The death of supreme court Justice Ruth Bader Ginsburg was announced while President Trump was holding a campaign rally.
At the conclusion of the rally President Trump approached the media and found out for the first time that Justice Ginsburg had passed. This was his immediate reaction:

Ted Cruz has correctly identified the constitutional nightmare of a 4:4 court with the strong possibility of the election being contested for a myriad of reasons by the myriad of lawyers already assembled for that purpose. What he fails to say is that any delay in ruling may, unless my admittedly imperfect knowledge of your Constitution is wrong, result in a lengthy period under interim-President Pelosi with all the havoc and devastation that will entail.

The newly elected House’s state delegations (all the Representatives from each state together cast one vote) elect the new president, as the new House and Senate are seated weeks before inauguration day. The Speaker is only third in line should something catastrophic happen to the president and vice president.
This assumes state and local elections are settled before the state electors are certified for the Electoral College. The red states will have no trouble because they’re not doing mail-in ballots. For those who are doing mail-in and cannot certify their senators and representatives, they may forfeit their votes. Not sure.

Will, you need to read your Constitution a little more closely or use a bit of reading comprehension. The Constitution specifically allows the Senate and House to develop “Rules to conduct business”. Since the established Senate Rules calls for hearings such procedure is Constitutional. Yes the Rules can be changed if you want to add that fight on top of everything else.
Since rules are set by each chamber and are NOT constitutional in nature nothing in the US Constitution requires a prolonged hearing. Those same rules you grouse about can be changed in the respective chamber by a majority of the members present. The US Constitution in contrast requires a 2/3 majority of BOTH chanbers and 3/4 of the states to legally amend. That is quite a different animal. Maybe YOU should read your constitution more closely.

The number of SCOTUS Justices is not constitutionally mandated. I believe for the first like 50 years it was set as 7. The structure of the judiciary is set by the legislature as per the US Constitution. Article III established the Supreme Court but does not set its number or the junior courts to it, Congress does.

Anyway, one thought that I keep having is that regardless of anything, this development gives Mitch McConnell leverage. Leverage over PT and leverage over the Dems. RBGs death gave Mitch power, pure and simple.

I just checked the constitutionality of a recess appointment and it states: “Thus, when the Senate is in recess, the President may make a temporary appointment to any office requiring Senate approval, including filling vacancies on the Supreme Court, without the Senate’s advice and consent.”

If #1 and #2 actually happened, then it just summed up her total life’s work on the SC. That would be her interferring with the dictates of the Constitution with her dying breath.

Trump is no dummy. He’s known for years that this was going to happen. He’s been prepared for it. He paused, confirmed that it had happened and then paused again before he spoke.
What he said was decent and reasonable, I expect nothing less.
The more telling to me is during the debates four years ago with Ben Carson. When Carson didn’t hear his name, because the applause for the previous candidate covered it up. Trump waited with him until it got straightened out. Totally classy and caring. I’ve shown that video many times when people denigrate Trump for being crass and uncaring.

That was in February of 2016 and yes it showed the president’s compassion as a person; which the crooked media totally ignored and indeed they recently distort & twist everything he does to make him seem like “Trump has no empathy.” That is perhaps one of heir biggest lies. The media is the enemy.

She was out of line back in 2016 when she endorsed Mrs. Clinton and bad mouthed Donald Trump. A supreme court justice speaking out in favor of a presidential candidate was unprecedented in modern times but she got away with it. The Chief Justice did not publicly reprimand her and the crooked Press praised her. May the president take his time setting forth a replacement nominee and let the democrats and their lapdog media howl at the moon for a few weeks. He can announce the next justice on the day after the election.

Trump is a class act. In looking for a replacement I suspect that his recent updating of the SCOTUS list is a tell. It is also curious that he has so many senators on the list. I would suspect that it would be hard for mugwumps (a person who sits with his mug on one side of the fence and his wump on the other) such as the Utah senator to ignore a vote if it was a friend and colleague

Trumps response was so honest and moving it should included in as many campaign ads as possible. It was a “perfect” response for these times.
As CET says, a woman would go a long way in helping get the female vote and it would be most a appropriate appointment. Keep in mind folks, the left will have a hard time personally destroying a woman or black nominee. Is anyone on the list that checks both those boxes?
The left will go all out using process to try to stop an appointment because any rioting or evil or personal destruction will only harm their chances of taking the senate and white house. The difference between the M Garland vote for SC and this administration’s vote is that Obummer was not an incumbent, and PDJT is. For Garland, there would be a new incoming administration no matter what. PDJT is the incumbent and still has a chance to continue his administration for another 4 years. So preventing him from going forward with his chosen SC justice interferes with his potential continuing administration…..(exactly what the dimms have been doing for the last 3.5 year), but is a somewhat different type of argument in favor of POTUS going forward with his choice.
