The minute order filed by Judge Emmet Sullivan outlines a protracted time-frame for the next sequence of events in the case against Lt. Gen. Michael Flynn:
As noted in the order, Sullivan is now telling the DOJ and Flynn defense to file a joint status report outlining their “recommendation for further proceedings” by September 21, 2020. From there a briefing schedule which will require both parties to respond to Sullivan’s personal amicus (Gleeson), and additionally respond jointly to any other amicus not ordered by the court. Lastly, Sullivan is requesting three dates for oral arguments.
In essence, despite his ability to quickly convene the parties to settle all matters before the court; which includes the unopposed motion by the DOJ and defense to drop the case; Sullivan intends to drag this case out as long as possible and use the amicus as a tool forcing responses from both parties (DOJ and Flynn). So much for the “quick dispatch” outlined within the DC Circuit opinion, this case is going on for several more months.
Sullivan is being told to bottle-up Flynn until after the election. The left is terrified of Flynn and what he knows, and whatever that is, it has to be really damaging to The Muslim…Obama’s the focal point of everything.
Certainly if he knows anything it would be out by now. There is nothing to stop him that I know of. This vindictive hate is unexplainable.

Congress has the power to impeach him. That requires a post election Republican congress and enough Senators to convict. The other court available is the throne of God, who is able to do more than we ask or imagine.

States make the rules regarding elections, not the federal government, which is why many democrat governors love cheat-by-mail voting. States also make the decisions as to what ballots will be counted,
Here in NJ, King Phil the First decided that: (a) Every “registered voter” gets a ballot, even though NJ voter lists haven’t been purged in decades, (b) even ballots that are received by Nov 10th (a week after the election) will be counted, if postmarked by Nov 3rd and (c) even ballots with NO POSTMARK, that are received by Thursday Nov 5th at 8 PM (2 days after the election), will still be counted.

I know its not the same thing, but there is a concept in law called “jury nullification” – and in this case, someone needs to simply refuse to acknowledge their authority as a means of invalidating their rule over us.

A handful of questions. Firstly, does the en banc decision effectively set a precedent by allowing Sullivan to use his external amicus, which then allows any district judge to use amicus to examine prosecutorial motives, or is this a ‘one-off’ decision? If it is a precedent, surely it seems to be a very bad precedent that the Supreme Court would want to prevent as it goes against regular order?
Secondly, can the parties formally ask Sullivan to expedite the case? They are in agreement, there is no more evidence required. Can they use a motion to bring that decision forwards? Or to formally exclude the amicus as a party?
Thirdly, does the term ‘appropriate dispatch’ have an agreed legal meaning. It looks like Sullivan will play slow process games. If a judge acts outside the order of the higher court, what sanctions can the higher court impose, and who has to press the case? Do defendants have to seek further relief and so do the casework themselves at their cost, or would a higher court step in separately (eg via a contempt charge) if a lower court fails to follow orders.
It strongly seems that higher courts are unable to manage or control lower courts unless a defendant themselves raises the case. What are the systems of control for the judiciary to ensure it keeps its house in order? Are there any penalties for judges who artificially create additional costs to plaintiffs through ‘proceduring’?
I am not a lawyer and don’t play one on TV… but it has always been my impression that ANY judicial activity from the bench sets precedent.

And what the Appellate court rendered in the Mandamus is in direct contradiction to a SCOTUS ruling in 2019 that was 9-0.
SO expectation is head to SCOTUS and have them slam the DC Appellate for ruling in contradiction to SCOTUS who sets ultimate precedence.

Sullivan has no good authority to flout the law; the appeals court has no authority to let him off the hook (in any way) for flouting the law. Justice Roberts has no authority not to step in and correct them all, and end it. Barr has no authority to kowtow to Sullivan (just say, “The DOJ will not further prosecute Flynn, nor allow anyone else to do so” — Sullivan does not run the DOJ, any more than he or any judge runs the President.
They are all pretending that this is only political, that the system is working (!) and that the people must decide at the next election. But that is all a lie; the law is the law, and it has been tortured perversely, and above all falsely. And the system is utterly broken. Only telling that hard truth, and demanding it from all within the system, will save us.

1) Judge Sullivan is doing exactly what I said he’d do, drag out the case past the election hoping for a change in the Executive branch.
2) Judge Sullivan is dumping an enormous amount of unnecessary work on both the DoJ and Flynn’s legal team. While the DoJ has nearly endless monies Flynn does not, and the Judge knows this. Clearly this is “punishment by process” against Flynn intended to exhaust his financial resources.
3) The only way the District Court could not have seen this coming is if they were “willfully blind.”

Has it occurred to anyone else this whole thing is partly to get Trump to simply pardon Flynn? The question about the purposes for that seem a little unclear, but the responses would be quite predictable. And somehow, I think if Trump were to do that, it might halt a lot of public exposure of what happened here. It’s my understanding that Flynn is still unable to talk publicly about what he knows because of all of this.
Yeah, I no longer believe that Flynn has some amazing hidden evidence to spill to us all, or we would know it by now.
But I would agree there is an effort to try and goad Trump into a pardon so that Flynn cannot serve again, they have the “i toldja so” they want, and so that they can make an example of people who dare to look the deep state in the eye without bowing down.
I’m unclear on this. Typically a conviction might prohibit access to certain roles within government service but doesn’t a pardon remove all convictions addressed in the pardon and therefore nullify any such thing?
There’s a similar reason Roger Stone’s sentence was merely commuted and not issued a pardon I think. I still hold out hope Trump expects there to be exposure of criminal actions and intentions by the Mueller team.
I just noticed that in the criminal docket,, the case is titled USA v. FLYNN. Such arrogance … that is not correct. The case title should read SULLIVAN v. FLYNN, after all, Sullivan has appointed himself to be both judge and prosecutor, with Gleeson representing the interests of Sullivan, and with DOJ and Sidney being lumped together as a single party.

You’re forgetting that McConnell, Graham, Romney, Burr, Grassley, Cornyn and a host of other Uniparty R sect members want to destroy Trump just as badly as Obama and Pelosi. It is a Uniparty afterall. They want Biden to win this election, business as usual. That’s what they’re paid to do.
