Impeachment Trial Next Steps – Senate Leader McConnell Establishes Briefing Schedule…

Adopted today by unanimous consent:

  • A Summons to the White House notifying them of the impeachment trial will be issued by the Senate and delivered by Saturday January 18th, 2020, 6:00pm,
  • The House of Representatives (impeachment managers) have a deadline of 5:00pm Saturday, January 18th, 2020, for the filing of their impeachment brief to the Senate.
  • The White House (defense lawyers) have a response deadline of 5:00pm Monday, January 20th, for their response to the House impeachment brief.
  • The House of Representatives (impeachment managers) have a deadline of Noon Tuesday, January 21st, for their rebuttal brief to the White House defense brief.
  • The Senate Trial begins at 1:00pm Eastern, Tuesday January 21st, 2020.

Senators will not be allowed to bring their cell phones or any electronic device into the Senate chamber while the trial is underway.

Following Thursday’s senate swearing-in and administration of oath, Minority Leader Chuck Schumer said he will try to force votes on witnesses on Tuesday.  Democrats have called for subpoenaing four witnesses including former National Security Advisor John Bolton and acting White House chief of staff Mick Mulvaney.

However, Senate Majority Leader Mitch McConnell is keeping the construction of the senate impeachment resolution, laying out the rules, quiet.  As of this moment no-one knows the details of the resolution being assembled by the Senate majority.

CTH has been warning those who are interested, since last year, not to underestimate the scheming and planning of the Democrats and Lawfare in the Senate phase.  The entire apparatus of the resistance network within government is aligned with the impeachment effort.  Nothing is happenstance and everything unfolding in the media is pre-planned.

Just like the media worked hand-in-glove with the DOJ, FBI, CIA and intelligence officials to construct the fraudulent Russia conspiracy case against Trump; and just like those same administrative state officials and media worked hand-in-glove with the Mueller investigation to advance the fraudulent special counsel effort; those exact same participants are working together to frame the appearance of criminal conduct within this impeachment effort.   Same people, same purposes and intents.

All of the media headlines are pre-scripted by narrative engineers who have been given advanced notification and copy of the needs.  All of the players within the headlines are working in unison; this includes the resistance operative inside government offices such as the DOJ.   All media stories are pre-engineered, sequenced, and scripted with a template provided by political operatives.

It took a long time for President Trump’s allies to realize the 2018 Pelosi rule changes were directly connected to the 2019 activity and the construction of a fraudulent whistle-blower complaint.  Many people, unfortunately including most on our side, just don’t grasp the amount of time and energy the resistance operatives put into the pre-planning.

The recent discovery of Mary McCord working on behalf of the impeachment effort should have been a bucket of cold water in the face of those who keep downplaying the risk.  I hope the independent researchers and new-media have awakened to the reality that surrounds all of us.

    This is part of what I mean by “the resolution must remain secret.” It would be counter-productive to have Senators able to start discussing what they plan to do beyond hypotheticals b/c it’s just asking for a Senator like Collins to get roped into something like this. Better to keep it so nobody can speak intelligently on what they plan to do

      Calling witnesses is a procedural matter probably involving several different steps. In 1999 there was a motion to call to witnesses, then a motion to suppress, then a compromise on who to call & how to take depositions & the format of presentation.

      Sen. Collins has a selective memory re:Clinton trial…
      “On January 25, Senator Robert Byrd moved for dismissals of both articles of impeachment for lack of merit.” The following day a motion to call witnesses was made. The next day, after back room dealing, the motion to dismiss was rejected and the witness motion approved.

      Since Sen. Collins wants a repeat of the Clinton trial, how will she vote (along with Romney and Murkowski) when Mitch make the motion to dismiss for lack of merit of the Articles of Impeachment?

      Collins still doesn’t understand this a partisan political coup. The process in the House with no due process rights to the minority party or the president was a joke. All of the Dem witnesses were destroyed on cross. Yet Collins wants to give the sham impeachment the appearance of credibility. If she votes with the Dems to assist in the coup attempt, Republican voters must abandon Collins in her Maine re-election. The party is better off without traitors. In all likelihood Collins is toast in blue Maine anyway.

        You misinterpreted my comment. I am not attacking McConnell. Chao is employed by the man McConnell is trying. Chao has considerable personal trade connections to China. It would not benefit McConnell or his wife financially or politically to see Trump convicted.

          I’m not sure that a LOT of folks know that Secretary Chao is also Mrs. Mitch McConnell. I’m not certain that has a lot of bearing. What I do know is that PDJT has pretty much left Mitch unscathed, there are reasons for that. In the end, Mitch has PDJT’s back and I think is judicial appointments speak to that. If he didn’t I doubt we would have the appointments Mitch has supported. The left freak out is more about the next 25-30 years and conservatives taking back over the courts. They have Mitch to thank for that, and PDJT of course. Mitch has a legacy to protect in the annals of US history. No way PDJT is removed from office on Mitchs’ watch.

    I expect some cavanaugh type fake allegations at emerge at the 11th hour to provide cover for 3-4 GOP senators to vote for witnesses. Nothing the witnesses have to say will lead to impeachment. Trump has to much support. GOP would lose 50 states is they stabbed him in the back

      As long as there is witness reciprocity, and Mitch seems inclined to agree. The sight of Hunter Biden taking the Fifth might make the Dems pause. Adam Schiff Michael Atkinson? The “whistleblower”?

      Witness reciprocity gives the RINOs enough cover to say, “I was in favor of witnesses, but the Dems backed down. They didn’t want a fair trial in which each side got to call witnesses of their own choosing.”

      I think the RINOs would sign on to witness reciprocity, and leave the Dems with Joe Biden yelling “My surviving son!” at them in a Dem conference call.

It’s time to turn this into a debacle, release to declass and expose the fraud. If they think Parnas is an ace they need to look at his record, starting with his birth in Ukraine. It seems too convenient to think that the pressure on Parnas is coming from the state side left when there are oligarchs back in Ukraine he is likely worried about. PDJT owns the news cycle and will masterfully play this as well.

    I find it unfair that the impeachment managers get two bites at the impeachment brief apple, while the President’s team gets a single look and rebuttal. This is not even remotely like cross examining a witness and then have redirect capabilities. The House WILL withhold something and then add it into their rebuttal to the President’s team to avoid having that input addressed.

      It’s pretty standard in legal briefing. There are some judges that allow a “sur-rebuttal” in rare circumstances in which the rebuttal doesn’t just respond to the opponent’s brief (which is what a rebuttal is supposed to do), but raises entirely new arguments not addressed in the original brief.

  7. Does anyone know: do they vote up/down on each witness either side requests to call? If so, then the RINO’s will accept the Dem witnesses in the Administration and reject others like the Bidens (or Schiff, or Roberts etc., all of whom are arrayed against them).

    I fear DJT is going to win but with 55-60 votes against him. A major wound, both personally and politically. They really should dismiss it, but the votes just aren’t there.

    I agree with Sundance that ‘misunderestimating’ the Lawfare-Congressional-Media complex would be a mistake.

    And think: they implicated Pence in the Parnas interview – which is just a talking point preview of what’s to come most likely, as perhaps one or two more whistleblowers suddenly spring up from within various Gov agencies. If they can take out Trump and Pence (unlikely but possible), then guess who gets to be President!!!

    But of course she won’t last long because her actions are impeachable since her impeachment process was designed to influence the election, and also her rise to the Office of President of the United States.

    The Republic is on the edge of being broken, perhaps no matter how this turns out. I don’t feel the MAGA promise has been kept, albeit not for lack of trying. They just took on more than they could chew…

    If Demonicrats can convince just 4 RINOS to vote with them on witnesses and other issues it’s all over.

    Mitch KNOWS many R’s want POTUS gone. He probably feels the same way. I don’t trust any of them.

    While I agree this is all scripted by the President’s enemies, I think there is minimal risk to President Trump. The articles of impeachment are garbage. The House clowns will present the garbage. President Trump has very competent lawyers who will go on the offensive to obliterate the garbage. The President is a smart man who knows what is going on and is active in the background. McConnell has put his reputation on the line as well with his consistent statements about the President’s acquittal. He has sized it up and is clearly on the President’s side. Look at the Democrat desperation up Lev Parnas at the last minute. When it comes time to vote it is much more likely that no Republican will vote to convict than there are 20 votes to convict. The House Democrats, not President Trump, will go down in infamy. How many Democrat Senators, after hearing the President’s defense, will join them is the only open question.

    POTUS must go to SCOTUS immediately and demand that they vacate this unconstitutional impeachment. The House certainly has the right to impeach, but only for “treason, bribery, high crimes and misdemeanors”. The articles passed by the House do not allege ANY violation of ANY section of US code. “Abuse of power” and “obstruction of Congress” aren’t crimes. It means the House doesn’t like POTUS. So what? We don’t have no-confidence motions in the Constitution.

    If he doesn’t go to court with this right away, EVERY president in the future is going to be dragged into a trial when the opposition party doesn’t like him! This is crazy!

      That has been my position as well; we need to erase this entire episode from the history books. If nothing else the shredding of the Constitution and due process we just witnessed by pelosi is all they had left and they leveraged the best they could. With no statute there is no crime. It leads me to believe it’s all been a show to placate the left wing hacks or more in line with my thinking they saw it as an opportunity to further destroy the Constitution. In the end, they had to settle for leading the lemmings on the left to actually believe that POTUS serves at the pleasure of Congress. Next is to eliminate the Electoral College and finally, why even have elections at all.

I have heard that Bill of Attainder term in the past month and sounds like the 116th Congress just brought us back to King Henry the VIII, complete with court jesters. So the way I read this is if the GOP had a backbone they would flip this and impeach Pelosi for ignoring previous SCOTUS rulings on how creating a Bil of Attainder in the House is “illegal”? By virtue of creating the BofA I read it as that every democratic that voted in favor of impeachment as having broken the law. Am I reading this right, is that possible?

          Roberts presiding over it is mostly that – a representational role of his presiding. He cannot deliver rulings by himself. It isn’t as if any issue raised will be decided by the entire Supreme court while this impeachment “trial” is proceeding.

          This is not the same as a trial “as we know it” where the usual rules apply. The Senate makes the rules for this “trial”, not the Supreme court. And the senate does that during the proceeding.

    It seems as if a lot of people are worried about the Senate trial. Looking at it in as practical way as I can… I just cannot see any way that the Republican Senators vote to remove. They all love holding on to their seat and their power. If they voted to remove PDJT any of them who are up for election would be in deep trouble. This would mean the end of the Republican party as we know it.

    Two simple things that might help DJT:
    1. All in or all out for witnesses. McConnell should advise that the rules are that if any witness is called by any party then the other party can call any witnesses as they see fit. You get one vote it’s for all witnesses or no witnesses. If you vote to hear from a prosecution witness then the defence is entitled to call any witnesses they want to call to ensure that Trump has access to his constitutional due process rights.
    2. Every GOP voter should call their Senators and tell them if they remove Trump they will not vote in the next election which will effectively destroy the GOP.

    This whole situation is causing my blood pressure to rise. Lol. However, we are fortunate that McConnell is up for re-election this year. I don’t trust Mitch, but I would be much more concerned if he wasn’t facing the potential wrath of angry Kentucky Trump supporters at the ballot box for another 4 years or so.

      McConnell is 77, if the Uniparty goes scorched earth to remove President Trump, their paymasters will make sure McConnell has a golden parachute.

      It’s the other 21 Republicans that are up for re-election that are probably worried. A lot of up and coming senators like Cotton and Earnst would probably like to stay in the majority.

      Mitch has a ‘Female” running against him. She is former military. She speaks very softly and carrys a big stick. She is also gay. The Dems are determined to rid Kentucky of Mitch and most of all they want to stop our state from voting 65% for a republican President president. We are the 3rd largest city in Kentucky and attention has turned to our town to see if they can turn us blue. They have no problem with #1 and #2 cities because they are clearly Dem’s. I don’t think at this point they will succeed getting our city to turn blue but you can never tell. They are after McConnell and they may just get him.

    That’s immediately.

    The bourgeoisie producers will cut back on production. They will stop making things, because the bottom will fall out of all markets.
    We will have a prolonged Obammy style slide down the scale.
    The final blow will be universal Green carbon taxes.

    PDJT continues to make the strategic error of not declassifying ALL of Spygate. Of course maybe it is not an error but intentional. He is where he is, being only the third president in US history to be impeached.

    Much to the chagrin of Nunes and others who have spent much effort in untangling Spygate, who implored Trump to declassify; Trump instead decided to stand with Rosenstein and now Barr to keep Spygate classified. Many here at CTH argued that Trump chose this action to prevent being accused of obstruction of justice of the Mueller probe.

    Well, as we see today Trump was impeached for obstruction of justice anyway! And Spygate remains mostly hidden from the public. This is a choice that Trump himself has made. Just like nominating Sessions, Rosenstein, Wray and Barr. All his decisions.

    There’s no point in blaming Barr & Durham when nothing happens with Spygate. The question that Trump needs to be asked is why he chose to side with them and not Drain the Swamp.

      I’ve started to wonder “how can the president declass?”

      He won’t go to a computer and email the information to reporters himself. He tells someone, who tells someone, who tells someone; and on and on until some low level guy actually logs in and then starts gathering the information. I’m stating doubt that there is loyalty chain that long to someone who actually puts fingers to keyboard to do the work.

      That doesn’t even take the ACTUAL bureaucracy into consideration and that’s where the lifetime employees who actually run the government will simply say “no.”

      THEN there will be political accusations and whistle blowers claiming all sorts of garbage about it being wrong dangerous and illegal.

      Even if he didn’t care what the consequences were, could the task of releasing it even be completed?

        PDJT can issue an executive order declassifying specific documents that Rep. Nunes has suggested. With that EO those documents immediately become declassified and can be FOIA’d by Tom Fitton, and others.

        If Trump was made aware of the Sundance List he could add them to his declassification order. POTUS is ultimate classification authority except for some nuclear related matters for which there is legislation. For everything else the rules for classification are by Executive Order of each POTUS.

    She wanted to give SDNY time to release info and also wanted to wait for GAO report.

    Also – Maddow is now a witness becasue she admitted to O’Donnell she’d been working on the Parness stuff for MONTHS.


    Bannon now says the entire shamimpeachment has turned into an absolute farce and that rather then favoring a long trial he now thinks it should be dismissed ASAP.

    He thinks the past few chess moves by demonicrats show pure desperation.

    The smart money says no to calling any additional witnesses; let’s just get this thing over. However, Mr. McConnell isn’t going to be able to fend off both the Democrats as well as the few Weak Sisters in the Republican Party.

    I put the over/under at three witnesses.

At this point in time, since Our Potus was elected against all odds, it will be God’s will if he stays with us as our president. God put him there and either He will keep him there or it is time for things to fall apart for our great country. Breaks my heart. It has been a great 3 years.

    The Wall Street Journal reports President Trump is worried he will need the help of neocon senators in his impeachment trial in the Senate.

    The mainstream media tribe cranks in to maximum overdrive, to portray the Epstein story as simply sexual abuse of girls 17 year-old, 11 months and 28 days. They also pump the old English Prince white guy involved angle.

    But where’s the real headline that should be on every news outlet for every day until this once great country of America no longer exists?

    How about this witness schedule:

    The Democrats can call any or all of the witnesses they called during the House “impeachment inquiry.” For brevity’s sake, let’s say there were 10 in total. In addition, they can call up to “x” new witnesses.

    The Trump / Republican defense can call 10 new witnesses, since the House Republicans were prohibited from calling witnesses at all during the House “impeachment inquiry.” In addition, they also get to call up to “x” additional witnesses.

    The rationale then presented to the public will be that: 1) the Senate (and the public) should have the opportunity to hear in full, and be able to witness and assess the credibility of, all the witnesses that were the reason why the House voted to impeach; and 2) that by the conclusion of the proceedings from beginning (“House inquiry”) to end (Senate verdict), both sides will have been able to call an equal number of witnesses.

    This could enable President Trump to have the “comprehensive” impeachment and expose that he wants and needs.

    I have emailed Rand Paul and Mitch McConnell both my letters concerning this so called impeachment. Rand Pauls letter went thru the 1st time I sent it and I received a confirmation of that almost immediately (I know-that is nothing more than a form letter). My letter to McConnell didn’t not go through the 1st time because I did not receive a confirmation but I did not receive the email as returned unable to send. I resent it a 2nd time last night and the same thing-no confirmation. Until it is recorded as received in his office I am sending it over and over and over again. What more can I do?
