Michael Flynn Hearing Today 11:00am – Open Discussion Thread

The DOJ, Sidney Powell and the Sullivan appointed amicus John Gleeson will hold a hearing today in the courtroom of Judge Emmet Sullivan to argue the unopposed motion to dismiss the case against Michael Flynn. The hearing begins at 11:00am ET and you can call-in to hear the audio of the live courtroom events.  (details below)

If the true administration of justice was to prevail in this case, the judge should simply accept the unopposed motion and this would be the end of the malicious prosecution.  However, this case has so many precedents anything is possible.

    Sullivan’s bias is so obvious to anyone. I doubt it but perhaps he is having a show hearing to appear to have put up a good fight before he dismisses. Never mind, Sullivan is a lost cause.

    this is an absolute CLOWN SHOW. You have the prosecution AND defense both arguing to the court establishing a basis for a dismissal. In a world that made sense, the judge would say “okay lets dismiss, lets call it a day”. But no we have this continued back and forth on and on with the judge pretending that he is considering both sides…just surreal.

    DOJ does great job of explaining why the case cannot be prosecuted, whether the defendant is politically connected or not. Now Suspicious Sullivan asks if he can draw an inference from the lack of SCO attorneys participation that this is “Monday Morning Quarterbacking.” Invokes again that he has to look to the “fair administration of justice.” Then he asks about a motion for reconsideration being more appropriate. DOJ lawyer beats this back. The evidence did not match up to the Statement of Offense. Messages among the analysts questioning why the investigation goes on that “has no logical basis.” Returns to Barnett — told the SCO there was nothing “there” as to Flynn. Jocelyn Ballantine and other career people are defending this motion to dismiss.

      There appears to be an important dance here. Sullivan doesn’t attack the DOJ, and Kohl doesn’t attack the Judge (they won’t ask for recusal, that would be a defense attorney’s job).
      Sullivan doesn’t like Sidney. Likely because she’s been in the press, I think, talking about Sullivan, initially praising him (due to the Stevens case) and more recently panning him (due to Flynn and Sullivan injecting his
      Sullivan doesn’t like Trump. He’s going into Twitter now.
      Mooppan is weaker than Kohl. So Sullivan moves certain questions to him. Now he has Mooppan defending the president’s tweets, tho he’s trying to distance from the Tweets.
      Sullivan isn’t dumb, he’s crafty. Or he has an earpiece (like Biden’s).
      But Kohl is awesome — gifted. He dismisses the tweet issue so well.
      This afternoon’s headlines will accuse Trump of interfering in the DOJ’s decision to dismiss, with calls for impeaching Barr … impeaching Trump.

    Sullivan is partisan, for certain. Atty Robert Barnes said he’s dumber than a bag of bricks. But I don’t agree. He’s slippery, working hard to articulate reasons to dismiss what’s favorable to Flynn and laboring to press the (old) DOJ claims against Flynn.

      That’s part of the whole Coup Investigation….this hearing is active to prosecute all parties to the coup. Crazy times. This charade is running parallel to it being entered into future evidence to convict hundreds of DC filth. And ultimately an EX-president now in the shadows.

    Just reading the comments here. My instinct tells me that this Judge just gave Sidney so much information on the record for abuse of power and distortion of justice.

    I strongly feel there is going to be a giant boomerang about the proceedings today. He apparently got carried away by his own disgusting snobbery and fear that Sidney has revealed his part in this disgraceful coup.

    I think AG Barr is aware that this is headed to the SC and is saving his best attorneys for last.

    AG Barr Sir, the ball is in your court. If the Justice Department has standing and you really want to save the Justice Dept. and FBI, now is the time to go full bore at this terrible injustice. The American people are looking to you to ensure that justice is blind and save them from political tyranny from the courts.

        The problem is hardly anyone in the media will tell the public of the truth about this fiasco, so Sidney has to be on these interviews in order to get any semblance of balance.

        It is just like President Trump having to tweet the truth since the MSM buries it under mountains of false narratives.

      It’s possible. However, I think he’s trying to extend it beyond the election so that the Newly Installed President can re-reverse the DOJ’s decision. Harris has already said that the case will be fully prosecuted if Biden is elected and the new AG appointed.

    I can’t listen to anymore. Its utterly frightening that a judge can take control, and twist facts. He needs to be impeached.

    Imagine what this biased monster would do to an ordinary citizen without funds. His prior cases need to be looked at, as does any case overseen by the FBI. No trust, no faith left. All I can do is vote.

    He keeps claiming that he trying to make the “right decision for the right reason.” Now says he was “floored” that there were allegations of alterations by Strzok’s attorney. “Very unsettling.” What a jackass. Why is it not “unsettling” to him that Flynn was set up? Now Sullivan pivots to how, if at all, he can take into consideration POTUS’ tweets.

      It would be cleaner to do that. If he doesn’t, and if it’s dismissed, the left will accuse Barr and Trump and Sidney with interfering with the charges. And that won’t have a thing to do with Flynn’s innocence or guilt, just the perception of having talked. And Trump’s tweets. Impeachment is used to smear and to give the appearance of taint, even if there is none.

        Would the gag order on Flynn be lifted if he is pardoned? If not, a pardon is not cleaner. Flynn MUST be allowed to bring his intelligence knowledge of O admin corruption forward. Remember he WAS the “insurance” plan, they HAD to shut him down and shut him up b/c of what he knows.

    AG decision not based on tweets; if so, they underscore propiety of dismissal.
    Sullivan asks for ‘what weight do I give’. He Just Told Him.

    Smart move to bring up ongoing involvement of DOJ officials on case with his Court.

    Sullivn has a long list of hopes-to-find: rabbit holes on “why didn’t (Van Grack) sign”
    wish they would give real answer of misconduct, but DOJ want to contol as internal.

    Now back to doubting Fokker clarity: getting schooled again.

    Sullivan seems very concerned that members of Mueller’s corrupt team of lawyers were not given the opportunity to weigh in on the DOJ decision to drop the prosecution. That’s at least three times Sullivan brought this up.

    DOJ won’t prosecute. Powell proves it was a railroad job against Flynn. Sullivan still talking after three hours of hearings and won’t let it go. So much of this is law class arguments. Process trumps facts. Embarrassing to the law profession which is supposed to protect the innocent.

    The fact that our judicial system has been allowed this atrocity quite frankly frightens me. Between this and everything else we know if PDT does not get a second term our country is done. Over. Kaput. Stick a fork in it.

    This judge needs to be removed from the bench without delay. Sad this cant happen.

      Our country was over after 9/11. That’s when I first became afraid of our government that had shut down the Minnesota agent, dissembled about everything else later to get a war going and put up a huge PR business with the “embedded reporters”… and encouraged Americans to rat on each other to the government, as if we needed a Stasi (instead of reasonable border controls and scrutiny of incoming terrorists to keep them out in the first place)

      What will we do to restore the ideals and principles our ancestors gave their blood and strength for? Trump’s doing his part, we just have to figure out what we can do, and when

    Nothing is going to happen for at least a week so Suspicious Sullivan can take in additional information. DOJ says to Suspicious Sullivan — stick to the facts and stop straying away from those facts. Now Suspicious Sullivan again questions why no SCO attorney signed on to the motion to dismiss. DOJ says you give that no weight. DOJ decides what lawyers are on cases, that is a separation of powers issue.

    Now he quesitions whey he should follow the Fokker decision. Claims that the most of the decision was dicta and not binding. He is much more out of control that I ever anticipated. DOJ does a good job here shutting down this line of reasoning.

          I think Sullivan is in real legal jeopardy because he betrays his loyalties to “Eric” for example, the bizarre questions utterly detached from the law, and then you really have to wonder what his communications are outside the courtroom to people like his amicus and to #resistance lawyers. When this thing gets thrown out, if I were Flynn, I’d add him to the lawsuit. If I were DOJ, I would put him on notice that they are going to be investigating his insane departure from legal precedent in a case in which he clearly has shown and demonstrated bias.

          He’s in on the coup and should be prosecuted like the rest of them.
