Day Five – Senate Impeachment Trial, Defense Begins – 10:00am Livestream…

There will be 24 hours of presentation by House Impeachment Managers (over 3 days); 24 hours of presentation by Defense team (over 3 days); 16 hours of Senate questioning; 4 hours of closing arguments, equally divided; and then a Senate debate/vote on further motions to include witnesses. If there are going to be witnesses, they will first be deposed prior to testimony. No witness testimony will be permitted without first being deposed.

The Senate Trial continues today on day five at 10:00am ET. Today is the first day of the Trump defense and will only be three hours long by request/agreement with the Senate.

      The actually need to use the words LYING and LIAR. This morning one of the attorneys asked the question, “Why didn’t Adam Schiff testify in front of Chairman Nadler’s committee. Think about that.”

      Instead of the imperative, “Think about that” he should NOT have minced his words. Fo the TV AUDIENCE, he should have stated, “He didn’t testify because he would have been put under oath. Does everyone listening to me now understand that for three years, as Mr. Schiff has stood behind Congressional lecturns, as he has sat in committee chairs, as he has stood before the cameras of every network spouting this and that, he has NEVER BEEN UNDER OATH EVEN ONE TIME DURING THOSE PERFORMANCES. Do you think that’s accidental? Of course it isn’t.”

        After what the Dimms continually said…that everyone’s a liar…the President, his staff, all Republicans, all deplorables, Republicans in Congress….all liars, today was a good day not to call Senators & the House Managers liars since this was a 2-hour briefing.

        Taking the higher road today & laying out prospective analysis was respectful to the “Senators” as an institution, especially after Schiff’s “Republicans are scared of the President because he threatened to put their heads on pikes if they vote for removal” yesterday.

        The Trump team has already been scolded by Justice Roberts (equally so the Dimms). Both Collins & Murkowsky have been upset at least twice by what the Dimms said about the Senate institution. (If you don’t vote for more witnesses, you’re participating in cover-up or participating in the President’s “coup”; you’re afraid of the President if you DON’T vote to remove).

        Remember, the Senate views itself as the adult in the room in DC, hence Justice Roberts’ admonition. Did that admonition happen before or after Sen. Collins’ note to Justice Roberts?

Not much left but more details to continue to expose for the record and for the thinking American citizen how corrupt this process has been. And how chillingly inept the demmi’s in the House of Representatives seem to be. When you have all the testimony and you still stick to this line of attack, shouldn’t any junior attorney be able to see how devastating the defense will be using the same evidence?

      Again, the rotten corruption of those from Obama’s administration and the left is putrid. But President Trump is also exposing their breathtakingly arrogant incompetence. From the FBI all the way to Polosi, Nadler and Schiff. The incompetence from those who are supposed to be leading and protecting our country is very frightening.

I hope at least a few of them are furious at the bait and switch game the House played on them…I think there are at least a handful who are not yet owned by the Swamp and if there are in states that the President won in 2016 they will have to think long and hard about voting to convict him with such overwhelming evidence that he did nothing wrong!

There are a handful of seats the Dems could pick up but there are also an equal number of seats that the Republicans could flip if the President is doing well in their state and if enough independent voters are disgusted by this impeachment sham!     Patrick Philben nailed it. He detailed Sundance’s long-standing argument that the House did not vote on having an impeachment inquiry; therefore, the House Judiciary Committee (Nadler) did not have subpoena power.

    Philben nailed it. For me he has been the lethal weapon on President Trump’s defense team.

    The rest of the defense next week is fluff really. Continue to hammer the nail, but don’t overdo and drag it out.

    There are several “target audiences” that the Trump defense team is speaking to…..the Senate as a whole; the public; and the media.

    But the key audience is small…maybe 6-7 individuals. The GOP RINO herd of Collins, Romney, Murkowski, Alexander, Gardner, and maybe a couple others.

    The objective should be to make it extremely difficult for any of these “willows in the wind” to justify anything but a quick acquittal and/ dismissal of these 2 Articles.

      Yes they keep pushing Roberts to the forefront. Let Roberts decide the witnesses…(senate already voted NO to that idea)…..Roberts rule on whether witness is material….(Again, you lost that vote) Their last point is to let Roberts rule on executive privilege. I don’t think so, POTUS has the right to have that question fully argued and adjudicated by the full supreme court. Chief justice Roberts is NOT the supreme court, nor is he a dictator.

      If anyone had any doubt that the D’s have the goods on Roberts, surely that notion has been dispelled today. I just wish we knew what it was and could prove he’s compromised so we could be rid of him.

    The House and Trump legal teams are both going to be busy this weekend. But the Trump team all be having fun. I practiced law for forty years, and shredding an opponent’s weak case, whether at the trial or appellate stage, is so much fun. Work, yes, but fun.

    I’d expect the Trump team is discreetly going to put out feelers to some GOP senators for feedback from their colleagues, too, so that can be covered on Monday.

    I caught about half an hour at the end, with a bit of Sekulow, a chunk of Philbin and a bit of Cippoline at the end.

    Philbin was much the most effective – too much emotion from the other two.

    They should put Philbin on the key point – the game of telephone that always leads back to Sondland’s presumptions, and then let everyone go home.

    I also saw about five minutes of CBS “post game” analysis, which showed the danger of the defense’s approach today. By tackling lots of different subjects in a couple of hours, that allows the hacks to pick one subject to refute and ignore all the others. Which is what CBS did. If you want to make a knockdown argument on any particular thing, you have to close off the media’s options on changing the subject.

      Something that really spoke to me was when yesterday, when Elise and the other 4 members spoke before the cameras and told us – the aid they are talking about was slated for the NEXT YEAR. It wasn’t for the present year. This demolishes EVERY single lie/point the Dems keep trying to shove down the public throat (how Ukrainians suffered or were killed because of the pause, etc.) . It should be emphasized many times.
