Flynn Defense Files Supplement #2 Motion to Dismiss – Includes New Exculpatory DOJ Release…

Earlier today Sidney Powell filed a new supplemental brief (#2) [pdf here] in support of the unopposed motion to dismiss.  The supplement covers the defense position on the newly released information from USAO Jeff Jensen which includes: notes taken by Tash Guahar at a January 25, 2017 briefing; the FBI work product that was an outcome of that briefing; and later notes by acting DAG Dana Boente.

The notes and FBI briefing summary are also on pdf here and embedded below.  It’s a lot of granular information to consider – so it’s worth beginning with the filing by Sidney Powell to see how the evidence released pertains to the current status of the case.

On January 25, 2017, the day after Flynn was interviewed by FBI Agent Peter Strzok and FBI Agent Joe Pientka (he’s the redacted name per his status under an ongoing protective order) the DOJ and FBI group assembled to discuss the Flynn interview and what steps they would take to frame Michael Flynn as part of their ongoing resistance operation.

Tashina Guahar from the DOJ-National Security Division was taking the notes.

Notes of then Deputy Assistant Attorney General Tashina Gauhar, reveal a January 25, 2017, meeting of ten officials including FBI General Counsel James Baker, Bill Priestap, Agent Peter Strzok, and [redacted]; from the National Security Division of DOJ: Mary McCord, George ZT, and STU; from the Office of the Deputy AG: Tash, Scott [Schools], and [redacted].

Additionally, when reviewing the notes and FBI briefing summary it’s worth remembering the release only covers the information pertinent to Michael Flynn; hence the non-Flynn material is redacted (even though some of the non-Flynn material we previously found). [Thanks to Techno Fog for that reminder]

One of the key aspects to the notes taken by Tashina Guahar relates to the group discussion of their own leaking of information to the media, which they worried had now alerted the Trump administration to the nature of their intelligence surveillance.

The resistance group’s media leaks, intended to undermine the Trump administration, “changed the dynamic” by informing the White House that FBI agents were intercepting communication from White House officials.

“Media leaks – re intercepts” pertains to the group telling their allied resistance operatives in media about the Flynn calls.  The leak of the Flynn-Kislyak call was one of the more dominating narrative headlines at the time.  Yes, it’s quite a surprising admission to admit their own leaks pushed the “investigation in the open” which “changed the dynamic”.

Here’s the attachment with three segments: (1) the Tashina Guahar notes; (2)  The typewritten FBI summary of the meeting; (3) the handwritten notes of Dana Boente.

The FBI summary of the briefing is an interesting, albeit troubling, dive into the mindset of a resistance group determined to make something unlawful out of ordinary contact between the incoming National Security Advisor and foreign officials.

The basic conflict, the fulcrum upon which they ended up deciding to move forward, surrounded the definition of the word “sanctions.”   Flynn never discussed ‘sanctions’, or ongoing punitive policy positions, in his call with Kislyak.  However, he did discuss not escalating tensions by reacting -beyond a reciprocal manner- to the expulsion of Russian officials; that is an entirely distinct difference between the “sanctions” imposed by the Obama administration.

In order to advance their “Flynn lied” narrative; the group merged the expulsion of the Russian officials into the ongoing “sanctions” against Russia.  In essence, they called the expulsions ‘sanctions’, and then set about saying Flynn lied when he said he never discussed those sanctions.   It was a strategic lawfare approach to parse words and meaning in order to advance their legal attack.

Four years of this bullshit over the word “sanctions.”  Think about it.

BTW, there is no way Soros is spending his own wealth on all his “philanthropic” activities to sow, foster and support global dissension through so may front organizations. This has to mainly be US taxpayers funds sent to other countries in form of nation build or humanitarian relief. this money is then stolen and laundered through Soros.

          Agree with your general assesment.
          My deepest concern relates to Barr and Durham. We are well over three years into knowing of the Coup attempt. Not one underling has been arrested, had their ovaries or testicles put in a vice, and been encouraged to talk.
          Grassley is correct, we deserve to see at least a portion of this investigation bear fruit well before the election, and it’s almost mid July.
          I have defended Barr and Durham, as most Treepers know, but the traditional investigative tactic of nailing the jr. conspirators publically and soon is necessary.
          We are basically in a cold civil war in this country, which is hot in places. The enemy force attempted to overthrow a legitimately elected President. The enemy force needs to pay for that, or we no longer have a rule of law.
          That needs to start happening now, AG Barr. We know there are jr. Players like Klinesmith that criminally broke federal law, and he is just one example. Unseal indictments on the criminal underlings who falsely swore, lied, made sh%t up on 302’s etc.
          The cold anger will go very hot if justice is not done. That will be your legacy AG Barr, if you don’t get off your ass and act on the oath you took.

          Sandra Day O’Conner did not come from a Federal Circuit court. She was an Arizona state court judge and Arizona State Representative, but I think she’s an exception. I got to have a private (4 people) lunch with her in 1997 while she was still on the SC, an experience I treasure.

      None, he has been called to action. Sullivan made a name for himself with the Stevens case but everything he did was after Stevens conviction and subsequent removal from office. The damage was done but the swamp takes care of the swamp so they exonerated him. I don’t know why Obama and Holder took him out, Stevens was a liberal Republican that voted with the democrats on a number of issues. I wonder if he had signaled to vote against Obamacare.

        James: Unfortunately, POYUS has no authority over the Judicial Branch. As far as I can tell, no one does. They supposedly police themselves. Congress can impeach a Federal Judge, but it rarely happens and they usually have committed a crime.

        Sullivan is doing what he is doing because he knows he can get away with it. The D.C. Circuit could remove him from Flynn’s case, and dismiss it.

      I have one little glitch in this that came to light the other night when listening to Sidney being interviewed about this whole case. Up until now she lavished praise on Sullivan, it’s in he book, Got me thinking. He may be blackmailed, well knowing his kids are rotten to the core I know he is but, could he want this case open to expose the lawfare apparatus? Bring these people into the case who are responsible. DOJ dropped it when the heat from Sidney Powell hit.
      She could/would never be chosen or confirmed as a AG but maybe she can chip away from the outside? Obviously nobody else will, in government, not you Sundance, (if they just followed your site and applied the law, this would have been over before it started.)
      If no evidence is given by the judge then my theory is dead. Small chance, very small that he is trying to clean up anything. Anyway!

    • Agree, the tempo is ramping up. One note of caution on the Maxwell arrest – it was Audrey Strauss (Bermans right hand) who arrested Maxwell. Barr was not allowed to choose his own replacement. While the timing of the arrest appears to be good, I am skeptical of the strategy of Strauss to arrest now – seeing as they have probably been keeping tabs on Maxwell awhile.

The “protests” that lead to the aforementioned evils, and the “greatest” of all false flags to ever be perpetrated the kung flu HOAX. It’s all in the rockefeller/gates playbook on that end, and the rest is cabal evil as usual.

      The bright side of it all is that it has definitely awakened those who just want to be left alone to live their lives, etc… the silent majority isn’t asleep, at all. Hell, those who have awakened through this madness CAN’T sleep.

      But it’s all going to get much much better, with a great resolve. Term Two.

    The releases of these notes are presumably the result of Jensen/Barr’s review of Brandon’s mishandling of this file (as well as that of the FBI), and released in accordance with Brady.

    The releases are also a sneaky way of undermining Sullivan’s goal of having Gleeson do “discovery” about what went on with the decision to dismiss Flynn. Each piece that’s revealed gives more and more credence to Barr’s decision to dismiss the prosecution.and diminishes the argument for Gleeson. It’s all in the record for the DC Circuit to see (and Sidney to discuss in her response to Sullivan’s en banc petition).

    While I still would bet the Circuit does not grant en banc, the releases would bolster the argument, “Look at all the evidence for dismissal Sullivan has seen. What more could he possible need to see? What is there left for Gleeson to look for” Sort of non-discovery. discovery.

      This filing is a supplement to an earlier filing. The purpose was to put the newly declassified notes into the court’s file. She will still file a reply to Judge Sullivan’s request for an en bank (whole panel) review of the 3 judge panel decision that told Sullivan to dismiss the case.

    – Flynn and Kislyak never spoke about sanctions
    – the DOJ prosecuted Flynn for lying to the FBI where the alleged lie was that he claimed they never spoke about sanctions

    Sullivan will not let Flynn off the hook until he is ordered to by the Appeals Court, who would give him 5 days to dismiss the case or be found in contempt. Then he might ask the Supreme CT. to grant a hearing.

    Sullivan is dragging this out until November. No doubt. I disagree with all the hype about what Flynn has on everyone. Sure he does, but the main thing here is Sullivan doing the bidding of the DS.

    Sullivan is a “scared judge walking”, and if they could get to a corrupt judge like Sullivan, they can get to anyone. Sad to see in our country.

    I am wondering if the latest push to extend this from Sullivan is in part due to President Trump considering to bring Flynn back in to some position of power. As well as to extend things and add to the costs of his defense, it may be Sullivan is working under orders from Obama (recall the perjury charge Obama leveled at Flynn, which seems to be the direction Sullivan is trying to keep alive). It blunts Flynn’s message, anything that Flynn says, by claims he is a liar. You know the media propagandists will push that meme.

    Obama didn’t like Flynn, but this is far beyond that as to motivation to take Flynn out. It makes me wonder what Flynn was likely to do that he was the first to be taken out by the cabal. Obama seems to be still worried about what Flynn could do, so this and any other means of delay are being employed. Must be a lot of scrambling of the rats going on to continue covering up things. What could Flynn possibly know? There has to be something there for Sullivan to keep exposing himself as a political hack.

        These questions lead to another I have been at a loss to understand. Why “go all in” on Flynn. I don’t think this is just a stupid bull-headed Judge. I think the whole Lawfare-Obama Cabal is behind him, probably directing him, and dedicated to making this Flynn matter a big fight, when it seems it ought to be minor skirmish.

        Do they just fight like the Japanese on Okinawa on every single issue involving anything Orange Man Bad? Or is there something they fear about Flynn being exeronated? Or do they just want to force Trump to pardon him? Or do they fear him getting on TV leading up to the election and talking about how he was treated?

        I have asked before of the many people on this board who know more than me, but have never gotten a good answer.       But what if Flynn knew? What if all of this was planned from the beginning or even before the election? Few want to consider the potential that this was all part of a sting operation. Soetoro and cabal are probably subject to a much, much larger RICO style operation investigation since then with a multitude of other crimes involved. Why else would there be full out terrorist style attacks using every conceivable style of weaponry (violence, Lawfare, bioweapon, ballot harvesting, etc.) on PDT, Barr, Freedom Caucus members, PDT loyalist Senators, national law enforcement, and We the People – at the same time?

      Either Jensen is still researching, still digging, and an outlet for those honest FBI and DOJ to bring out the truth, or he has given Barr a pile of stuff and is releasing it piecemeal to Sydney under Barr’s direction.

      The first releases angered Sullivan. They were enough that Sullivan should have ended the case. Instead, he ordered Sydney to stop filing until the Government was finished. (I haven’t seen that she has said she has been told that the government is finished yet.)

      So Barr moves to have the case dismissed. Using the bare minimum of reasoning and evidence sufficient to prove it necessary. And Sullivan becomes totally deranged.

      Note that if the case is dismissed, there is no longer a justification or requirement to make this public. It is first to go to the secret court. So once the case is dismissed the remaining information stays out of the public.

      So the damning information release resumes. And we find more and more malicious behavior against Flynn to attack Trump. Official malfeasance.

      After refusing to dismiss, we have been shown about Obama, Biden, Yates, Boente, etc. all being in on falsely accusing Flynn and arranging to frame Flynn, and doing so in the face of evidence that he was innocent. We have learned much more than the initial evidence that showed the investigation was closed and that there was no grounds to interview Flynn, so that any statements in that interview were not material.

      And the information keeps coming out. In chronological order. When will we find out why they didn’t do anything? (Except continue to falsify 302’s.)

      More importantly, when will we see records on how Mueller and company dealt with all this evidence showing Flynn’s innocence?

      There is also a tie in between Comey’s one on one interviews with the President that hasn’t been established yet but must be there. Comey has full knowledge that Flynn is innocent, and that he is being framed at the highest levels of the DOJ and FBI. And uses this to attempt to frame Trump for obstruction of justice.

      And Comey, at a minimum involves more of this same frame Flynn team in documenting Comey’s frame Trump notes. These two actions are not separate. There should be more damning mtg notes to come.

    I wore one of my Trump t shirts yesterday because I realize now with Flynn, Stone, riots, statues..lack of, etc. We are being silenced. Tucker Carlson is spot on when he said, “If they control your speech, they control your mind.” I can’t be passive anymore. We have been silenced whether we want to admit it or not. If the left wants to confront me, bring it on. It’s time to show America how many of us exists. We owe it to our country and Trump. The more of us that openly stand for Trump gives those on the fence hope. Yesterday i got the dirtiest look fom this woman in the grocery store. She stared at me forever as i went about picking out blueberries, and IT FELT SO GOOD to have my Trump t shirt on. It quietly said, I EXIST. I am going to wear my Trump t shirts every weekend. I do not want my country to turn into Venezuela. We all need to have courage like our ancestors, Paul Revere in mind, and save our country.

      302, I wear my MAGA red cap every day to walk my dog in the park, just to make sure folks see we are here and not silent. I get a lot of compliments from people who wish they could be bold. Occasionally some push back from the brainwashed prog minions. I think the many ballots cast in 2016 for PDJT by so many who are uncomfortable in public, will be magnified in 2020 in the privacy of the voting booth. No poll can capture this truth.

    What is it that Flynn knows?

    Here are my top 5 best guesses.

    1) He knows they used the NSA database with specific contractors to illegally gather information on thousands of Americans including Federal Judges from 2012-2014 for the purpose of future leverage.

    2) He knows people in the prior administration provided weapons to known ME terrorist via Libya.

    3) He knows that part of the Iran deal may have included financial kickbacks and/or its connection to Uranium One.

    4) He knows about Money Laundering Schemes via NGO’s that provided kickback and funding for their socialist, anti-America agenda.

    5) He knows about the corruptness of the IC and was going to investigate them and possibly expose them as PT Nat’l Security Advisor.

    Frankly, anyone of these would be pretty damaging with criminality attached to it.

    I hope it is #1 because that should open pandora’s box and expand any investigation to include the Hammer Program where it is much easier to connect to the top dogs as there were only 2-3 layers back in 2009.

    So, yes, if any of these are indeed what Flynn knows then here is your reason why the top dogs what him kept under wraps until post election where they steal the election via massive mail in ballot voting fraud.

      The CIA Libya station was laundering arms deals to ISIS through the Ukrainian arms dealer that is a contributor to Pelosi, Schiff and other DemComm traitors campaigns. It was all done with knowledge and approval by Brennan and Obama. The Ambassador to Libya caught wind of the scheme to arm and build ISIS and became a liabilty. Hence the Embassy op set up by Brennan, Hillary and Obama to take him out.

    I guess Comey DID manage to find “the RIGHT people” to put on this didn’t he? Not the “best” but the “right” people, those who’d do whatever it took to manufacture a semblance of a “crime”.     I’m not surprised by much of anything I see or hear any more, but still, if you, in a calm moment, really contemplate that wearing a t-shirt supporting your preferred candidate has become an act of (real and true) courage, you realize just how bad things have become, and what sinister forces are at work that make it so. Conservative_302 is correct. We all need to start engaging in acts of rebellion and disobedience against the nihilist forces of censorship and silencing. I have seen through real experience that there’s really no utility in trying to reason with the opposition (ultimately and almost without exception they will simply scream ‘racist!’) except to say to them, out loud, ‘You will never silence me. Ever’ and leave it at that.

    Where I live, up on the northern frozen tundra, we are pretty well insulated from all the madness that’s happening, but I know that if we don’t fight back it will spread to everywhere that it isn’t already. It only requires courage on our part and we will win, win easily even. The opposition are moral and political cowards who will wilt in the face of a unified opposition. Apparently our politicos won’t provide the courage so we must lead by example. We will settle for nothing less than victory over the dark forces arrayed against us. Good luck and God bless you all.

        This was filed with the trial court (Suspicious Sullivan), not the appellate court (DC Circuit). Flynn is basically adding to the already existing record of Brady violations in support of the previously filed DOJ motion to dismiss.

      I don’t disagree with you in theory. The problem for most is that they fear losing their job/income. I’m a small business owner and it’s always been a rule never to discuss Politics or Religion. Many major corporations seem to think supporting a Marxist revolutionary cause is apolitical these days. I personally don’t have to fear losing my job, but I do fear media/social backlash forcing people to avoid my business because, not because they believe the that my company would be “racist”, but over fear of simply being associated with a business that’s been labeled. It’s really amazing how an institution like the Media can have such low favorability ratings and yet still have so much power to influence. The problem there is that people only watch/read media reporting that supports and reaffirms their world view. Those polls reflect their feelings about the press/media that they don’t agree with.

      John I have come to many of the same conclusions you have and am standing up whenever I can. I take a different approach when someone calls me racist. I tell them to go look in the mirror if they want to a racist. And firmly say I won’t let a racist call me a racist. Walk away and end of that discussion. Can also throw in as your turning to walk away from the racist, only racist are members of the racist Democrat party.
