of the group were scattered across America and were numerous (there were at least nine members). To search for the infiltrators, they used the Domain Name System (DNS).
In late July 2016, a member of the bipartisan computer scientist organisation, known by the alias “Tea Leaves”, discovered potential malware moving from the Alfa Bank server to the Trump Organization server. The information “Tea Leaves” discovered was then circulated among his colleagues.
“Tea Leaves himself told The Intercept that he had to keep his identity and methods a secret because, ‘I run a cybersecurity company and I do not want DDOS and never have we been DDOS, nor do I want other attention.’” — The Intercept
“I also spoke with academics who vouched for Tea Leaves’ integrity and his unusual access to information. ‘This is someone I know well and is very well-known in the networking community,’ said Camp. ‘When they say something about DNS, you believe them. October 31, 2016, Franklin Foer published the article, “Was a Trump Server Communicating With Russia?”, in Slate. This article was then retweeted by Hillary Clinton in a tweet which read: “It’s time for Trump to answer serious questions about his ties to Russia.”

This was soon followed by a statement from Jake Sullivan, tweeted through Hillary Clinton’s account: “Computer scientists have apparently uncovered a covert server linking the Trump Organization to a Russian-based bank.”
At the same time, days before Election Day 2016, the Clinton campaign and the Democratic National Committee ceased funding Fusion GPS’s research. Fusion GPS then passed Steele’s reports to Marc Elias at Perkins Coie.

Interesting take. My take is he got this roadmap out there because he could be shutdown at fiscal yr end (Sept 30) and this makes doing that much harder politically for the Biden admin. Otherwise, I believe he would have kept the indictment sealed.

Am I the only one thinking, B.. F ..D? THIS is what this guy brings for an indictment, after all this time? I am getting so used to being let down it’s starting to get easy–I don ‘t even flinch now. Everyone is complaining about all the time this has taken, but I suspect getting the billing records from Perkins Coie was not as simple as subpoenaing them and receiving them the next day. Remember Fusion gave Nunes quite a fight over their billing records and he didn’t get everything there he wanted.

FWIW – Greg Jarrett, on Hannity, Hillary Clinton is the one who should be indicted because she has been established as the source of the lie. He said that the CIA was aware of Clinton’s dirty tricks and Brennan told Obama what she was doing and he sat on it. He also said Clinton was referred to the FBI and Comey buried it.

Sussman is not a small fish. He was the laundryman for GPS and the campaign. Recall how hard he worked to prevent anyone from finding out his firm was washing the invoices. I’m shocked that he billed for the time…rookie mistake on his part. Also, Durham is not FBI. He’s a retired US Attorney. Now, he may be a rooster like Gowdy, but he seems to be more methodical and doesn’t seem to be seeking the spotlight. None of this is to say that this goes anywhere else, but this is encouraging. There were plenty of chances for lies to occur after Sussman approached Baker with his lies in Sept. of ’16.
Also, overt acts to conceal the conspiracy by any member of the conspiracy extend the statute of limitations which does not run until the last act of the conspiracy. Again, not suggesting this is likely, but it’s quite possible a conspiracy indictment as to some group of actors is still in the works.

Anyone can be indicted. All you need is someone making an accusation. That’s it.
You need a grand jury to hear evidence and agree to issue one.
That means someone bothered to subpoena the billing records for Perkins Coie. That’s a pretty big deal. That’s the most connected firm out there other than King & Spalding or Sidley & Austin.

If US Intel was investigating the hack of the network in partnership with the Dutch, why would they stop investigating when Crowdstrike came on board for the DNC via P-C?

Imagine what they could find if they had something like say, a FISA warrant, on this guy for the last 5 years? He almost single handedly could bring down half the swamp.
I personally think that there is a larger, long term, secret investigation.
Imagine this investigation is like a nuclear sub that must stay hidden. No sounds, no bubbles, no surfacing, etc.
Since you mention FISA. Seeking a FISA in such an investigation would be similar to surfacing the sub. So how do you legally get intrusive information for your investigation?
Do you strategically position individuals and groups for whom a FISA is not required, maybe?
How about you get your targets to put a FISA on a subject, who then directly contacts your targets, and you use your targets’ FISA to get your 2 hops?
Reread the Comey memos, and consider that perhaps Comey is the target under investigation. They are an interesting read from this point of view, imo.

When did Perkins Coie hire Crowdstrike on behalf of the DNC? Who hired them, Elias or Sussman?
DNC retained P-C, Sussman in April 2016 to handle the hack (per indictment pg. 4). Logically, Sussman hires Crowstrike sometime after April 2016.
P-C Sussman was under retainer by IT Exec 1 since February 2015.
IT Exec 1 brings the story of the Alfa server to Sussman in July 2016, while Crowdstrike is under retainer by P-C Sussman to investigate the DNC hack.
In other words, Crowdstrike is the source of the Alfa Bank server tale, in late July 2016, if Shawn Henry of Crowdstrike is IT Exec 1, as suspected.

Sundance’s ID as Shawn Henry is supported by documents and interviews, imo. I’m just taking that ID thru an exercise in logic based on the contractual relationships identified in the indictment.

I’m a bit weary of so many commenters that barely read the analysis, never read the supporting documents, and are quick to whine and dismiss all of the work that is being done as ” nothing will ever happen”. From what I gather Rodney is Max from Max and Tealeaves the supposed discoverers of Alfa thing.
He is a DNS expert and it sounds, from indictment, that DNS experts cooked this up. Neustar has/had various govt contracts, too. But, who knows?

The negativity and “is that all after 5 yrs” suggests to me they didn’t read the indictment. It’s really an interesting read. What DOJ-types call a talking indictment, something the Mueller crew engaged in to make innuendo public.

“Tech Executive-1” (an executive at an internet company)- a client of Sussmann’s who helped obtain the data underlying the Alfa Bank claims – was “tentatively offered the top [cybersecurity] job by the Democrats when it looked like they’d win.”
My guess is Shawn Henry, former FBI official who became an executive at Crowdstrike. (FBI and DNC contractor)

You know, for meme value, the indictment of Hillary’s bagman is pretty strong…this indictment is an inflection point in the narrative line…Hillary did it. Period. Now we have to be vigilant in refuting the reductive side meme of the FBI just being duped by all of this.

Sundance, Remember the little technicality you wrote about that the Special Prosecutor has to be from outside government ? Does that play into this indictment ? Will Sussmann’s Lawfare come back with “Sure he’s guilty but Durham has no legal authority to indict”.
I suspect this is another shot across the bow to the Clinton faction, letting them know that they have NO stake in the game anymore…But Hillary has all of the dirt on everyone and if she ever decides to release it, we will all need to buy LOTS more popcorn! I’m sure she won’t, because there is no way she could walk out of it alive and she knows it, but maybe, just maybe she will wake up one morning and think, “Oh, what the Hell” and burn it all down!!
This is the first of “Bad Guy” indictments. There will be thousands to follow over the next several months. The Military will be involved with its tribunals. The “Bad Guys” are ultimately doomed, however, it will get ugly because they will fight with everything they got to the bitter end.

Everyone who mattered in Washington knew this at the time. Most of the media got it too. The readers here with the help of Sundance connected the dots years ago.
The sad fact is most that who don’t already know don’t care. The media will cover and spin so in the end the evil doers themselves don’t really care. Justice delayed is justice denied. If it is delayed long enough does it affect the current mess in the government today?
Will equal justice under the law be served, or should I count on the fact that some people are more equal than others?

Here is a good baseline for this case.
1) July 29th Michael Sussman meets with Christopher Steele and informs Steele there is a Trump campaign server connected to Russian Alfa Bank.
2) July 30th Christopher Steele meets with both Bruce and Nellie Ohr. Steele shares Alfa info with the Ohrs. Steele later testifies in Brittan that Alfa Info originated from Michael Sussman. Bruce Ohr (Number 4 at DOJ) goes on to share Steele info with FBI and wife Nellie shares with her Boss Glenn Simpson of Fusion GPS. Simpson later instructs Steele to include Alfa info in hoax dossier. Fusion GPS is on retainer to Perkins Coie (Sussman) at this time. Alfa bank accusations are later completely debunked by FBI
3) July 31st Peter Strzok starts the Crossfire Hurricane Investigation with an EC (Electronic Communication) from Peter Strzok to Counter Intel (Peter Strzok) and approved by …you guessed it Peter Strzok.
4) Sept. 16th Sussman meets with James Baker FBI General Counsel and gives him 3 white papers and thumb drives that implicate Trump conspiring with Russia to get elected. He implies to Baker he is not reping any clients and that his motivation is that of an informed and concerned citizens.
This is a small part of the scandal that can move both forward and backward but covers three important days that your friends and associates can learn in an effort to understand what is going on. It is not just a lie but a total misrepresentation that lead to FISA abuse, General Flynn persecution and the Mueller inquisition. That is to say 4 years of hell for our great country and ALL of its citizens
