The interview begins with Senator Paul discussing the leftist definitions of ‘infrastructure’ and how left-wing groups are beneficiaries of trillions of taxpayer funds.
On the economic ramifications Senator Paul notes the impact of massive capital gains increases and how increasing corporate income taxes only provides incentives for national companies to establish themselves overseas to avoid tax liability. The multinational corps, those already positioned overseas, do not have the same risk exposure to corporate tax increases, thus they do not oppose legislation that hurts national business and small U.S. corporations.
Overall the points made by Rand Paul are all valid; however, those in DC still hold back from pointing out the intent of the JoeBama group – that’s frustrating. This game where incompetence is claimed under the guise of ‘benefit of doubt’ is a severe weakness within the GOP. The refusal to aggressively confront Obama 3.0 is beyond frustrating.

Anyone who believes Democrats own exclusive opposition to the America First principles are completely ignoring the deliberate construct of the republican party. There are just as many -if not more- natural enemies within the Republican apparatus as there are within the Democrat group. “America-First” is antithetical to the UniParty.

Most people think when they vote for a federal politician -a House or Senate representative- they are voting for a person who will go to Washington DC and write or enact legislation. This is the old-fashioned “schoolhouse rock” perspective based on decades past.
There is not a single person in congress writing legislation or laws. In modern politics not a single member of the House of Representatives or Senator writes a law, or puts pen to paper to write out a legislative construct. This simply doesn’t happen.
Over the past several decades a system of constructing legislation has taken over Washington DC that more resembles a business operation than a legislative body.
The for-profit groups (mostly multinational corporations) have a purpose in Washington DC to shape policy, legislation and laws favorable to their interests. They have fully staffed offices just like any business would – only their ‘business‘ is getting legislation for their unique interests.
These groups are filled with highly-paid lawyers who represent the interests of the entity and actually write laws and legislation briefs.
In the modern era this is actually the origination of the laws that we eventually see passed by congress. Within the walls of these buildings within Washington DC is where the ‘sausage’ is actually made. Again, no elected official is usually part of this law origination process.
Almost all legislation created is not ‘high profile’, they are obscure changes to current laws, regulations or policies that no-one pays attention to. The passage of the general bills within legislation is not covered in media. Ninety-nine percent of legislative activity happens without anyone outside the system even paying any attention to it.
Once the corporation (multinational) or representative organizational entity has written the law they want to see passed – they hand it off to the lobbyists.
The lobbyists are people who have deep contacts within the political bodies of the legislative branch, usually former House/Senate staff or former House/Senate politicians themselves.
The lobbyist takes the written brief, the legislative construct, and it’s their job to go to congress and sell it. “Selling it” means finding politicians who will accept the brief, sponsor their bill and eventually get it to a vote and passage.
Corporations (special interest group) write the legislation. Lobbyists take the law and go find politician(s) to support it. Politicians get support from their peers using tenure and status etc. Eventually, if things go according to norm, the legislation gets a vote.
Within every step of the process there are expense account lunches, dinners, trips, venue tickets and a host of other customary financial way-points to generate/leverage a successful outcome. The amount of money spent is proportional to the benefit derived from the outcome.
The important part to remember is that the origination of the entire process is EXTERNAL to congress.
Congress does not write laws or legislation, special interest groups do. Lobbyists are paid, some very well paid, to get politicians to go along with the need of the legislative group. When a House or Senate member becomes educated on the intent of the legislation, they have attended the sales pitch; and when they find out the likelihood of support for that legislation; they can then position their own (or their families) financial interests to benefit from the consequence of passage. It is a process similar to insider trading on Wall Street, except the trading is based on knowing who will benefit from a legislative passage.
When we understand the business of DC, we understand the difference between legislation with a traditional purpose and modern legislation with a financial and political agenda.
If you know a better solution to this mess than repeal of the 17th amendment, I am all ears.
If, as the constitution outlined, the Senate were still a place where all legislation required a 2/3 majority for passage; and if, as the constitution outlined, the Senate were a body filled with representatives selected by State Houses instead of popular election – then perhaps Senators could not be purchased by multinational interests. Alas it is not.
Passage of the 17th amendment took away the very intentional roadblock of the Republican framework that Jefferson spoke of when he called it a saucer to cool the hot emotional tea of short-sighted legislation. The constitution outlined consent as “two-thirds” (66), which was progressively watered down to become “three-fifths” (60) as the majority rule; and substantively, as it now stands according to democrats objectives, one-half plus one (51).
We are on the precipice and the GOP operate as if the constitution burning can be restored if they just reach across the aisle more.

no repeal necessary….do some research as the 17th Amendment was never legally ratified by US Constitution requirements…..state legislatures not in session “magically passed it” and the differently worded versions were never reconciled into one singular amendment and ratified by the required 36 states (3/4 of 47 states at the time).

Even if the Congress had sent it back to the states, it almost certainly would have been kicked directly back with no changes. I saw no state that had gathered enough information and support to send a new, official Trump slate. Having said that, I believe that is exactly what Congress should have done–send it back to the states. Put the State Legislatures on the hot seat. After all, they (in many cases) changed the laws, and have Constitutional responsibility for their elections. Pence chickened out.

You are correct there is no 2/3 requirement for passage of legislation in the US Constitution. This declaration also set me back. Maybe the original Senate RULES called for a 2/3 vote for cloture but this is not a constitutional requirement. I know filibuster is a rule that protects the minority from the tyranny of the majority, I would just like to see it put into actual action rather than agreement in the abstract to block legislation. Make the Senators mount the Senate floor and speak continually from its well until victory or defeat of the filibuster.

That is also a Senate rule but one based on the US Constitution. Recess appointments are only valid until the end of the current Congress so no more than 2 years and SCOTUS has determined that each body in Congress determines when it is in recess. The Senate pulls a kabuki show called standing order where every 3 days one of them gets up into the well and makes a speech-making them technically in session. When they go to recess they implement this pro forma session by calling for it “without objection.” A single senator could upset this theater by objecting and then the Senate would need to either remain in session or recess officially. If they recess however unfilled administrative posts that require “advise and consent” by the Senate that are unfilled could be populated by recess appointment made by POTUS.
OK, so a single senator COULD upset the apple cart, but I am pretty sure the Constitution also calls for BOTH chambers to agree to either one or both going into the type of recess required to permit recess appointments. Pelosi would have never allowed McConnell’s senate to go into recess.
But, the one senator thing must be what Sundance was talking about. As you point out, one senator could not unilaterally declare the senate in recess.

Having belonged to and rejected both major political parties over the course of my life, I have learned to trust neither. I am embarrassed that it took President Trump to show how uncommitted the GOP is to the platforms on which they run . It turned out they did fool some of the people a fair amount of the time. At least, the Democrats lost me by being fanatically focused on horrible policies. They meant & still mean what they say.
Back in the 1960s in law school. I was introduced to Administrative Law which for my money is one of the most destructive forces at work in America today. It provides the perfect milieu for special interests and lobbyists as well as the lazy people who are supposed to represent us. Broad purpose feel good legislation filled in by agenda driven bureaucrats is a poor product but it’s what we get nowadays. Limited government may be the only solution but neither party is really committed to that.

What Article, Section and paragraph of the US Constitution specifies that ALL Senate votes require a two thirds majority?
I’ve found that threshold mentioned in regards to certain, specific circumstances (impeachment or veto override) but not in the everyday consideration of legislation.

Passed in the wake of Watergate – Democrats don’t have to get those additional 7 Republicans for cloture.
As I recall, the Democrat-controlled Congress also passed a budget reform bill that year that created the current system with the continuing resolution and omnibus provisions (needs verification).

Neither of those has any effect on legislation which is what you discussed. The second is the requirement for a conviction during impeachment and the first is for treaty approval, ambassador, and other officer confirmation.
Cloture is a Senate Rule which is normally determined by each body at the beginning of a new session about how to administer itself and conduct business over the ensuing two years. As such it is not governed by the US Constitution nor is it legislation as the House nor POTUS are involved in its passage or implementing.
A Senate rule, not a constitutional requisite, subject to change by the same body at their pleasure.

I might suggest a few other changes besides the needed repeal of the 17th Amendment.
Repeal of bad legislation and enable the impeachment of all federal officials, including judges, by 2/3 of the state legislatures who respond to the question within a specified time frame. Make it mandatory for the legislatures to take up the question and vote in a timely manner (make it a constitutional right for each legislature to call itself into session to answer these questions regardless of their state constitution and/or their respective governor or legislature leadership refusing to call a legislature into session.) There need to be a mechanism to trigger this in the constitution, perhaps when half the states request it.
The administration of elections is a function of the various states. Elections must comply with state law. State law must not be in conflict with the US Constitution.
HR-1 passed the House and was received by the Senate. HR-1 is an effort to federalize our elections. It is a raw power grab. Rand Paul’s job is to try to strip that thing down and vote against it. He has the bully pulpit with his constituents and some of his fellow senators and house members. He does not have the option to write and enact executive orders.
Having said that, somebody needs to sue Nanzi over her proxy voting scam. We’ve had nearly dead, and possibly comatose, congressmen registering votes through the magic of proxy voting in the House. Let’s have some proof of life.

I agree with your larger point, but the Constitution doesn’t require a 2/3 Senate vote to pass legislation. That was a convention the Senate used for many years, but the Constitution doesn’t require it. Here are the cases it mentions 2/3’s votes:

As of now, the multinationals buy off Washington and Washington buys off the campaign primaries, meaning we get Washington’s choices in every state, meaning the multinationals pick our senators.
