Speaker Pelosi Instructs House Chairman to Assemble Articles of Impeachment…

With the House calendar extended to December 20th it now appears the full House vote on articles of impeachment will take place within this year. Today, Speaker Nancy Pelosi announced her instructions to House Judiciary Chairman Jerry Nadler to assemble the formal articles of impeachment to be brought to the House floor.

Speaker Pelosi did not provide many details; however, Democrats have said they are considering multiple articles of impeachment against Trump including abuse of power, obstruction of justice and obstruction of Congress. The House Judiciary Committee is expected to draw up articles of impeachment as soon as next week.

This is the first time in History that articles of impeachment will be assembled without an official full house vote to initiate the impeachment process. This is also the first impeachment effort without the House attaining recognized judicial enforcement authority.  The vote will take place before the Supreme Court weighs-in on the legal framework for the House effort. The House judicial enforcement authority, not being recognized by the Supreme Court, likely had a strong bearing on the timing.

The awakened American middle-class insurgency, led by Donald Trump, is an existential threat to the professional political class and every entity who lives in/around the professional political class. Their entire political apparatus is threatened by our insurgency. The political industry, all of corrupt governance, is threatened by our support through Donald Trump.

You know why the entire apparatus is united against President Trump. You know why the corrupt Wall Street financial apparatus is united against President Trump. You know why every institutional department, every lobbyist, every K-Street dweller, every career legislative member, staffer, and the various downstream economic benefactors, including the corporate media, all of it – all the above, are united against Donald Trump.

Donald Trump is an existential threat to the existence of a corrupt DC system we have exposed to his disinfecting sunlight. Donald Trump is the existential threat to every entity who benefits from that corrupt and vile system.

      But most of those elected to the House in 2018 are not constitution-honoring Americans.

      That’s why it matters who is elected to Congress, both House and Senate.

      There are even very few Constitution-honoring, Republican, Americans in Congress. Why do you think we get so excited with a few good questions from Stefanik and a good press-release from Nunes? Most of the Republicans in Congress are not worth a bucket of warm spit.

      The slippery slope upon which we are currently picking up speed was entered upon a long, long time ago. At the very latest, I’m talking about the 1980s.

      Of course, back then — nobody wanted to take the threats to our Republic seriously and those who tried to talk about it as a serious threat were looked at like we were overdue for a nap, and we were on the receiving end of barely veiled tolerance. And that’s a fact.

        No we are not. This impeachment process started the moment Trump was elected. For 2018…blame the 40 house incumbents directed by Speaker Ryan, who left Congress. When 90% of incumbents get re-elected, one has to ask why in this country’s hour of need, walked away? The reason is Trump and as SD said, a mountain of bipartisan legislation ready for Hillary’s signature was pushed into trash pile.

        Ryan handed Pelosi the speakership and for me the most shaming evidence of the UniParty. No amount of voting would change the 2018 outcome.

        I hope we have the strength to do what is needed to both restore our government to some semblance of functionality, as well as to adequately warn any that might choose to partake in swamp activity. I’m reminded that in the United Kingdom, a copy of Charles I’s death warrant is displayed in the robing room used by the monarch as a ceremonial reminder of what can happen to a monarch who attempts to interfere with Parliament. It doesn’t need to be a death warrant, but we need to stand for our country enough to provide a lasting reminder of what happens to elected people / civil servants that attempt to subvert the country.

      You see the trap? While this is going on, any law enforcement action against the criminals participating in the coup or any serious investigation into criminal politicians was always going to go this way.

      Did anyone think Biden was going to win? But they knew Trump would support criminal prosecution of these people. The impeachment is both coup and shield from prosecution. Is it now politically possible for any sort of charges against the Bidens or any of them right now? NOPE!

      Asking the question “who can stop this…”? says you already understand the president is largely powerless to stop this directly. I still hold this was the plan all along. Biden didn’t enter the race until he got wind the heat was on as it pertains to Ukraine and all the rest. This act is using the political process as a shield. I guarantee you if word got out about Hillary being under threat, she’d also enter the race… and there has been word on that not too long ago as well.

      The SCOTUS can stop this. And they will but that’s another problem. RBG is clinging. And even if she departs the bench, “president under impeachment will not be allowed to appoint a new justice! He’s trying to influence the courts to stop his impeachment!!”

      It’s all a bunch of traps.

      Over the past few years, we’ve seen a lot of really strange things which have strangely been accepted by the masses. Thousands of years of procedure in the replacement of the pope have gone out of the window and now the leader of the Catholic Church is a globalist. The strangest death of a Supreme Court Justice happened while we all watch as the death was pronounce BY PHONE. (People think Roberts is compromised? Maybe… all they had to say was “you’re next.”) And there’s a lot more strange things which have happened and been accepted by the consumer public.

      The public will accept this too. Over the past two centuries, we were citizens. We are now “consumers” obsessed with entertainment and gadgets. Critical minds and people who can see things are now rare and precious — many of those are right here and Sundance is among the top in this class of people.

      But we have to talk about this with people. We can’t fear being ostracized. When our country is at stake, why do we care so much about less significant things like superbowls and what the neighbors think?

      • I don’t buy your argument Daniel. Running for office doesn’t protect you from prosecution of a crime you committed. The President can nominate anyone to the Supreme Court. Where in the Constitution does it say impeachment articles against a sitting President, fraudulent articles at that, prohibits it? Only the Senate can deny him, and they haven’t yet. They can tell the Dems to go pound salt when RBG goes to Hell.

        This crap is going nowhere. I don’t think enough of the one-term and two-term House Dems will fall on their swords to protect corrupt and aging party members. Really, what’s in it for them?

      First, there are 31 vulnerable Dems in House districts PDJT carried. Two of those have already announced they are against impeachment. If Pelosi loses the House Articles vote she is toast.

      Second, Nadler and Schiff have nothing for traditional articles of impeachment. And what they do have is very weak, ‘created’ via a patently unfair process that even violated House rules (the Repub Intel committee day of witnesses). All that will be exposed by Jordan,Ratcliffe, and the rest of the Freedom Caucus team and debated on the House floor before a vote on any Articles. Not a good look.

      Third, IF Articles are passed, PDJT has already promised that he will insure the Senate trial utterly destroys the Dems. Schiff, Schiff’s staff, Ciaramella the first up ‘witnesses’ on the corrupt House process. Trial in Jan after SCOTUS rules the ‘subpoenas’ weren’t. No quid pro quo per Zelenskyy. On and on.

      Fourth, all this now takes place against a backdrop of the IG report on FISA abuse spying on PDJT, and likely Durham indictments. Impeachment will seen (except by fake news CNN) as just the latest Obama/deep state dirty trick against PDJT. The Do Nothing Dems label they continue to earn is going to cost them bigly in the 2020 election.

        House debate will be all of 1 hour. So, Repubs will have 30 ‘whole’ mins to sway these 31 members.
        Alan Dershowitz, with whom I concur, believes the Senate can simply reject the articles of impeachment due to constitutional defects. But how would that play out? Could the Supreme Court actually force the Senate to accept the articles as is, and render a summary verdict? Could Senate Repubs even withstand the heap of media scorn coming their way for remanding the articles? Politically, would it even be wise?

          As I recall, Sen. Graham also suggested a few weeks ago that the Senate could, with a simple majority vote, refuse to consider the Article of Impeachment on grounds that they do not pass Constitutional muster. If Dershowitz says it as well, it may be an option—except for the never-Trump RINOs, who could frustrate the vote.

          Then too, McConnell has said that if the House sends up Articles, he is required to have a trial. Does he disagree with Graham and Dershowitz? Or could he be enjoying the prospect of tying up those remaining Dem Senators running for President by requiring them to stay in DC for a couple of months?

      I am inclined to agree with Gary as well. Pelosi may be pushing for a rush draft of Articles of Impeachment and a House vote before Christmas because she suspects (or knows) that the vote will fail. She can count: how many Democrat members in pro-Trump districts are getting warnings from the voters? How many defections would it take to sink the vote? Maybe best to get it over and get on with the 2020 campaigns.

President Trump should let it be known now that he will not sign another CR without full funding for border security, passage of USMCA, a middle class tax cut and reduction in the growth of spending. Time to throw a big monkey wrench in the House Democrats plans. Hammer them everyday for not governing. If he refuses to sign the CR what has he got to lose? They already plan to impeach him. At this point I doubt most Americans would really care, or notice, if the government shut down.

      If an impeachment does actually become a reality, and assuming Trump survives, our 2020 campaign slogans MAGA or KAG will seem out of place and under-stated.
      MAKE AMERICA FREE AGAIN may better express how urgent a Trump victory in Election 2020 may be to our very existence.

    Nancy wants the attention on the impeachment and not the IG report. That is why they won’t vote on it in the House. Once they vote, they no longer have control because it moves to Senate. Why else would they have another “meeting” on the same day as the IG report?

  19. Nancy Pelosi intends to impeach Trump and Pence and thus to seize the throne herself in a classical “palace coup.” But there are many problems with her plan.

    The most basic is §1.9.3: “No Bill of Attainder … shall be passed.”

    The House is claiming that a particular person is guilty of a high crime because they say he is. Never mind that testimony after testimony, when asked directly if they knew of any crime that the President committed, said “No.” The Legislature intends to find him guilty, and to punish him with impeachment, without benefit of trial or due process: a classic Bill of Attainder.

    You are witnessing the self-destruction of the Democratic Party, right before your eyes. To these people, the United States Government is, and of rights ought to be, an organized crime ring, with themselves at the head of it. This could turn violent. If these men and women go walking down the streets, they’d better have bodyguards.

I do think, realistically, that the average American needs to be prepared for what may come if they impeach our President.

      The Constitution does not place any limitations on the impeachment power. Congress does not need SCOTUS’s permission to impeach, and as long as they follow their own rules, SCOTUS has nothing to say about it.

      But, that is impeachment, not investigation. Paraphrasing arguments that our host has made, investigation is an executive activity and Congress has no general access to a power held by a different branch. SCOTUS has ruled that the house has some limited investigatory powers implied by the power of impeachment, but the conditions of today are not at all similar to the conditions present when that precedent was set.

      I am certain that the House Oversight demand for PDJT’s financials, stayed by CJ Roberts, will be overturned. Sundance even reposted my detailed analysis in one of his posts. But that only narrowly touches on just one aspect of impeachment —the defective late claimed ‘cure’ for the original fundamental demand defects.

      The constitution sets up the impeachment/ conviction process in A1 and A2 without A3 judicial involvement. Exactly where SCOTUS would find jurisdiction is not visible to me at present. Perhaps if the Senate sues the House over legitimacy of Articles process? But then why not just a Senate vote not to receive them (reject holding a trial) on those same grounds? Sound constitutional grounds: A1§3.6 says Senate shall have sole power to try all impeachments, and A1§5.2 says each house may determine the rules of its procedures. So Senate could in theory vote a procedural impeachment rule that the House voted Articles were improperly created and without substance, therefore Senate will not try them.

      There may, however, be a cloture problem. Haven’t researched whether cloture applies to senate rules votes. McConnell speaking yesterday about Schumer seemed to indicate not.

      Extraordinary to be alive in such historic times.

    My expectation is that every future president will be impeached because it gives congress dominion over the executive branch. Even so, it will only apply one way. Liberal judges will disallow subpoenas of dem presidents/deep state actors yet rubber stamp subpoenas against conservative targets.

    I am surprised that it took this long for dems to discover this flaw in the constitution, but it only works if they control enough of the commanding institutions to not care about come about. I am truly sad for my country.

      Add to that a too late to stop bluing of formerly red states due to interstate migration of people fleeing the nests they’ve fouled with their leftist voting only to vote the same in the red state they move to and the 1965 Immigration Act which shifted priorities to 3rd world countries and opened up massive chain migration of relatives, with 60-80% of 3rd world immigrants voting left regardless of income or educational level.

      Trump made those problems obvious to far more people, but it is far too late. In the process of trying to eliminate him because we voted incorrectly, the Deep State didn’t even try to be subtle and remain in the shadows as it has usually done in the past. It has now made itself incredibly obvious to everyone except for the large percentage of idiots in this country.

      The only (temporary) fix is to vote for Trump again in 2020.

    I believe this is what you get when globalists call in their markers on corrupt politicians. Naming it Ukraine v.2 wouldn’t be far off.

    • Don’t think so. We have a constitutionally mandated divided government and two Houses of Congress for this very reason…..to prevent a lawless rogue faction from overthrowing the duly elected President which is EXACTLY what will be be happening if they vote to impeach.

      Remember, Pelosi has to invite him. She cancelled her invitation til after the shutdown was over last time.

      She is not about to give President Trump a speaking engagement from the floor of Congress when he is being impeached and she KNOWS he can destroy them with a speech……..right in front of them.

        It is my understanding that POTUS can deliver the SOTU address from anywhere. If I comprehend the requirement correctly, his sole obligation is to deliver the report to the Congress – written format is sufficient. I’d kinda like to see him do it live, on stage, from the lectern, at a very large, packed house, live rally. Under the current circumstances, at least some of the LSM would see themselves as obligated to cover it.

        If POTUS were to go rogue with the SOTU venue, Miss Nancy would lose control over the event. Maybe she should pray that POTUS doesn’t entertain the delivery concept of “off-site” for the SOTU, lest she become side-lined and wind up House sitting all by her lonesome.

    Next step – after RBG leaves, one way or another, they’ll try to block any new SC judges claiming it can’t be done by an impeached president. It won’t matter if republicans sweep the house and senate in 2020.
