But Comey’s attorneys have already indicated that they will argue that he cannot be re-indicted because the statute of limitations in his case expired on Sept. 30. The USAO attorney was a Biden appointee and resigned. DOJ, under their appointment power named an “interim” prosecutor, which is valid for 120 days. When the 120 days ran off, as provided in the law district court then has power to appoint “interim” prosecutors. Apparently this was an amendment due to Di Fi in 2006 intended to prevent serial appointments of “interim” prosecutors.
The “interim” prosecutor was reappointed by the district court. Subsequently he resigned. The DoJ then named a new “interim” attorney for 120 days. The judge ruled this appointment illegal (appointment still under authority of the court, not DoJ).
DoJ seemed to realize they were on shaky ground, so they later also named her as a “special” attorney within the DoJ, not within the USAO for the Eastern District of Va. Judge wasn’t buying this either.

The dismissal was without prejudice. So, even with the procedural defect, there is a long line of case law that says: If an indictment is filed within the statute of limitations, the limitations period is TOLLED, even if the indictment is later dismissed for a defect not related to factual guilt.
In his case, the Statute of Limitations is tolled and the DOJ under 18 U.S.C. § 3288 has within 6 months to refile.
The district court will appoint a valid interim U.S. Attorney and re-indict in weeks.

Many analysts are saying that the Statute of Limitations test was met by the September Indictment, and that there is a 6 month timeframe to re-file the case with a new prosecutor.
There is also a possibility that the dismissal is overturned on appeal.

I blame much of this on Thune and his inability to get Trump’s appointments through the Senate. This happened in his first term as well. If Trump can’t see this, and call it out for what it is, then I think all is lost.
They should have had the case totally and properly designed before 20 Jan 2025 and then worked with what was already at the DOJ, but you can see that even after his chosen ones “took over” as titular heads, the place is still ideologically against reform. 90% of the people there would need to be replaced to change that according to an attorney who works on cases fighting the DOJ.

Currie, 77, was appointed to the federal bench by Bill Clinton in 1994. Last month, the chief judge of the Fourth Circuit tasked Currie, who is based in South Carolina, with handling Comey’s disqualification motion. Chief Judge Albert Diaz said in an October 21 order that the transfer was necessary for the “limited purposes in the interest of maintaining public confidence in the impartial administration of justice.” A similar motion by Leticia James also landed on Currie’s docket.

Comey already is taking a victory lap, claiming the decision vindicates him from any criminality. (It of course does no such thing.) He thanked his defense attorneys and DOJ prosecutors who had refused to bring any charges against him, resulting in a purge of the office. Comey forgot to mention that the father of Erik Siebert, the ex-interim U.S. Attorney removed for refusing to indict the former FBI director for making false statements and obstructing Congress, is godfather to one of Comey’s children.
Hopefully his preening won’t last long. Even if he skates on these charges, Comey appears to be a target of the DOJ’s “grand conspiracy” investigation into the perpetrators of Russiagate and decade-long lawfare against the president.
Their first try was to say that the revised indictment had not been presented to the full grand jury. That didn’t fly so they changed direction because legally they can do so. It’s the damndest thing I’ve ever seen but I’ve seen it before. One avenue literally proves them wrong, so they just pivot, come up with an entirely new angle, and keep going. I think it has been described as lawfare? Did any of us honestly expect the lawfare to stop?

in the case against Comey, with the argument regarding the Statute of Limitations, is it correct to assume that the DOJ will need to repeal the current ruling by the judge who ruled that appointment of the lawyer, Halligan, is the reason the judge dismissed the charges – so it becomes a battle in the federal courts over the rights and powers of a sitting President of the United States to hire the people he wants to hire in the executive branch’s Dept. of Justice.
With this ruling, re: the Comey case, is this furthering the liberal mindset to create precedent with their theory that the Dept. of Justice is separate entity and thus immune from the Executive Branch decisions and oversight? Something we heard under the Obama and Biden administrations, that talking point narrative that the DOJ is its own branch of the govt under its own authority apart from the Executive branch.
If so, this ruling must be appealed in order to rein in that false belief that the Executive Branch has no say over who works for the DOJ.
That mistake, authority over the department not being subject to the decisions of an elected siting President, needs to be nipped in the bud immediately.

Legally, that’s not how this works.
§ 3288 only applies if the original indictment was valid.
Judge Currie ruled the Halligan indictment was void because the prosecutor was unlawfully appointed.
A void indictment doesn’t toll the statute of limitations and can’t trigger the 6-month extension.
Bottom line:
The law treats the Comey indictment as if it never existed, and the statute of limitations has already expired.
That’s why § 3288 doesn’t revive the case.

A president cannot install a nominee as acting U.S. Attorney while waiting for Senate confirmation.
Under the Federal Vacancies Reform Act (Vacancies Act), once a person is nominated for a vacant U.S. Attorney position, they are generally prohibited from serving as the acting officer for that same position.
However, the Attorney General may appoint an interim U.S. Attorney under 28 U.S.C. § 546 for up to 120 days, independent of the Vacancies Act, which is what AG Bondi did.
This is what will be the crux of the appeal by Trump’s team.
Lindsey Halligan rushed to replace the resigning or being fired Erik Siebert, and in a matter of hours or days had indicted James Comey and Letitia James. She was some sort of White House staffer previously, working on indicting the Smithsonian Institution for something. After meeting President Trump at his golf club in 2021, somehow she managed to actually be present at Mar-a-Lago, when the FBI raid occurred, according to Politico.
Now that her indictments are dismissed, calls are incoming for Pam Bondi, who appointed Halligan, to resign. Actually, Halligan should resign and leave the President’s team. She misrepresented her abilities by promising and producing actions that were flawed, and she embarrassed if not injured her superiors. Halligan has not earned the benefit of doubt, and she presents as too sketchy to risk further adventures with her.
So you would prefer to skip the appeal and fire Halligan or have her resign. Trump’s team can do without that kind of input.
If you take the judge’s opinion seriously, it is not Halligan’s fault, but the fault of whoever appointed her in a supposedly illegal fashion. Why should she resign or be fired?
Halligan took the appointment, which was outside of the statutory 120 day period. And she signed the indictments by herself. We must ask, if she knew beforehand, that the indictments would be thrown out? We must ask, if that is what she counted on? If so, it was most certainly a strategy to get Comey and James out of jeopardy. What actually happened is, they got off scot free. I always consider if a surprising outcome is intended and not an accident.
Halligan was an insurance lawyer. And beauty pageant participant.

Dismissed without Prejudice tolls the statute of limitations. The DOJ has 6 months to do something with this. I have to admit, I find it interesting the judges reasons for dismissing. Since the President CAN appoint her as an interim AG and she can legally file these charges. I believe that the judge is wrong and other than giving Comey and James some headlines, I believe that this will be overturned. BUT the way it was dismissed extends the Statute of limitations.
Wrong. Once the President nominates her for the US Attorney position, he cannot then make her the acting US Attorney according to the Vacancies Act. But the AG can install an interim US Attorney independent of the Vacancies Act. That is what Bondi did. Perfectly legal.
The interim appointments can only be made that way for 120 days. That’s combined, not per appointment. Otherwise they’d be able to avoid Senate confirmation entirely by appointing a string of 120 day interim prosecutors.
They’re going to appeal based on that description being wrong. I’m not seeing that working.
But they have 6 months to re-file and get it right.

The performance of the past months, as good as it has been, will not prevent the Communist Left from scoring. Even if they don’t get a majority they win.
Mid-terms are looming and I’m seeing squat from the people that should have engineered a win by now.

All here are well aware of my ardent support for President Trump. Well, I’m disappointed. What was MAGA/America First, has been infiltrated by RINO Neocons and Zionist shills. It’s sad. Trump will never learn. His flaw is that he loves adoration and these snakes are aware of that and have used this to slink into his inner circles. I thought after his first term, he had learned. He hasn’t. He had a chance to bring forth the long knives. He didn’t and now they’re undermining him waiting for midterms.
So disappointed. He has cast aside devout MAGA loyalist like MTG, while opening the gates to pieces of shit like Lindsey Graham, who has always been working to undermine him and the MAGA agenda. Mitch McConnell did the same thing.
