The American Legal System is now rewritten such that:
– If you are innocent and the Justice Department drops the charges, Judges can run separate prosecutions to ensure you still go to prison
– If you are subsequently pardoned by the President of the United States, the Judge can leak to the media that he is considering challenging the legality of said pardon
– If you are a candidate who is victimized by election fraud, neither you, nor any of your supporters have standing to sue, and your evidence will not be considered in a court of law. In fact, it will be dismissed without arguments being heard or evidence being presented in any way. AND, in the most recent case, “EVEN IF” your claims were true, the Judge will tell you that he or she would not throw out the illegal votes anyway.
This is going to devolve quickly into bullets, because people with absolutely no recourse through their Government are going to take matters into their own hands. Desperate people having their freedoms taken from them like this have no other means to defend themselves.

Any constitutional lawyer here to answer this question: Dose SCOTUS have original jurisdiction in the Constitution to conduct an evidential trial without sending the case back to the district court?
My understanding, not a lawyer, is that an appellate court can only decide based on what was presented to the lower court. For instance, in Georgia, the Judge dismissed the case based on Plaintiff’s lack of standing. The 11th Circuit, and subsequently the SCOTUS, would potentially reverse the standing issue and direct the lower court to proceed.
SCOTUS only acts as an evidentiary court, trial court, for those cases in which it has original jurisdiction: a case between two states, etc.
What is weird, the plaintiff’s pleasing must be accepted as true. It’s the Defendant’s job to submit information to discredit the Plaintiff’s pleading, that’s why it’s always best to be the first to file an action. So Sydney’s fraud allegations must be view as true until the defendant counters the claim with actual evidence.
Attacking “standing” is one way to dismiss a case without having to address the complaint. Go look at the Rules of Federal Procedure and it will give in sight into the procedural process. I think rule 12 covers dismissals.
There was only the SCOTUS in the Constitution when it was ratified. All other lower courts were created by Congress later. Under the Constitution, Congress has no power to invoke SCOTUS’s original jurisdiction on any federal matters by creating lower courts.
Does that mean SCOTUS can try a case at its sole discretion? I hope the SCOTUS can hear DJT’s case, de novo, without sending the case back to the lower court. Time is short.

It seems “standing” is the only thing that’s been addressed. You must have standing to bring a matter before the court. Ultimately SCOTUS will correct (?) the problem and direct the lower courts to proceed. I think that’s when you’ll see Motions for Injunctive relief barring/reversing certification. Then, again it will go before SCOTUS because the lower courts will rule that it’s “extraordinary” relief that has been requested.
SCOTUS will hopefully apply the rule of law and grant the injunction, but first they need to overcome standing at SCOTUS which’s in turn makes filing other cases easier because there’s precedent from SCOTUS that the Plaintiff’a have standing.
After standing is addressed, then injunctive relief can be addressed and then things move to discovery. Lawyers are good at creating delay, delay, delay.

Retired Magistrate here: President Trump is not going to let this country go down the tubes. He will let everything play out and hope that the Courts will do what is right along with the legislatures; so far that does not look good.
In my opinion, if all else fails, he will use Executive Order 13484 signed in September 2018 which has to do with foreign interference in our elections. President Trump has made some significant changes in the Department of Defense and other defense operations. If President Trump was not planning on doing something with that executive order plus other powers he has, why bother at this point in time.
I keep watching the President and I just don’t see any signs that he is giving up, intends to give up or intends to loose.

The only problem I see with PT using EO13484 is it requires a report from DNI Ratcliffe delivered by 12/18 stating if there was foreign interference in the election.
Unfortunately Ratcliffe was on with Maria this past Sunday and said he HAS NOT seen any signs of election interference so I’m not sure PT can do much with EO 13484 if his own DNI Director is saying their intelligence does not show any interference.
I think PT is now relying 100% on the SC Court as I don’t believe Ratcliffe would have made that statement to Maria if he had knowledge of the Frankfurt servers or any other foreign election interference.
The SC either saves the Republic or it dies within 4 years under the many traitors who failed to act on this coup when they were in a position of authority and power.

Ratcliffe did NOT say there was no interference in ELECTION fraud, which constitutes compromised computer systems, servers and the like that would comprise an entire election writ large.

If there is any action coming on this, I am certain they will not be letting anyone know beforehand. I personally hope that Ratcliffe’s statement was misdirection, as we all know there is evidence of foreign interference. Dominion is based in Canada. Scytl is based in Spain. There have been mentions of China, Iran and Germany being involved as well.

There’s an argument that they’ve given it to the Supreme Court already in a TS/SCI format “off camera” to protect sources and methods, or that they are not going to tip their hand until they get to SCOTUS tomorrow.
My guess is they don’t have the goods, so this will be a straight up Equal Protection Clause case due to the multitudes of changes to election law made by a State bureaucrat in PA.
I think that’s why PA issued that letter…to message to SCOTUS that the PA Legislature does not concur with the certification.

We thought that if the election was thrown to the states for a vote on electors that we would win, since we have a majority of states controlled by republicans. But it is now evident, that those state legislators in the contested states are not going to be of any help. Right now, they are putting on a show just like they do in the House and Senate with their show hearings.
If Biden is allowed to steal the election, we only have one alternative left. And we all know what that is. We have been slowly boiled like a frog by the uniparty, and now we are feeling the boil and it may be too late to jump out of the pot.

My district is going to open an all-e-learning school next year. Parents will be given a choice: you either enroll you child, full-time, at in-person learning at the school or you enroll in the all-e-learning school. Basically, they’re going to boot the parents who are making this painful for everyone else by refusing to return to school.
I might have some very small classes next year if the district does this. If I don’t decide to leave first. It’s a complete s-show. A lot of teachers aren’t doing jack. A lot of students aren’t doing jack. A lot of parents aren’t doing jack.
It’s like everyone is treating this like an extended national holiday from their responsibilities as citizens.
I teach physics, usually the top students in the school take this because it is very math intensive and they need it for engineering degrees in college. I’ve never had a situation where 3-4-5 students just flat-out refuse to do any work or take tests. When contacted, their parents just ignore me.
I love what I do, and I’m great at it, but this CV19 thing has destroyed whatever tenuous compact existed between parents, students and school. It’s not like these people are going out and Home Schooling either. They not doing a damn thing. At all!
I got asked by some administrators what I think is going right – the answer is NOTHING. Then they asked me what I thought should be done, and I told them, “throw out any student/parent who refuses to attend in-person, send them to a digital e-school, and then send everybody back to class in January with no masks and no stupid restrictions in the building. Otherwise, there is no point in having school this year at all.”
I am so sick of this crap, and I’m lucky to live in a very conservative area with a non-unionized school.

ATLANTA — UPDATE: Judge Timothy Batten in the U.S. District Court for the Northern District of Georgia has dismissed the lawsuit.
A similar suit in Michigan was also dismissed this morning.
It’s likely Powell will appeal to the 11th Circuit Court of Appeals in Atlanta, which itself over the weekend dismissed a similar suit brought by the attorney Lin Wood.

A hearing will be held Monday morning in Atlanta for the Sidney Powell “Kraken” lawsuit, challenging Georgia’s election results.
The hearing will begin at 10 a.m. in the U.S. District Court for the Northern District of Georgia. The presiding judge is Judge Timothy Batten.
News organizations are not permitted to stream footage of proceedings within the Northern District of Georgia courtroom.

The sprawling suit at its core alleges a wide-ranging conspiracy perpetrated by international and domestic actors to use Dominion Voting Systems, the company that makes the voting machines for Georgia and a number of other states, to rig the election for Joe Biden, in large part by switching votes from President Trump to Biden.
Georgia’s hand-count audit of all 5 million of Georgia’s paper votes (both those printed out by the Dominion machines, which were reviewed by voters, and those submitted by mail) confirmed the original machine count, and a machine recount has so far confirmed those two previous counts, making it highly implausible the results were manipulated at any point.
Powell and those who have given testimony for her have instead argued that in Georgia, fraudulent ballots were inserted into the system and the hand-count was conducted in a manner to deliberately overlook them. They have not offered direct material evidence of this, instead at a Georgia Senate hearing last week presenting data analysis and accounts of various individuals who served as poll workers or observers during the election and audit.
They also presented surveillance video from State Farm Arena on election night of counting occurring late into the night, after observers and media left. State officials have long acknowledged that counting occurred, and said it was done legally. In a filing over the weekend, the state’s lawyers motioned to bar the admission of testimony from nearly all of the lawsuit’s expert witnesses who would present the analyses that are core to the suit’s contention that Biden’s vote total in Georgia is not legitimate. The state argued these witnesses are both not qualified to present themselves as experts and have not sufficiently disclosed the methodologies by which they present their analyses.
The Powell suit is seeking, among a number of extraordinary forms of relief, the dismissal of all mail-in ballots used in Georgia in this election and an order that Gov. Kemp “transmit certified election results that state that President Donald Trump is the winner of the election.”

So the machine that altered the vote, printed out the votes that were hand recounting and thus “confirming” what the machine had printed out.
An honest person would say you can only verify that the machine printed out what it “counted”. You cannot verify that all the voter input was printed out correctly.

After spending the last few weeks in a state of anger, I have to admit I am starting to find some of this a bit comical.
Here are some amusing results of from out esteemed courts:
1. If you bring a fraud lawsuit but the fraud is not enough to overturn the election, the case is thrown out. But….
2. If you bring a fraud lawsuit alleging enough fraud to overturn the election, you are trying to undermine the election and the case is thrown out.
Together, these results are comical. However, point 1 funny by itself because it implies fraud is acceptable up to a dynamic limit based on the particular election. For instance, in some elections, 1 million fraudulent votes is good but in another election, we cannot tolerate more than 3 fraudulent votes. Fraud is acceptable? What?
That bit of judicial comedy might actually be trumped by the following (brought to us courtesy of the PA Supreme court):
1. If you bring a fraud lawsuit before the election, you have not been injured and have no standing so the case is thrown out. But….
2. If you bring the same same lawsuit after the election, you filed too late and the case is thrown out.
We may be tempted to conclude that for practical purposes there is no longer any meaningful state and/or federal laws that controls elections. Of course, that would seem to indicate that we are now in a contest to see who can cheat the best. However, it seems the following rule can be extracted from the recent decisions: There is no enforceable election law if the current election results in a democrat win or in a GOP win that has been pre-selected for a win; however, all encoded election laws will be strictly enforced against you if it results in a conservative win or a non-selected GOP win.
I may find some of this funny because I am well past the point of contributing, writing e-mails, calling people, signing petitions, waving flags, attending meetings and/or rallies, etc. These are things my family has done in the past for at least Heather Scott but we are pretty discouraged and HIGHLY disillusioned. If people become committed enough to get past the contributing and calling stage, we will happily re-engage.
