Devin Nunes Discusses Partisan Impeachment, Ukraine and State Dept Involvement….

Devin Nunes appears on Fox News with Sean Hannity to discuss the manipulated one party procedures within Pelosi’s impeachment program.


Speaker Pelosi cannot engage the courts for support against the Executive Branch because the House has not created their judicial authority.  As a result of their lack of a vote to initiate the House “impeachment inquiry” there is no penalty for non-compliance behind any committee subpoena.

Attempting to compel testimony that crosses through the separation of powers; and goes even further in an attempt to penetrate the firewall around executive privilege; requires the House -or a committee therein- to carry “Judicial Authority“.

“Judicial Authority” is not absolute authority, but rather a legal reference and framework that forms the basis for an impeachment ‘compulsion demand‘ (or subpoena) by the House.  Judicial Authority is the House saying they have a legal basis to make a demand.

The reason judicial authority is necessary, is because creating Judicial authority, via the Legislative Branch full chamber vote, gives the Executive Branch access to appeal any legislative demand via the Judicial Branch (federal courts).

Repeat for emphasis:

…The reason judicial authority is constitutionally required, is because creating Judicial authority, gives the Executive Branch a process to appeal any legislative demand via the Judicial Branch (federal courts)….

Absent the creation of judicial authority the House has not created a penalty for non-compliance.  However, absent a penalty for non-compliance the Executive Branch has no process to engage an appellate review by federal courts.   This is the purposeful trick within the Pelosi/Lawfare road-map.

Speaker Pelosi’s current Lawfare-inspired road-map (House and committee rule changes therein) attempts to construct a path to impeachment that avoids asserting House “judicial authority”; because they fear losses from a Judicial Branch ruling.  Those who constructed the road-map are also concerned about outright blocks by the courts in their proceedings.

This process issue was argued by Lawfare member Douglas Letter today during a hearing on the topic of the House Judiciary Committee gaining access to Weissmann/Mueller’s grand jury evidence.  [Expanded Here]

Here’s the bottom line: “Judicial Authority”, granted by a full House vote, gives the House of Representatives more authority in their impeachment construct.  However, “judicial authority” also grants the Executive Branch a path to appeal via the Judicial Branch.

Because the Lawfare/Pelosi roadmap intends to subvert judicial authority, it is destined by design to end up running head-first into a constitutional problem; specifically separation of power and executive privilege.  That predictable constitutional issue will end up with arguments to The Supreme Court.  THAT is why the Democrats have been working for months to delegitimize the Supreme Court.

Please let me repeat for emphasis.  The Lawfare impeachment road-map is designed to conflict with the constitution.  It is a necessary -and unavoidable- feature of the plan, not a flaw.  Pelosi and the Lawfare group know they are creating a constitutional crisis; that is why the background attacks against the Supreme Court were started months ago.

      The letter the President’s team sent to Pelosi cut the Gordian knot. There isn’t a trial of any sort without witnesses. Kind of tough to justify impeachment. Most Americans see this as a sham, the Democrats will pay dearly in a year.

          Since the “impeachment” is a sham, why doesn’t Trump just ignore it? I don’t get this AT ALL. Trump could just say, “I’ll respond to impeachment if legal impeachment occurs,” and never say anything publicly beyond this. His spokespeople could just say, “No comment.” It seems to me Trump is making the faux impeachment more real by reacting to it. Like running from a dog makes it chase you. IS THIS SOME KIND OF STRATEGY or something?? Seems dangerous to me.

Under Nancy’s rules, they can refer whatever they have over to Nadler to draw up articles then there will be no choice but for the Senate to take it up or dismiss it. No getting around this.       I see a problem though. The construct was using the whistleleaker report to create a false narrative of what Trump said. Specifically, they were going to use the speech Schiff made up. That would infuriate the public and push the Dem holdouts to finally come over and support impeachment.

      However, each one would still have a problem at home in 2020. I am sure they fully expect Nancy to push the whole Trump should be impeached and the Senate Republicans should be thrown out of office for not removing him. This would also be her protection of those Dems in Trump districts as well as appeasing her rabid base. It’s a Hail Mary but they have nothing left to lose.

      When Trump published the transcript, he blew that up. Schiff got exposed as a liar. Nancy got exposed as starting impeachment based on a whistleleaker report not supported by the actual phone call and she didn’t wait for facts. Nervous Dems see all that playing out. Even though they are using the MSM to cover for them and spout their narrative 24/7 to get the holdout Dem support, it isn’t going over well with the public. The “narrative” is not supported by the transcript so they fell short.

      I am not sure she can get the 218 votes needed. She can only lose about 17-20 Dems and there are close to 30 in Trump districts. Will they all fall on the sword for the team, especially knowing it will not result in Trumps removal from office but quite possibly result in their own removal in 2020?

      I saw the reporting on that poll too. The usual suspects on Fox seemed absolutely giddy reporting how now a majority of Americans supposedly have “turned against” the President and not only support impeachment but removal from office. You’d think these frauds would at least try to hide their glee.

      I will be sorely disappointed if a few media personalities aren’t also swept up in some of the forthcoming criminal indictments.

        FOX polls are always inaccurate, probably because the same analysts that called the 2018 mid-term elections early conduct these polls. This is all crap news and yes, except for a few on FOX, FOX is going to fake news, anti-Trump as Paul Ryan has been urging them to do.

Clearly, Wolf Blitzer is convinced that he knows something. What it is, I can’t say. Ignoring that wouldn’t be prudent.


    • Check the fine print, Independents had a margin of error +-8%! That is a 16pt swing, meaning it is useless. The Rep had a +-5% MOE, another useless number. The Dems were 3.5% MOE, more in line with normal poll MOE. This was a pure narrative poll, no science at all.

        The vast majority of news consumers have NO IDEA how to interpret a poll when those statistics are provided. If the samples aren’t of LIKELY VOTERS ONLY and sufficiently large and random to provide +/- 3% sampling error or less, the poll is useless and meaningless.

        I am calmer now. A flaw of mine is that blantant injustice truly gets at me, especially when the smears and lies are directed at a family as genuine as the Trumps.

        Stuck, it’s not that I believe polls. I don’t, however many do, and up this way ( Canada) even half decent folks are getting a little “ wobbly” at the impeachment vitriol. It’s relentless and the haters are breathless in their hate for PDJT.

        Its 24/7 Trump hate on the MSM, I don’t watch it. But it is in Gyms, Restaurants, Hospital waiting rooms, Dentist/ Dr offices. Even my barbers.

        I even said to my barber just last week, that if she wasn’t such a nice lady I couldn’t come into the store because of the news channel that was on.

        The sound was down, but the continual loop of the banner along the bottom was irritating.

        She doesn’t notice it ( lucky her) but the owner likes it on.

        I know to “ let it go” but it is a challenge.

      True. The only wild card is Chief Justice Roberts–he would be the judge. As many on this site have noted, Roberts appears compromised. I think Obama found dirt on him (illegal adoption?) prior to the Obamacare vote which he flipped flopped on at the last minute. He’s voted strangely in several other cases. This would be big so he may be highly pressured/coerced to give much latitude to the Dem prosecutors. That said, I can’t image 19 Repub senators voting for Impeachment.

If they rule against the house, Nan et al will scream the courts decision is illegitimate, bc Kavanaugh is illegitimate.       They had the ball and plenty of first-downs, but they failed to convert.
      This may be them busting a last gasp move to try and hopelessly destabilize our government in order to seize and maintain control using weaponized departments and loyalist within the system.

    The current squabble between Nancy Pelosi and Donald Trump reminds me of an experience in the mid-1970’s in Panama while serving as the Provost Marshal for the Pacific side of the Canal Zone. Little Jimmy Carter was in the midst of giving away the Panama Canal and like the current democrats he had his little freedom fighters running around demonstrating for ‘justice and the American way’ to pressure the Zonians and the Congress to make way for his sham of a treaty. In addition to generally behaving as little pests by demonstrating at the gates and/or actually entering our military installations, they were distracting us from dealing with what the Panamanian government wanted us to think was Cuban terrorists. The so-called terrorists were being a little more than pests in that they were setting bombs here and there causing a bit of stress among the local zonians and the military dependents. Shortly before my arrival in 1975, a new US Attorney had arrived in the Zone. He was fresh out of the Civil Rights Division of the Justice Department and it was obvious he had instructions to do his part to keep the pressure on to speed up getting Jimmy’s treaty on the table. My boss (the Canal Zone Command Provost Marshal) was a mean old airborne ranger colonel turned military policeman (MP) only after 15 years in the infantry. On the day I arrived in the Zone he told me the reason he had selected me was because of my infantry experience. In the next breath he told me he wanted Jimmy’s little pests cleared out and the terrorists negated straight away. We started two days later detaining all civilian demonstrators for 72 hours in our stockade before releasing them with a criminal trespass notice and the suggestion that they catch the next flight stateside. Side Note: Without getting into any embarrassing details the last two bombings occurred within four weeks of my arrival. Following the old colonel’s tactics to the letter the terrorists seemed to have received religion and returned to Cuba? Do not know why it took the US Attorney over a month to get wind of the military locking civilians in our stockade for 72 hours, but within my first month he arrived in the colonel’s office in a rather agitated condition. He demanded that we cease locking up civilians and only he could order his US marshals to detain civilians. The old colonel pulled out a book and read the Internal Security Act of 1951 to the US Attorney. The act provided that any US Army officer in the rank of major or above could detain a civilian breaching the security of a military installation and/or interfering in military operations for up to 72 hours. The US Attorney said he did not care about the law and tried to order the colonel to stop detaining civilians or else. The colonel looked at me and asked how many MP’s did I have. After I replied that had I 549 duty MP’s, the colonel turned to the US Attorney and asked him how many US marshals he had (he did not answer but we knew he had six). The colonel then told the US Attorney he should submit his complaint to the Attorney General or the Secretary of Defense and wished him good day. Think Donald should ask Nancy how many cops/soldiers she has?

The Supremes will go down as the Court that stripped the RULE-of-LAW away from the United States of America. and NO Supreme Court member wants to be remembered of letting that HAPPEN.

    The degree to which members of congress, government officials and lawyers, and the intellectual elite have rationalized that Trump poses such an existential threat that all means of artifice, deception, underhandedness, secrecy, abandonment of professionalism, violation of oath,subversion of law and abuse of the justice system are justified is unprecedented in the nation’s history and truly astonishing to me as a citizen. American politics has always been highly partisan with accusations of wrong doing, cycles of investigations and raging controversies. But never have ordinary ethics, morality and sense of fairness been abandoned to this extent in pursuit of a political objective. A government where this behavior is tolerated an any level and not exposed and punished is no longer serving the people.

      It has long been well established by SCOTUS that Congress has lawful (judicial authority) subpoena powers pursuant to its implied responsibility of legislative oversight. BUT that only applies to the items enumerated in A1§8. Neither foreign policy (Ukraine) nor impeachment have any nexus to A1§8. So, for example, Schiffs Intelligence committee has no judicially enforceable subpoena power in the matters he pretends to be investigating.

      It was separately established bu SCOTUS during the Nixon impeachment investigation that IF the full House votes to have the Judiciary Committee commence an impeachment investigation, then Judiciary (only) has subpoena power that can also overcome executive privilege claims. There has been no such vote.

But the hate filled Democrat party has crossed into an evil world of politics that only the crazed or the cruel choose to travel. Most sane people have a conscience or the wisdom or “faith” that restrains them before they cross such a perilous line.

    The MSM is doing the nation a terrible disservice by portraying these evil Dem deeds and actions as just or righteous and that P Trump’s innocuous phone call is a justified impeachable offense. This recent egregious media fraud on the public is something only genuine enemies of the people would willingly promote on a mass scale.

    Some pollsters (blame or) allege that “suburban women” were the deciding voters that gave the Dems the House in 2018 because their lying Dem Rep candidates promised their gullible voters that they’d concentrate their efforts on Health Care and other important family issues rather than attacking P Trump. I wonder if any of these Dem voters are pleased with how these 2018 promises are working out for them. If POTUS wasn’t great at his job, even when he’s under constant attack, the families of these suburban women would be far worse off. Watching the evil deeds of the “Do Nothing But Impeachment Party” every day is a definite health hazard.

    This has become a race between Pelosi/Schiff and Barr/Durham. The Ruling Class knows how many skeletons are in their closets, and they sense Barr will expose a significant chunk of it. Barr/Durham are realizing the corruption and conspiracy at the top of government is so vast it may take years to uncover and prosecute. It is like a major RICO case with hundreds of persons involved.

    Pelosi is short-cutting the normal impeachment process, as Sundance has so ably described, because if Barr comes out with his case first, the Ruling Class will be severely damaged and loose more support of voters. They have already realized they cannot beat Trump in the election with their ragtag band of candidates. Their fear is that they could also lose the House once the corruption is exposed.

    Barr/Durham are trying to work deliberately and carefully, but there are too many threads to unravel and they are hampered by corruption at the FBI, CIA, State Department etc. which forces them personally obtain evidence in many instances. One of Pelosi’s aims with fast track impeachment is to force Barr to end his investigation prematurely and thereby limit the bleeding among the ruling class.

    I distinctly remember some comments after the 2018 Mid-Terms about how losing the House of Representatives was not that big a deal. “We have the Senate and the White House, let them have the House….”.

    I commented then that it was a disaster. So, was it?

    In the past 3 years we have discovered:

    – The leadership at the FBI took prima facia evidence of violations of 18 US Code 793(f) by Hillary Clinton and her aides, presented it to the American public, and said “We will not prosecute this”. To this day, this still might be the most astonishing thing I have ever witnessed from a law enforcement official. In retrospect, this was a clear indicator of the utter corruption in the FBI and Justice Department that we did not yet understand.

    – The Email Records of Hillary Clinton were subpoenaed legally. There was no court challenge that the subpoena was illegal. She, and her legal and political team, attempted to destroy tens of thousands of these emails, in DIRECT VIOLATION of Federal law. To this day, no one has been charged with Obstruction of Justice, Destruction of Federal Records, or Perjury in this case.

    – A laptop computer with HUNDREDS of THOUSANDS of Hillary Clinton’s emails, some of which contained classified information, was discovered. This prima facia evidence of violations of 18 US Code 793(f) was also ignored and discarded.

    – The Obama Administration use the most sophisticated electronic surveillance system in the world to illegally spy on his political opposition. This is not opinion. There have been 2 judges now that have indicated that VAST numbers of illegal searches were done of the FISA database. 20 years ago the ACLU and various other Civil Liberty Groups would have led the charge to tar and feather the government officials who participated in this. Now, all you get is a deafening silence

    – Senior Member of the Obama Administration planned and participated in a manufactured coup against the incoming President Elect. They used American Intelligence Assets (like Stephan Halper) to plant and set up false stories against Trump campaign officials.

    – Senior FBI personnel lied repeatedly to the the FISA Court in order to gain “legal” cover for their illegal activities.

    – Government Officials have repeatedly leaked classified government documents without reprisal.

    – The Constitutionally protected American Press has taken sides, politically, and have aided and abetted the dissemination of known false information in order to weaken and take down the President.

    Now, the House of Representatives is poised to:

    – Obtain secret testimony from unnamed witnesses who are reporting 2nd hand information which was classified information illegally leaked.

    – Use the testimony of witnesses being protected by an Inspector General who changed and backdated rules in order to shield the identity of the person trying to reveal classified information.

    – Draw up Articles of Impeachment in secret without input from the minority party.

    – Present the Articles of Impeachment for a House Vote without allowing the President or the other political party to subpoena documents and/or witnesses.

The Impeachment Platform will provide a global platform for the fight to the death between Trump and the Deep State, with the MSM spending the last full ounce of its credibility in the effort.     Where in the Constitution is ‘judicial authority’ mentioned? The Congress has the authority to ‘constitute tribunals inferior to the Supreme Court’, but aside from making laws and impeachment, has no other judicial functions. It’s not even clear to me where the extra-judicial authority for committees of the Congress to issue subpoenas comes from.

    From what I’ve read so far, aside from Due Process entitled to every citizen, the main argument of the President’s lawyers for a full House vote relies on precedent, which is significant, but Granny Pelosi can ignore that if she wants. It’s not binding. /LEJ

      There are only two ways Congress can get one of its subpoenas enforced.
      1. Federal court civil contempt—fines
      2. Federal court criminal contempt—jail
      There is Theoretically a third, ‘inherent contempt’ enforced by the House Sargent at Arms. Is very political and impractical. Was last used (and abused) in 1934. See McGrain v Daugherty 275US135 as limited by In re Chapman 166US661. SCOTUS would likely reverse McGrain were inherent contempt be tried Under present circumstances.

            There is an elevated level of subpoena, made power possible by SCOTUS precedent, that carries inherent penalties for non-compliance, and is specifically allowed for impeachment investigations. That level of elevated House authority requires a full House authorization vote.

            In this current example the Legislative Branch is expressing their “impeachment authority” as part of the Legislative Branch purpose. So that raises the issue of an entirely different type of subpoena:… A demand from congress that penetrates the constitutional separation of powers; and further penetrates the legal authority of Executive Branch executive privilege.

            It was separately established by SCOTUS during the Nixon impeachment investigation that *IF* the full House votes to have the Judiciary Committee commence an impeachment investigation, then Judiciary (only) has subpoena power that can overcome executive privilege claims. [my emphasis]

            There has been NO VOTE to create that level of subpoena power.

    Regardless of the current impeachment scam, just the fact that one of the two major political parties would go to these extremes to overturn the will of the voters is enough to convince me there probably is no coming back from this. Even if PDT is re-elected in 2020 (and I hope he is) half of the nation is being led to believe that the will of the American voters does not matter. This is how nations fail. There probably won’t be a shooting civil war, but the instability created by this current political crisis is more than enough to eventually erode the confidence in the American system. It’s been said for years by people a whole lot smarter than me that the only way America falls will be from within. Well, here we are. There can be no “Uniter in Chief” from either political party. The current system has been corrupted to the point that there would have to be maybe 30 or 40 criminal convictions of actors from the last disastrous administration to salvage the nation and I don’t see that happening.

I seem to recall reading after the coup, that what bothered the US and EU was not the corruption, but that Ukraine was being offered cheaper gas from Russia, like 2/3ds the cost, and their President was inclined to take that offer, before being run out of office, by a coup planned by neocon Assistant Secretary of State Victoria Nuland (see her taped cellphone call plotting the overthrow on Youtube). Any Ukraine experts out there who can flesh out the record? Ah, from google, here’s what I was remembering, from

    Is it possible the coup in the first place was designed to allow Burisma to block this cheaper Russian gas and to profit it from higher gas prices? That would certainly pay for a lot of politically connected board members.
