U.S. District Judge Cameron Currie has dismissed the cases against former FBI Director James Comey and New York Attorney General Letitia James, under the grounds that U.S Attorney Lindsey Halligan was illegally appointed to the role of prosecutor when she secured the grand jury indictments. James Comey was charged with lying to and obstructing Congress, relating to his 2020 Senate testimony about the FBI’s investigation into President Trump and Russia. Letitia James was charged with bank fraud and making false statements.
WASHINGTON – […] U.S. District Judge Cameron Currie concluded that Halligan’s appointment as interim U.S. attorney for the Eastern District of Virginia violated laws that limit the ability of the Justice Department to install top prosecutors without Senate confirmation.
“Ms. Halligan has been unlawfully serving in that role since September 22, 2025,” Currie concluded in opinions simultaneously filed Monday in both cases. “All actions flowing from Ms. Halligan’s defective appointment … constitute unlawful exercises of executive power and must be set aside.”
However, Currie dismissed the cases “without prejudice.” That could allow prosecutors to attempt to obtain new grand jury indictments in each case. But Comey’s attorneys have already indicated that they will argue that he cannot be re-indicted because the statute of limitations in his case expired on Sept. 30. And Currie agreed that the deadline had passed without a valid indictment. (more)

I see a judicial conflict in VA. This judge rules she is illegally in that role, which means that the VA judiciary has left that seat vacant since 9/22, failing in their duty to appoint a new AG for the Eastern District. So, which is true?
There was an interim appointment (not Senate approved). He resigned then Halligan was a second interim appointment.
The precedents cited in the ruling are clear: The legality of interim appointments ends after 120 days. That’s combined. You can’t start over with each new appointment. Obviously, that would be abused — just keep making new interim appointments to avoid the Senate.
All that said, my understanding is that she can hold the office while waiting for a truly confirmed candidate to get through the Senate, and she can even do most things. But for some things, you need someone legally appointed to be involved.
One guy following the case closely claimed that they could have just had someone who was legally appointed from anywhere in the DOJ overseeing and signing the important documents. I can’t verify the accuracy of that.
What I can say is this is on Bondi, first and foremost. Then on Trump for listening to Wiles, Bondi’s lobbyist buddy, and appointing her. Bondi continues to be unimpressive to me. What I see is a news face with no real legal chops. Gaetz would have nailed this IMO.

I tried, not very hard, to see what exactly was “unlawful” and don’t see much discussion other than it was ruled so and she went after those two because she used to be Trump’s personal attorney and is/was carrying out his unfounded revenge.
Can anyone elaborate if the administration will be successful on appeal? and what’s the difference if her appointment was illegal and Jack Smith’s prosecution — also found to be unlawful?
I doubt the appeal will go anywhere. The legal appointment part is pretty clear, with precedent rulings. DOJ just s**t the bed on that one.
The good news is there’s a 6 month window to re-file, even if the statute of limitations is now up. They have to start over with a new grand jury since Halligan resided over the grand jury. Maybe this time they can get Comey indicted on all three counts (only two before).
A smart DOJ would see the opportunity here to do much better. Not convinced “smart” and “Bondi” go anywhere near together though. Let’s face it: She’s a lousy AG.
