U.S. District Judge Cameron Currie has dismissed the cases against former FBI Director James Comey and New York Attorney General Letitia James, under the grounds that U.S Attorney Lindsey Halligan was illegally appointed to the role of prosecutor when she secured the grand jury indictments. James Comey was charged with lying to and obstructing Congress, relating to his 2020 Senate testimony about the FBI’s investigation into President Trump and Russia. Letitia James was charged with bank fraud and making false statements.

“Ms. Halligan has been unlawfully serving in that role since September 22, 2025,” Currie concluded in opinions simultaneously filed Monday in both cases. “All actions flowing from Ms. Halligan’s defective appointment … constitute unlawful exercises of executive power and must be set aside.”
However, Currie dismissed the cases “without prejudice.” That could allow prosecutors to attempt to obtain new grand jury indictments in each case. But Comey’s attorneys have already indicated that they will argue that he cannot be re-indicted because the statute of limitations in his case expired on Sept. 30. And Currie agreed that the deadline had passed without a valid indictment. (more)
I don’t recall this many judge’s orders stopping almost everything the Administration does.
It’s never been done to any other administration like this that I’m aware of.
I read some time back that Trump has had to deal with this more than all presidents combined since the 1960’s, and a lot more water has gone under the bridge since then.

Ultimately, even though Trump keeps winning in the Supreme Court, they can only take so many cases.

An appellate court may reinstate it if the judge’s ruling in certain instances. There is federal law that allows for refiling after a without prejudice if an indictment was defective, but I don’t at a high level think that this holding regarding the the US attorney’s appointment would allow for it as that wasn’t a pleadings based reason for the dismissal. Hopefully I am wrong.

Because the judge knows they are guilty and the evidence is airtight, so he had to come up with a way to dismiss the case before any evidence was shown. Trump appointed Lindsey Halligan legally. He has the authority to appoint acting US Attorneys while waiting for confirmation.
From what I read, comey is off the hook as the stature of limitations runs out fairly quickly. Not so for james. However, did we expect anything different? Any excuse, contorted reasoning, legal mumbo jumbo, etc. is used to “protect” anyone who tries to screw Trump.

Does this mean that if a court overrules Currie, the indictment was valid the whole time and the case continues?

I may not be correct but I believe Sundance warned us again last week about Bondi. Why would you risk the Comey case knowing the statute of limitations is up? Bondi should know the rules for appointing prosecutors. If there was any risk to the case she shouldn’t have gone forward with Halligan. Surely, another prosecutor in the district could have brought the indictment.

My first question is: Are we really sure that Halligan wasn’t properly appointed? Most commenters are assuming that this judge has ruled correctly instead of as a partisan, and that is not at all clear.
Ultimately, this issue (and thus the ability for the case(s)) to proceed will be decided by Robbie And The Supremes.

Perhaps the inverse is true, also. Did the judge accept Halligan in his court at anytime without denouncing her as unauthorized? If the answer is ‘Yes’, then it follows that she was acceptable to represent the Government case.
If he didn’t boot her forthwith, she would have been – and is – good to prosecute the case.

I hope you are correct. I watched a video about how Lindsay Halligan made some rookie mistakes in the Comey court proceedings. Something about how she submitted 2 indictments or something. I guess there was an error in the first one, so she had to resubmit.
The also video mentioned that the Grand Jury took 2 hours to decide on Comey’s guilt (or whatever they call it when they vote to indict him). The video said that Grand Juries usually take a matter of minutes to decide, not hours. They thought that meant she did something wrong to confuse the jury or something. It was probably either Jonathon Turley or Greg Jarrett I was watching on Fox News. I think Greg is their other lawyer go-to.
It’s interesting that the judge didn’t mention any errors – only that PDJT appointed her improperly.

How is it that in Atlanta, after Willis was dismissed as prosecutor by the appeals court , how is it that the case could continue with a new prosecutor instead of being dismissed, yet in the Comey case, the case is not allowed to continue with a new prosecutor?
I understand the judge dismissing ‘without prejudice’, which he did in this case, means the case can be continued. My guess is with a new prosecutor. That’s why I think Leticia is still in trouble.

Not true. The case against both of them was dismissed, and a new case would have to be brought against James. If the appeal fails, Comey is safe due to the statute of limitations.
Democrat Todd Blanche dragged this out in the first place. He parlayed his work on the Stormy case into the COO position at DOJ. And since Bondi is Absent Without Fox, he’s running the show.

I don’t recall the part of the Constitution that says an Appointee can’t legally do anything prior to Senate Confirmation…
As I said in the daily Presidential Politics thread earlier, I think the law the judge relies upon (28 U.S.C. § 546) is unconstitutional. The Constitution gives the President the power to make executive appointments, not Congress or a judge. Congress arbitrarily put a 120-day time limit in place for DA appointments to be confirmed by the Senate and then said beyond that time limit the power to fill the acting district attorney seat would belong to the District Court judge, who will serve at least until the President nominates a new person, who is in turn confirmed by the Senate within a new 120-day time limit. None of that is in the Constitution.
How can the Senate fail to do their job and then Congress goes and gives the Judicial branch the authority to appoint their own DA? Not only that, but it should not be right that a judge gets to pick the prosecutor in the cases coming before his or her court.
If the Senate cannot or will not confirm or deny confirmation within that arbitrary 120-day limit, then the President’s choice of acting DA should continue to serve until the Senate gets around to doing their job. If Congress had to pass any law about this, then it should have been that if the Senate could not or would not confirm within a set period of time, then the President’s nominee should be considered to be confirmed because of their inaction.
This judge’s decision should be appealed and the law she relied upon should be challenged as unconstitutional.
So an appeal on this ruling ( unconstitutionally allowed appnt ) , if overruled and upheld, would return full Presidential appointment authority, eliminate undelegated congressional actions on same, and continue the original SOL prosecution timeline for Comey??? Hmmm?
Look, Trump should fire that loser Bondi immediately.
Take one of the other cabinet members that has already been confirmed by the Senate, move them to DOJ as a figurehead, hire Gaetz to destroy the DOJ, and establish 20 special prosecutors reporting directly to Trump.
