Previously we noted RFK Jr’s name would be gone from ballots in the battleground states of Arizona, Pennsylvania and Nevada. RFK Jr will still appear on Michigan and Wisconsin ballots. {Background} However, thanks to a unanimous North Carolina appeals court ruling (3-0, note could be appealed to full court), RFK Jr will most likely be removed from ballots in North Carolina.
The three-judge panel decision [SEE RULING HERE] could still be appealed by the DNC; however, that approach would make the entire Harris agenda in NC look transparently fraudulent and political. With RFK Jr name removed, the odds of a Trump victory are significantly higher.
This decision by the North Carolina Court of Appeals comes one day after a Superior Court Judge, Rebecca Holt, signed an order denying Kennedy’s request for a temporary restraining order against the State Board of Elections. The appeals court decision overrides Judge Holt.
This might present a problem for those North Carolina regions who had already begun the ballot printing process.
Kudos to the RFK Jr campaign legal team for following through on their promise.

Well now, the absentee ballots here in NC have already been printed as they were to start mailing them out to absentee voters today!
And on Wednesday I was able to view and go ahead with printing out a complete sample ballot for my precinct.
So of course JFK,Jr. is on the ballot for President with the ‘We The People’ Party.
And what do ya know, we have seven parties represented with President/Vice President candidates this election.
Just checked my ability to view and print out a sample ballot for my precinct and…nope, they’ve turned that back off.
And lo and behold, they now list 9 political parties in NC(though only 7 parties list a President/Vice ticket).
Going to get mighty interesting around here in the next 2 months!

Polk County NC has 7 parties on their Sample Ballot listed for President of the US. Democrat (Harris), We the People(Kennedy), Libertarian (Chase Oliver), Green(Stein), Constitution (Randall Terry), Republican (Trump), and Justice for All(Cornell West). This sure does LOOK like the old Uniparty routine of Ballot splitting so often seen in Republican Primary elections. The Uniparty is still alive and up to their usual tricks in North Carolina.
Definitely ballot splitting. I feel like they are trying to get the people who would not vote for Kamala to vote for anyone else to hurt Trump.

You could easily argue that what I count as the 8th entity is not a “political party”, but those who register as ‘Unaffiliated’ can run for office as unaffiliated and they make up the largest block of registered voters.
So the list goes like this–

Having wrongly printed ballots hasn’t stopped our secretary of state from sending them out in the past, and then “oops, so sorry, just don’t use the wrong ballot.” That also appeared to be purposeful – I don’t know if it was an effort to have multiple ballots per voter in order to confuse the voter and get the wrong one sent in, or to have multiple things that looked very much the same in order to easily add in yet another kind of fake ballot, or another kind of fraud I don’t understand yet.
In any case I’m sure the company that prints ballots was just fine with the extra order.

Removing RJKjr from ballot in NC should hold even if it goes up to NCSC as patriots have already voted in a Republican majority in the state supreme court in a recent past election cycle.
Should be easier to spot illegal dem printed ballots with RFKjr’s name still on them.

I don’t know about any other “naysayers” but for me I needed to see some action like being taken off the ballot. So now I feel better but am still not in love with the guy. After all, the ONLY politician that ever showed me his word could be trusted is President Trump, who is Not a Kennedy.
Jr. still makes it all about him. He doesn’t have the feel of a team player, or something. President Trump is a warm person, Jr. is cold. This is the weirdest election of my lifetime. We are in for a wild ride.

Good question, Val. Mathematically, your idea is simple. Legally, it’s anything but simple. Votes must be counted according to the law, and your simple formula is not written in the law. You could attempt to get the legislature to pass a law to count the votes that way, but oh my goodness that would be hard. And it is generally frowned upon (for good reason) to have laws name specific people.

Just a note. In the 2022 election, North Carolina voted into office Republican NC Appeals Court and NC Supreme Court judges. The importance of those positions was highlighted in 2018-2020 when the Democrat-controlled NC Supreme Court continued to turn down voter ID as being racist. In state referendums, the people of NC had overwhelmingly approved voter ID, but the Supreme Court continued to block it.
Since 2022, with a Republican majority, the NC Supreme Court finally approved voter ID and in the primaries, voter ID was required – though there are bunches of ways to provide that ID and to vote.
Becky Holt, the Superior Court judge who denied Kennedy’s request is a Wake County judge. Wake County is one of the bluest counties in NC.

To use Sundance’s words … there are voters who “cast their own ballots” and there are BALLOTS completed by a proxy and dumped and Voter Cast Ballots that are FLIPPED somewhere in the process, digitally or replaced with a DUMPED Ballot after the “Voter” Casts their Ballot.
RFK Jr is legally still a candidate who can legally receive votes via WRITE IN … what stronger candidate can there be than one who’s name is entered as a WRITE-IN (///sarc) … Suspended = being a legal candidate .. and/or … = retaining status as a candidate under the State Laws where RFK Jr met legal requirements after submitting his name.
OK, RFK Jr ‘s actions works for a very large majority of “VOTERS” but has zero effect on “BALLOTS” Flipped or delivered en-masse (i.e. DUMPED INTO the pile) in place of erased votes for President Trump.

RFK Jr has to LEGALLY END his campaign and have Election Officials in States where he is a candidate declare his name is withdrawn as a LEGAL CANDIDATE in that State. Removing a name from a Ballot does not END the eligibility of a candidate to receive votes.

Suspect “suspended” is due to compliance with FECA 1971 and FEC regulations for campaign committees.
My state (Hawaii) does not have any concept of “legally end” that I can see. RFK Jr has qualified as a petition candidate and has been so certified by the Chief Election Officer (Scott Nago).
The only “withdrawal” method I see is HRS 11-117 for “ill health” with a doctor’s statement. The withdrawal window ends on 16 Sep.
There is no “write in” in Hawaii and no way to receive votes if not on a ballot.
Note that the “withdrawal for health” has had a controversy here. Sitting congresswoman Patsy Mink (D HI-2) was reported to be in the hospital for some minor medical issue. The day AFTER the withdrawal deadline she was declared dead and so she remained on the ballot (and was elected), resulting in the need for a special election where the Ds could put forward their preferred candidate. Since then we now have “ranked choice” voting for these special elections, as the Ds were afraid of a “splitter” situation.
Printer Musings: Dems fight like hell. NOTE: They will probably harvest against their interests to boost standing in other courts and make it look like it was T’s team that did it. They’ll use capricious exit or some other stupid argument and find a judge who will allow standing. They did that last time in PA (denied only because same judge heard Elias in both arguments for and against complaints from the party with the lower vote total and she had an ounce of self preservation to know she couldn’t rule on both in Elias favor for using the opponents arguments that she just denied)
What about the guy that did jail time for posting on Twitter encouraging people to vote by text message or social media? This is the exact same thing. Encouraging people to throw away their vote.
