Senator Graham on Impeachment: “I Will Not Allow Hearsay Evidence During Senate Trial”…

An impeachment trial in the senate would presumably be run through the Senate Judiciary Committee (presiding judge John Roberts), unless there are constitutionally permitted process rule changes.

Senate Judiciary Chairman Lindsey Graham begins to get specific about what he will and will-not allow as part of the senate trial.   Graham notes the ‘hearsay rule’ will be applied to the House evidence within the article(s) as presented.  Additionally, Graham notes that anonymous witnesses (ie. “whistleblower”) will not be permitted.

  1. One reason people are tuning out is because The Impeachment Show has been the only thing on tv for four years now, and Donald Trump has only been president for three.

    Mitch and his Decepticons are already warning Democrats that they are not just going to leave this flaming bag of dogsh*t on his doorstep, ring the bell and run away. He’ll put them on trial, too. He’ll shove it up TFA.

    Absent a Black Swan, this Steaming Hot Bucket of Democrat Diarrhea never leaves the House.

The last thing Democrats want is a trial that’s why Schiff is being so bad. Schiff is banking on no trial. By calling the Democrat’s bluff and holding an extended trial 6 to 8 weeks putting all the Democrats dirty laundry on display including Hunter and Joe Biden, the whistleblower, the leakers, the Obama state department officials John Kerry’s son, and embassy staff who colluded with Biden, the CIA and NSC traitors not to mention the $1.5 billion China bribe. A trial in the Senate is the surest way to make the Democrats drop the impeachment hoax!

        Even if they acquit, she will use the same argument to steal the 2020 elections.

      SD has, through exhaustive research efforts and objective assessments of the entire resistance movement, clearly documented the steady progress made by the Deep State in its war against the President. He has been consistently prescient in the content of his commentaries, clearly outing seditious co-conspirators and their plans.

      Yes, the trial will happen, and the RINOs and NeverTrumpers will get their one, last shot at removing the President. We know who they are, and they know the stakes.

      The evidence presented by the prosecution will be spurious and falsely damning, and the defense of the President will be truthful and accurate but to no avail. McConnell’s earlier commitment to “play it straight” and Cornyn’s bluster yesterday are, IMO, indicative of the insufficient support for the President to overcome this travesty. Add Roberts to the mix and the recipe is increasingly sour.

      Now, Graham is posturing, again, to be an “honest broker” when his previous behavior proves him to be a charlatan.

      The President’s tweets are increasingly emotional, accusatory, and repetitive because he knows he is on a political island owned by the enemy.

      SD gets it; all of it.

        But they won’t. Listen to Burr, He says the trial will take 6-8 weeks in the senate. If we really had confidence in our Republican Senators, taking that long could inure to the benefit of Republicans. They could turn the impeachment trial against the Democrats by calling the correct witnesses. All the while they would be keeping the Democrat Senators running for President off the campaign trail and essentially muted from talking about it because they would be jurors.

          Fishing season in DC is apparently 6-8 weeks long. The democrats will have access to everything. Once it’s official they can pierce executive privilege, grab everything from everyone, and put together some fakery.           Which would help Bloomberg, Hillary, etc… But can we trust the Senate Repubs? An impeachment trial allows the RINOS and Dems time to plant something unexpected (doesn’t have to be true). Then watch the weak kneed and feckless Repubs collapse. And, BOOM! it’s over… An alternative would be to consider impeachment DOA, but hold serious Senate hearings and unpack everything while (hopefully) Durham is serving the coup plotters with subpoenas and perp walking some off to jail. I would rather leave the Dem candidates on the campaign trail being the radical fools that they are and free to savage each other, including Bloomberg and Hillary.

This hoax of an impeachment is much worse than the mueller investigation. It is so bogus it should not be allowed to go to trial. I think there could be some democrats that could vote to end this before it is at trial. All of the Republicans voted against shifty and nancy on the ‘inquiry’, so at least one would vote to not have a trial! And if it got shot down, you would know for sure who of the Republicans are going to vote with the democrats. What to do? I say kill it up front in the Senate!

          Notice President Trump was not able to defend himself at all in the Mueller hoax, which included criminal conduct on the part of the hoaxers. Anything he did to defend himself was called obstruction. He was guilty before being proved innocent and they still claim today he is guilty of crimes related to that witch hunt. And anything he does to investigate what happened to completely clear his name is called obstruction and further criminal activity.

          Now they do it again with no due process and no ability to defend himself. Anything he does to defend himself is considered an obstruction of justice, even when he properly defends the Executive branch from the illegal activity in the House.

        They do, however, badly want the Senate verdict. It will be a bipartisan majority vote to convict, but not the 2/3 required.

        This outcome will satisfy the RINOs, who want Trump weakened and humiliated, bent to their will, finally.

        The Democrats want to finally have a semi-valid argument that Trump is not the legitimate President: a bipartisan Senate majority has voted to remove him. As many have observed, this is apparently the only campaign issue the Democrats have to offer in 2020. They must believe strongly it’s going to happen.

        What the RINOs miss is that Trump’s supporters will demand their pound of flesh. The usual smug RINO logic that “you have to vote for us, we’re the lesser of two evils” will not stand up in 2020. Republicans will turn out, vote for Trump, and leave the Congressional ballots empty. The RINO cleansing is overdue.

          I see this and have the same thoughts. However, I don’t see Trump rolling over in some Senate trial. From what I hear, some of the articles of impeachment will include obstruction from the Mueller witch hunt. He should be able to call witnesses and present evidence on that witch hunt. That includes people like Hunter Biden, Andrew Weismann, Jim Comey, Mueller, and Senator Burr. What happened with the FISA leak by the SSCI? Who did Chalupa talk to in Ukraine? Who sent her there? Who paid for that dossier?

          For that reason, I can’t imagine these Senators and even Congresscritters, wanting to pick at that scab. They have far more to fear with that opening up than Trump does. He didn’t commit a crime. They did.

          Furthermore, with the abject failure of the hearing yesterday, Pelosi has to put on her public face but internally she has a problem. They are not getting the fake story out. The public is not buying it. That means the 30 Dems in Trump districts are NOT getting the cover they need. She will be lucky to get to 218 unless she has some people willing to fall on the sword.

          I can see her going the resolution route because of those issues. She doesn’t want a trial where President Trump actually has his first chance to properly defend himself and challenge the carefully crafted storyline. Her 30 Dems will be in trouble.     There should be no trial whatsoever. I called both my Senators and told them we expect them to file a motion to dismiss immediately upon arrival in the senate.

    It is obvious to everyone what a sham this whole thing is.

    It has now become obvious this whole thing is a massive counter-offensive mounted by all the Dems who were themselves involved in the graft, corruption and money laundering with Ukraine.

    Hunter Biden, Kerry’s son, Pelosi’s son, etc… were all receiving kickbacks through Ukraine.

    The US politicians in power approve “aid” to Ukraine, it goes to Ukraine, then the corrupt politicians there give a cut of it back to their offspring. Thats it. Trump and Rudy exposed it and now they have mounted a pre-emptive defense/counter-offensive. They do that by accusing PT of doing exactly what they did in 2016: Pressuring a foreign government to investigate (illegally surveill) their political opponent.

    Every Senator should vote to dismiss this immediately upon arrival in the Senate. Anyone who doesnt can be deemed complicit in the cover up and attempted frame up.

        FWIW, I liked the idea of a Senate “Trial” to expose all of the swamp corruption, until I started reading the Senate Rules and some comments. Best I can tell, a Senate Impeachment trial goes by Senate rules and not by any of the usual legal standards of due process, etc. The Senate Presiding Officer, in this case, John Roberts has control of the proceedings and issues are decided and rules can change by simple majority vote of Senators present. With the combination of John Roberts, Romney, Murkowski, and Collins, at a minimum, determining the outcome, a Senate Trial is a major crap shoot. (As an aside, I read that with a Presidential impeachment trial, the Vice President can’t decided tie votes, 50-50 votes seems very possible if this sh*T show goes to the Senate, wonder how that is resolved?)

        Care to comment on that comment? Im guessing this is the reason you think we should have a senate trial. I just have no faith that anything would be exposed in a senate trial. Not sure why anyone would think that.

          Do you really think Roberts is going to preside over any trial that denies an accused constitutionally mandated due process? Rules can be changed but they must be compliant with our constitution.

He’s a proven liar, and I believe his paramount interest in affecting any Senate proceeding will be limiting the scope of inquiry and revelations about Democrat misconduct — especially his buddy John McCain’s related nefarious behavior. Vindicating Trump will be secondary.

    If you’re upset just remember the Christine Blasey hearing. I think pretty much all of us were upset when Grassley gave her a platform. We thought Kavanaugh was sunk. But it ended up being a beautiful thing. The Democrats made fools of themselves. An impeachment trial would have the same end result, and the added bonus is we’re heading toward an election. 🙂

    These senators primary objective above all is to stay a senator. If Trump goes down in the senate, the Republican party is over and they all lose their seats.

    Feels like the GOP Senate is trying to spook the Democrats. First they have a leak from Burr saying “6-8 week trial”…right in the middle of the Democrat primaries. That would have the dual impact of pulling half their team off the field and also completely destroying their ability to shape their message for the fall. That “leak” was quickly squashed, but message delivered: “If you impeach POTUS, expect it to fully disrupt your primaries.”

    Then, we have McConnell and Cornyn saying that a motion to dismiss won’t fly. They don’t have the votes. I think that is a message to Trump to start working the phones to whip the vote count to get to 51.

    Finally, we have Graham saying “no hearsay evidence”, that literally eliminates every witness not on the phone call and not directly involved in the transfer of the aid, the discussions with Zelensky, and direct discussions with PDJT. The House Impeachment Managers will have nothing they can present as direct evidence.

    It also opens the door to call the whistleblower as a witness because he is a direct witness able to answer who wrote the complaint, what his contacts were (so we can call those people as witnesses), who he worked with in Schiff’s office, etc. If Schiff wants to call his kangaroo court a grand jury, then the POTUS can go after him for prosecutorial misconduct. It also opens the door for Trump to call friendly witnesses to his Ukraine decisions who were directly involved in the discussions.

    Lots of reasons to be pessimistic about the Senate, but I’m a cynic not a pessimist. I believe the GOP Senate will look after its own best interests – staying in power and raising lots of money – and their best interests perfectly align with Trump’s at this time.

Knowing that a trial of President Trump in the Senate has the potential to do great damage to the current front runners for the Democrat’s 2020 nomination, is preventing Joe Biden, Elizabeth Warren, and Bernie Sanders from becoming the 2020 nominee one of Nancy Pelosi’s stealth objectives for impeaching the president?

          My own opinion is that the Democrats are looking at taking some big losses in 2020. They’re going to lose to Trump. Trump has coattails. The only reason why the Dems won the House is that Paul Ryan and 40 Repubs “retired” in order to deliberately create an unwinnable game table. Over in the Senate, we gained seats, wrecking the plans of the Pelosi/Schiff/Ryan/Romney/Media mafia of removing Trump in 2019. Candidates who stumped with Trump won. Trump continues to win – as recently as North Carolina last month…2 House seats.

          Therefore, impeachment is about trying to get their own voters on board with the 2020 election. It’s a panic move, based in part on the failing health of Ruth Ginsberg. They’re desperate. McConnell is licking his chops at a 3rd justice, perhaps this year. If Trump wins, he gets to replace probably Clarence Thomas who I think might retire. Impeachment is a Hail Mary.

          The problem is that in a Hail Mary play, the other team gets to send all their guys into the endzone too and the play rarely pays off.

            hokkoda, I would agree with your assessment but with one difference. The Democrats are not in panic mode. They are on offense and what Nancy Pelosi is doing with impeachment is perfectly consistent with taking a well calculated gamble before the 2020 election.

            Her game is to energize and mobilize the committed Democratic faithful to come out in large numbers in November, 2020. Impeachment porn consumed in huge quantities by the party faithful is her best tool for achieving that goal.

            If it backfires in 2020, they’ll lick their wounds and do something else in 2024.

    Not all of them hate him. He had more endorsments than any of the canidates he faced. You might not like him but one of the 1st people to endorse our President was Dick Chaney. They diasgree with wars but his daughter votes with our President on everything. Steve Scalise endorsed our President. Paul Ryan is gone our President is making Pelosi look like a fool. Dems will take a beating in 2020. What we need to do is vote for our President again. Brietbart endorsed Trump. Our President cannot afford for our country to go done. Pascalie who runs his campaign now has digitally formatted his app so it makes it easy for him to get voters. He set a worlds records for votes and Obama rigged it for Clinton. Google admitted to giving Clinton 10 million illegal votes and he still won. He is throughing rallies all over while the dems have barley stsrted. Stay coop he was born for this and he will win again easy. Just vote for him.

    Unless the Senate Rules allow a single Senator to vote to keep them out, I don’t think Lindsay Graham has any say in whether “hearsay” witnesses are allowed or not. At best, it would be a vote by the entire Senate.

    Doesn’t the House still have to actually vote to impeach before it moves to the Senate? Not sure of their next step. I still dont feel that President Trump will be impeached no matter how crazy it looks now. He will also win another term. Keep the faith and pray. (Just my opinion)

      Yes. The articles of impeachment have to be finalized and voted out committee and then voted upon (approved) by the whole House. Then approval an actual impeachment resolution is required to send the articles to the Senate for “Trial”.

      The very nasty tricks (rules) McConnell and Graham can play with the senate rules include:
      – Secret Ballot
      – Hearing not in public, classified
      – A senate panel hears the case
      – Finally, in a sense of “fairness” an equal number of Democrats and Republicans on the panel, with all “Independents” (i.e. Sanders, Angus King) also seated. This flies in the face of the fact the voters have put a Republican majority in the Senate.

    Don’t believe him until such time as he holds the hearings in re: “Russiagate”. Like he promised he’d do and has not done. He promised he’d call everyone associated with that scam including all of the top dog IC actors. Hasn’t even interviewed anyone. Graham is great at talking a big game. Not so much on even making an effort at follow through.
