The minute order filed by Judge Emmet Sullivan outlines a protracted time-frame for the next sequence of events in the case against Lt. Gen. Michael Flynn:
As noted in the order, Sullivan is now telling the DOJ and Flynn defense to file a joint status report outlining their “recommendation for further proceedings” by September 21, 2020. From there a briefing schedule which will require both parties to respond to Sullivan’s personal amicus (Gleeson), and additionally respond jointly to any other amicus not ordered by the court. Lastly, Sullivan is requesting three dates for oral arguments.
In essence, despite his ability to quickly convene the parties to settle all matters before the court; which includes the unopposed motion by the DOJ and defense to drop the case; Sullivan intends to drag this case out as long as possible and use the amicus as a tool forcing responses from both parties (DOJ and Flynn). So much for the “quick dispatch” outlined within the DC Circuit opinion, this case is going on for several more months.
I’ve been saying for at least 20 years to anyone who’d listen that we are a Country run by corrupt un-elected Lawyers(Known as Bureaucrats), activist Judges and a corrupt Judicial who allows it all….

People wishing for Powell to file a cert wi9th SCOTUS (at this point) are barking up the wrong tree.
1. SCOTUS likely views the petition as premature just like the DC Circuit does.
2. Don’t want to burn that lifeline until we see how far Sullivan will go.
3. Absolutely CANNOT count on Roberts vote.
4. Going to SCOTUS just puts Flynn on hold again like we saw the past 2 months while the DC Circuit farted around. We are back where we started.
5. A defeat at SCOTUS would give Sullivan an even brighter green light to keep delaying.
You go running to SCOTUS now and you may not get another crack at it for a year or more.
There IS some pressure on Sullivan to get on with it. It ain’t gonna happen before the election so we just have to accept that.
No reason to believe Flynn makes any difference in the election.
Flynn could be put in jail before the election. If I went before Sullivan, I would have brought my toothbrush and have a preprepared writ of habeas corpus in my hand and possibly a preprepared pardon.
This result cannot happen. If it does, people will be mentioning the word “malpractice”.
Problem is if, God forbid, Biden wins. Appoints a new dem AG that reverses current DOJ position to drop the case. Elections matter.
Sullivan & Co. are rolling the dice hoping Biden wins. If he does, Trump will be forced to pardon Flynn. The Deep State claims another scalp.
If Trump wins, Sullivan still has options. He could hold his amicus hearing–who knows when, delay, delay, delay. Another option I believe (and I’d appreciate some legal beagles chiming in on this one) is that Sullivan could ignore the government’s request to dismiss the case and accept Flynn’s plea and sentence him (thus formalizing the stain of guilt), forcing Flynn to appeal.
While I believe Flynn would eventually win, it might be years before he did–effectively keeping him on ice and out of government. Deep State wins.
Bottom line: Flynn might receive some justice, but it’s likely he’ll never work in government again, and he sure won’t have the opportunity to get some well deserved payback against those who’ve so tormented him.
I really don’t understand some of this talk about what happens to Flynn “if Biden wins”. Do we not understand what that would mean? Uhh… if they manage to manipulate this election to the point that Trump “loses”… well, I’ll just put it bluntly: Who CARES what happens to Flynn at that point? Force Sullivan to make a commitment one way or the other. Leave the amicus curie out of it.
Explicitly state in their response motion that “all parties” are in agreement. This would force Sullivan to go on the record as to who the parties to the case are.
Explicitly state that since “all parties agree to the facts of the case and that dismissal is warranted, there is no reason for further hearings”. Force Sullivan to put his position on record.
I think Sullivan gave them a choice of only 3 dates. Sept 22-24.
I think they need to get Sullivan on the record about things the appellate court specifically recognized as very concerning — but not justifying mandamus since they had not happend yet. For example, fact finding, additional charges and the contempt of court issue. Find a way to make him commit (not decide but commit) on whether any of those avenues will be explored. THEN, they have something to go back to the appellate court with.
There are no “parties”. There is no prosecutor!
There is no case. There is no controversy. DOJ does not have to participate. One branch of Government cannot make another participate. Emmit could hold the DOJ in contempt much like Congress held Attorney General Holder in contempt. But what happened with that? Not even the Supreme Court can force the DOJ to participate. If Emmit wants to force the DOJ to participate, he would have to file with THE DOJ! This is Sydney Powell’s legal explanation in her motion and during the hearing that if Emmit wants to prosecute he has to refer it to a prosecutor. The last time I saw the Judge become a lawyer in the court room was in Ga. when Obama failed to sent a legal representative to court on the eligibility question, and the Judge in that case became a defense attorney. Now Emmit is becoming a prosecutor. The Supreme court has a history of not hearing cases like this. The Certiorari Act of 1925 gives the Court the discretion to decide whether or not to here appellate cases. The Statue “Lady Justice” should have the statue; with the blindfold removed, looking at the scales with a finger on one of them, and using the sword in her hand to cut the other hand off so she never has to pick up the scales.

The process is the punishment. So very odd to think this court has a case and controversy before it. The separation of powers issue is ripe and ‘jurisdiction’ i.e., a case or controversy is always a rip issue. Further – this is a criminal case – not just some run of the mill civil action. After listening to oral arguments at the en bank hearing – that was one hostile and hating bunch of judges. Stone was given wise counsel to drop his appeal case, he didn’t have a chance with the DC appeals court and they could have really screwed him over on remand, and getting cert would have been a long shot.
The process is the punishment. That is correct, they will wear you down emotionally, financially, They have unlimited time and funds and nothing to lose. In this case Sullivan knows he is backed by his supporters and they own DC. We, the people, do not own it. Everyone with a brain knows that the appeals court lied in their order when they said they made the decision “Su Espante” to hold an En Banc hearing. Sullivan filed for that hearing and they waited for the last day to authorize it. If I were Sidney Powell, I’d go right to SCOTUS and argue that Sullivan is a party to the action and has made himself into a non impartial jurist and have him recused from the case.

I want to second your comment and add just a bit more depth to it.
You are absolutely correct that Sullivan and the Deep State are trying to force Trump to pardon Flynn. Reason: Flynn was forced to plead “guilty” to making a false statement to federal agents even though Sydney Powell AND the DOJ has evidence that the plea was maliciously and falsely coerced by the government.
In other words, Flynn pleaded guilty to avoid the government from maliciously prosecuting him and his son. It was not that Flynn did anything wrong, it was just that the Deep State needed him out of government permanently because of the potential for him to uncover the numerous misdeeds (and the perpetrators) of the Obama Administration.
If Trump pardons Flynn, his plea bargain to making a false statement is still hanging over his head. Thus, the taint (or stigma) of misdeed lingers (regardless of circumstances and government malfeasance to force his plea).
But if Sullivan or whomever is finally forced to drop the case–with prejudice (meaning a future Democrat AG could not resurrect the case)–then Flynn’s plea is null and void. The benefit of this would be three-fold; first, it would allow Flynn to purse a civil suit against the DOJ / FBI for malicious prosecution and malfeasance. Second, it would allow Flynn to also pursue a civil suit against Eric Holder’s law firm (which originally represented Flynn) for incompetence and / or conflict of interest.
And last, but most certainly not least, it would leave Flynn’s good name and reputation intact, thus enabling him to rejoin the Trump administration if he wanted to. For obvious reasons, the Deep State cannot allow that to happen.
Don’t kid yourself: the immediate Deep State in this case is Ovomit & Holder. If Flynn doesn’t know where the bodies are buried, he knows where to look for them.

Just appeal his biased sentencing that is coming regardless of DOJ or Flynn’s further participation.
Flynn can appeal decision to SCOTUS. If he loses there, then the President can pardon. In my opinion, a pardon does not necessarily indicate guilt of criminal conduct any more than taking the 5th. After all, there was no prosecution or trial in the Flynn case.
As much as I’d like Trump to pardon, this needs to go to SCOTUS.
The possibility of sentencing Flynn doesn’t scare me.
The only way that Sullivan can sentence Flynn LEGITIMATELY is if he could show that Flynn illegally influenced the decision to drop the case. Like if Flynn paid off the DOJ.
One other way (less legitimate) is if Powell and the DOJ did what some here have suggested …. essentially boycott any further activities of this court by refusing to participate. That would be a really dumb thing to do. Sullivan would likely then sentence Flynn and hold everyone else in contempt.
Short of that, any sentence by Sullivan should be quickly overturned.
Flynn doesn’t have money to pay off anyone. He had to sell his house to pay last set of lawyers and was still 6 million in hole I believe.

Such a sentence, even for a day would be politically damaging. The judge can react if he doesn’t like something Flynn or Powell says. Sullivan can immediately retire. He does not have to be legitimate. Playing Russian Roullette with this judge is not good.
Torn on this BIG TIME! On one hand, I want Trump to pardon Flynn and allow him to get on with his life, but with a Pardon he’d never get a senate approval to work in the Trump admin. However, if he plays along, and Sullivan throws it out after Trump wins in Nov. Trump can bring him in to clean house at the CIA/NSA etc.
Not too sure Flynn would get Senate approval even if the Republicans kept the Senate and Sullivan (or whomever) dismissed the case. A guy like Flynn with an ax to grind would be VERY dangerous to the Swamp and it Critters. Senate Intel Committee would likely nix it.

Since the only two legitimate parties to this case are the government and Flynn and they are already in complete agreement as to how to proceed, why don’t they get together and submit their own joint recommendation? By definition, an amicus curiae is not a party to a case. Neither is Sullivan, but he has inserted himself as some kind of aggrieved party because his feelings are hurt or something and has essentially appointed the amicus curiae as his personal representative. Since his minute order directs “the parties” to come to a joint recommendation and to propose three dates for oral arguments, couldn’t they (that is, the government and Flynn) issue a recommendation and propose the three dates as Sept 22, 23, or 24? If the amicus curiae doesn’t agree with any of that, then too bad, since that person is not legally a party to the case. Then let Sullivan blow up over it, which he probably will. Maybe his reaction will provide good grounds to take it all straight to the Supreme Court?
Sullivan has put Barr on trial. He wants to judge the reason for Barr dropping the case. Flynn is wrongly caught in the middle. This is not justice. It’s politics.
Obama had direct communication with Sullivan to slow roll this case until after the election. I don’t remember if that was from Sundance or Jim Hoft but I saw that when Sullivan; whom Powell praised earlier, came out and started this farce. Tyrant in a black robe !!!
By keeping an innocent man with no prosecutor in limbo until after the election, Sullivan is taking a known political case and making it even more political.

Judge Sullivan really does not care what happens to General Flynn, nor does he care what you and I may come to think of his very being, his rulings, his temperament as a judge and his integrity or lack thereof.
He has a role to play and he intends to play it out to the very end.
As the dust clears, dear friends, he will retire from the bench hanging out with his buds for the remainder of his life, knowing full well there will come a time when he is invited either to his master’s estate in Washington, DC–or better yet, that grand estate in Martha’s Vineyard where he will be given the kudos he believes he richly deserves.
Till then, slave Sullivan will wake in the morning and go to his mirror smiling at his facial hair in that smug manner only those who love Obama know.

Perhaps the real question is: “When will Colin Powell make his special appearance?”
Who made Sullivan Emperor of the Judiciary? Is it unfeasible to simply tell him to “stick it!” and ignore all his chicanery? He’s making stuff up as he goes…creating authority where none exists; and, those who go along with it are proving to be aligned with his agenda-driven intent. This is the United States, not England under King John! Or, am I missing something?
