DOJ Reverses Course in FARA Case – Calls Flynn “co-conspirator”, Doesn’t Want Flynn Testimony – Judge Sullivan Intervenes…

Breakthrough – Things Making Sense Now…

Lots of things going on in/around the two legal cases involving Michael Flynn today.  The origination of the DOJ shift in position involves the indirect case (EDVA) where Flynn is/was a witness in the FARA (Foreign Agent Registration Act) case against Bijan Rafiekian and the Flynn Intel Group.

Hat Tip to Techno-Fog for a litany of legal filings assembled today [132 pages here].  This is somewhat complex to explain.

The direct case against Flynn (Judge Sullivan court – Washington DC), where Flynn copped a guilty plea for lying to FBI investigators, has a sentencing predicated on Flynn’s ongoing cooperation in the Eastern District of Virginia (EDVA) case against Bijan Rafiekian and FIG (Flynn Intel Group).  However, in a stunning move today the DOJ prosecuting Rafiekian now says it will not call Flynn as a witness; and further the DOJ state they now consider Flynn an “unindicted co-conspirator”.

From court filings (on behalf of Flynn) we find the reason.  Michael Flynn refused a demand by the DOJ to testify that the Flynn Group FARA filing was completed with knowingly false information and contained “false statements”.

Michael Flynn refused to testify to this DOJ construct because the claim was not true.

Michael Flynn and his lawyers say there was no intentional filing of false information in the Flynn Group FARA submissions; and the FARA forms were submitted based on legal advice provided for their completion.  If there were mistakes in the FARA filing, they were not falsehoods and/or mistakes made purposefully or with purposeful intent.

When Flynn agreed to the plea for lying, he was agreeing with hindsight and accepting the government position that some of the material in the FARA submission was false.  However, Flynn did not admit that anything was intentionally false, but rather an outcome of mistakes made within a process that relied on legal advice.

It is worth noting here that Flynn lawyers call out former DOJ-NSD Official David Laufman for pressuring Flynn to sign the FARA submission; a FARA submission the DOJ would later claim contained false information.

The DOJ prosecutors wanted Flynn to say that he, the group and Bijan Rafiekian, knew the information on the FARA submissions was false.  Flynn refused; and would not testify to that falsehood in the case.  As a result the DOJ retaliated against Flynn by changing his position to a “co-conspirator” and cancelling his testimony.

The DOJ prosecutors don’t want Flynn to testify (no longer want his cooperation) because his testimony would undercut the foundation of their case against Bijan Rafiekian.

So with Flynn’s cooperation now at issue in the secondary EDVA case, in the primary case against Flynn himself, Judge Sullivan (Washington, DC) wants some answers:

BACK TO EDVA – The lawyers for Bijan Rafiekian, also filed motions to dismiss the DOJ indictment based on the prosecutors inability to prove the Flynn Intel Group knowingly acted on behalf of the Turkish government.

Essentially Rafiekian is arguing the Flynn group were hired and advocating for private interests and they had no reason to belief the Turkish government was behind the contract.  This is the essential underpin for the FARA registration.  If the Flynn Group didn’t know they were contracted by a foreign government, they wouldn’t know how to fill out the FARA forms.

Here’s where it gets interesting and a picture starts to emerge.  It is possible, very possible, the DOJ-NSD using their legally authorized database and surveillance access, knew the background principals behind the Flynn Group contract were members of the Turkish Government. [DOJ-NSD head David Laufman knew]  However, Flynn, Rafiekian and their lawyers did not know; and therefore signed a FARA submission that was later shown to be false.

Yes, Laufman -representing the DOJ- knowingly pressured Flynn to sign a FARA submission while withholding evidence the DOJ would later use to prove the FARA submission contained materially false information.  That’s how it looks.

The same David Laufman who sat in on the Clinton email interview.  The same David Laufman who was FBI official Monica McLean’s lawyer when things got sketchy about her work with “beach friend” Christine Blasey-Ford…

… Yes, THAT David Laufman.

In a late breaking development, Judge Anthony Trenga (EDVA) ruled the DOJ has not presented evidence sufficient to establish “evidence of a conspiracy” for the purposes of admitting the hearsay statements of alleged co-conspirator (Flynn).

TECHNO: “Notably absent” from the DOJ’s proffer is “any evidence… that Flynn… has admitted that he made certain false statements in the FARA filing” that was part of the alleged conspiracy.

Bear with me…

Here’s what I THINK is going on…. Keep in mind we saw this in 2016, and we warned about something weird going on in the background, but we did not know what it was.

Now we have hindsight to overlay with our CTH warnings in late 2016 (Oct/Nov).

I suspect the DOJ-NSD knew Flynn was lobbying for clients closely related to the Turkish government.  I suspect Flynn was already under Title-3 surveillance (confirmed by Mueller report) and this lobbying issue likely became the legal predicate for a Flynn Title-1 FISA warrant.  [Go Deep To See] That 2016 FISA warrant, likely approved by FISA Judge Rudy Contreras, allowed the DOJ-NSD -via FBI (Strzok)- to launch a counterintelligence investigation into the people who hired Flynn as a lobbyist.

If my suspicion is correct, in addition to the larger surveillance issues upon Flynn, the DOJ-NSD knew the people who contracted Flynn and Rafiekian were a ‘front‘ for senior Turkish officials (not withstanding possible WH coordination).

So when Flynn was confronted by DOJ-NSD head David Laufman, he was being *interviewed* by a DOJ official who knew more about the contract initiator than Flynn did.  The DOJ-NSD and David Laufman was involved because manipulating FARA violations was the method to conduct surveillance (SEE HERE).

David Laufman then pressured Flynn in January 2017 to sign the FARA submission, knowing it contained material that was false, but unbeknownst to Flynn.  This later became the predicate for the FARA case against Flynn and Rafiekian.

However, there’s a twist as highlighted by the Judge Trenga order.

The DOJ (Laufman first) knew the background of the FARA filing was false because they had conducted a FISA Title-1 investigation prior to the Flynn FARA submission; and the DOJ (Mueller team now in 2017) knew the Turkish government was behind the lobbying contract…..

….But the DOJ cannot tell the court how they knew the lobbying contract was from the Turkish government, because they didn’t want to reveal the FISA surveillance; AND the DOJ may have an additional interest in hiding their knowledge of their origination of the lobbying contract by the Turkish government,… because it might have been somewhat coordinated by the Obama White House (pro-brotherhood, and pro-Erdogan).

    Ristvan, as a lawyer can one walk the jury through the complexities of an operation like this to the point where a jury can understand the multiple points of convergence and the conspiracy? Can a jury be made to understand how all the spooks,coooks, and enimedia played their part? I have to reread many of SD’s posts just to comprehend most of it myself. Or are we going to get them all on something like tax evasion and let them meet their maker from the clink?

      IMO, one does not need to be concerned about a jury. No jury will be involved.

      Flynn is apparently no longer involved in the EDVA case as a cooperating witness. Flynn was set up tp be a witness because of a contrived legal plot that has shown to be false.

      With Flynn not a witness, the government has no case and the concern about speaking to the jury becomes a poof of smoke.

At best an election will be decided on the basis of what appears to be blatant manipulation by members of the Intelligence Community. But heads? As many as 16 TOP FBI agents were at the invite only conference. At least one of them had the integrity to reveal McCabe’s motive for what became a political witch hunt.

      Oh my, looking at Flynn’s Lawyer Sydney, I see how she boxed the DOJ in. The reason she brought up the fact a couple of weeks back that she knew the DOJ didn’t give Flynn’s lawyer all the discovery they were entitled to was she wanted to PLANT it in their head that if they tried to take away the plea later on, I am coming for those files, LOLOL. Thus the Gov. , IMHO, can’t back out of th Flynn deal on that end, because even though they have it in writing (Buffaloed Flynn)that Flynn is no longer entitled to discovery, and Sydney knew that, she wanted them to know, if they drop the agreement, she would be coming after the full files via Discovery.

      Thus the Gov. had only one option, to try to charge Flynn as a co-conspirator in the other trial, but of course they can’t prove it because the evidence they have proves they were spying on Flynn and had foreknowledge or basically, Set Flynn up. So all the judge could do is not charge Flynn, and with no evidence/testimony from Flynn, the other guys case goes away too. Now Flynn gets his plea deal in the other case because they are scared as hell of what Sydney might find out….She basically put Flynn in a no lose situation, she knew those cowards didn’t want her going through their Gov. Docs. So all they can do is cry uncle !!

    I think the corruption is much much bigger than we are seeing. I really believe that. The question is, will it be exposed and justice served? Not only for Flynn and Trump but for all victims?

        I too believe the biggest payoff using the NSA database was selling insider trading Information. As an example, one could data mine all the recorded communications between the principles of a firm known for mergers and acquisitions. The returns could be huge knowing the targets.

        I recall the French government accused the American intelligence community (NSA) of industrial espionage many years ago. Maybe they saw a pattern. Five Eyes was exposed at about the same time to the EU parliament, and the same accusation me were made.

        This would be the Mother of all Pay-to-Play scams. The use of the database for blackmail, although useful for legal and political control, is small peanuts. Always follow the money.

        Flynn is broke, like most people in the military and saw that there was money to be made. But I believe $35,000 was all he was paid for his involvement. That is nothing to these people. I don’t see him as greedy, more naive, in a way, although he was privy to all sorts of info and probably saw everyone else make a bundle. People never expect to be a target themselves.
        In a similar way,, Uncle Joe was surprised that he would be attacked for racism, although he’s been a dirty player himself all these years.

    Jun 22, 2019 – General Flynn as we all know now was targeted by Obama and the Clintons for some reason. He knew too much and he was working with Trump, but maybe his [November 2017 op-ed for the Hill] was what scared them the most. He had to be taken down and so he was targeted.

        Some years ago, when I was studying education and charter schools, the Gulen movement schools were being staffed by Turkish import teachers, paid for by our tax dollars, etc… The charter school system , and set-up was supposedly being investigated by FBI. I never heard what happened in that investigation!! I believe the name of some were a chain of Cosmos Schools??

    Don’t we know that Flynn remained in regular contact with DIA, at least to the extent he debriefed on his Russia speech and other contacts? Doesn’t it seem odd that a former head of DIA would sign onto a lobby effort without drilling down to the source? It requires an entire suspension of belief on everything we know about him to think he just didn’t know. Especially in the midst of a presidential campaign, while he was teed up for another top intelligence post. And especially when by all evidence Flynn loathes such shady or irresponsible behavior among others.

    Where I’m going with this — I think there’s still more to this story. I know there’s all sort’s of wild speculation about what’s really going on, but at this point suspecting some sort of ongoing work for/with DIA seems the most believable.

    I mean talk about being caught with your pants down — two high profile cases built upon FISA abuse upended with one abrupt move by Flynn. “Yeah, no, I didn’t know those statements were false. Why …… did YOU?” It sure quacks like a sting.

    I know, I know …. no big leaps or inferences. Wait for the facts. But that can’t mean to pretend somethings rings true when it flatly doesn’t. The idea of Flynn unwittingly lobbying for the Turkish govt while meanwhile gearing up for a post in Trump’s administration isn’t believable. Nor does the idea that he’d pretend not to know so he could cash in, then duck and cover.

    It really looks like the outlines of a sting are coming into focus.

    These points to the depth and breadth of continuing conspiracy and subversion in the DOJ. Why have these FARA lawyers not now been fired by Barr?

          Getting rid of the 17th Amendment is a great goal!! If we had abolished it, we never would have had John McCain as Arizona legislature never would have put up with a open border candidate.

          Popular vote is a terrible idea and will lead to the most populous States being able to swing elections, negating the vote of the smaller States. Not a good idea and one the founders (and history) has rejected. Check Article IV, Section 4 of the Constitution where the federal government are to guarantee a representative form of government, not a democracy as a popular vote would do.

          A better idea would be to abolish the 16th Amendment giving the federal government the power to confiscate ALL of your income. Read it. There’s no limits.

    Why was Judge Contreras taken off Flynn case after signing off on FISA and approving a quickly arranged plea deal? Does Flynn not have the right to know?
    Did FBI and DOJ quickly target Flynn to cover up their actions before his security clearances showed their actions?
    Flynn was very involved in Trump campaign and forming of his Administration. What level of surveillance was he and Trump team under during this time?
    When Barr states there was spying going on and he is investigating the predicate, it’s clear Obama FBI/DOJ did everything in their power to continue the spying.

Unfortunately I can’t see the schedule for July 8 any more, but look here and you can see the schedule for as far out as 1 week. http://www.vaed.uscourts.gov/schedule/index.html So just pull up the schedule for Alexandria for the upcoming week and search on a party name and there ya go. Notice once again that Q just posts a vague comment with no useful info about what might be happening. That’s because Q only saw the entry on the schedule which does not mention the purpose. It would have been far more impressive if he had mentioned “unindicted co-conspirator” or even “unsealed”.

      Q is taking advantage of people who don’t know where to look to acquire the info he’s acquiring.

He’s not going to be exonerated. And now he’s reneging on his deal with the prosecutors, though for good reason. His new team of attorneys is trying to minimize the damage (and perhaps expand their own knowledge of what happened in the process). Keep in mind Flynn had a deal with prosecutors that his sentencing would be delayed while he continues to cooperate, and right now he’s cooperating to take down his old business partner, but he didn’t quite cooperate the way they wanted him to.

      Instead of reading Q posts you should be reading the court documents and good articles summarizing them.

    Under Muellers and Comeys guidance, it appears many worst fears became true. We have not just provided FBI access to foreign information, we have opened a window for foreign actors to influence domestic matters. Hence Steele Dossier and it’s marketing to FBI, DOJ, State Dept, John McCain etal.
    And then there is the matter of legally protecting sources and methods even when our duly elected President and policies is effected.
    FBI is no longer manageable, does not furnish info for oversight and needs to focus solely on domestic matters.

      I’m not an attorney so obviously I don’t really know, but I have a feeling there isn’t much that can be done for Flynn beyond ending his cooperation as a witness, getting his sentencing done, and then maybe Trump will pardon him after he is re-elected. (Everyone needs to make sure Trump is re-elected!)

      One thing I like though is that Sidney Powell, who was already well-versed in what the traitors did, is not getting a privileged inside look at all of the documents pertaining to the Flynn case. I’ll bet there’s some eye-opening material there.

    It seems to me that we taxpayers are being forced to fund various “intelligence agencies” that are supposed to protect us, yet the reality is that the vast number of the employees seem to spend all their time engaged in some kind of illicit activity designed to destroy our Country and its patriotic citizens.

    How did it ever go this far?.

    If they won’t indict their own over a coup on the President of the United States what makes anyone think they will act on anything to uphold the rule of law and our Constitution, especially if they themselves violate the law?

    Their answer is we may need some modifications to policy and more training.

    Honestly it is time to organize and march on DC like we saw in Hong Kong and surround the FBI and DOJ buildings 24/7 voicing our demand for justice.

    How will this impact Flynn’s other case? Judge Sullivan has ordered the Government to respond by 6pm today and Flynn’s response 24 hours later.

      I read a NYT article published yesterday and I laughed because for the most part it was very objective and did a good job of summarizing the recent events. But at the end of the article they had to insult Sidney Powell. IIRC there’s no mention that she was a US Attorney but there was mention that she sells t-shirts on her web site. Horrors. (eye roll) They can’t really criticize what Flynn’s new attorneys just did so they have to criticize the attorneys personally.

      You might not be doing this but some people are criticizing Trump for not doing enough to fix the problem. I hope everyone will remember that Trump is a victim of what happened, and because the President isn’t a dictator he can’t fix all of the problems by himself. The President is balanced by Congress and the Supreme Court, the President doesn’t have complete control. And Trump needs to make sure he can be re-elected.

    Rep King made statements over the weekend that are an attempt to prep us for the scale of abuse by the FBI/DOJ of the FISA warrants.

    Most have no idea how invasive the surveillance is when under a T-1 warrant. Sundance’s assertions of the setup of Flynn, when viewed through that lens are just beginning to scratch the surface.

Oblique comments in Trenga’s ruling make it clear that “the legal implications” of various Government actions remain to be resolved in his mind – and I’m sure that Judge Sullivan is now thinking the same. Was Flynn strong-armed into signing a false confession? And then, howbeit that he suddenly becomes “an unindicted co-conspirator” when he refuses to say that he willingly lied to the Government? Yes, I think that it is entirely proper for both Judges to demand to know, “exactly where did your information come from, and exactly when did you have it?”

    Note also that it’s possible to independently verify the latter part of my question, using the audit records that are kept by these top-secret systems. As Admiral Rogers demonstrated (to Judge Collyer et al), exact details are kept of every query that is run. Did the Government deceive Gen. Flynn and illegally entrap him, even while threatening his son?

    Once again the connections to Spygate and to the Clintons is inescapable. I shudder to think that this pure-evil woman was supposed to be President.

    This is what it looks like when the “counter culture aka 60’s radicals” and their spawn get power. “If it feels good do it – the ends justify the means -sticking it to the man.” Those of us old enough to remember understand that this was promised 50 years ago, once the Woodstock Nation was born. Anything goes with this group of radical devotees. While most of us were getting off on the great music. There was a group that was immersed into cultural Marxism and promised once they were in a position of power to do exactly what is taking place, overt corruption with all manner of debauchery.

    The good news, they are actually a small group and can be exposed as President Trump is doing with ease and alacrity. This is their Achilles heel and once they start to tumble they will tumble fast. They have no loyalty other than themselves and once they begin to be swept up, they will turn on one another in attempts to save themselves.

    This is why someone like General Flynn is such a threat to the cabal, duty, honor, love of country are diametrically opposed to an inherently corrupt administrations. A crime syndicate does not function with people who posses a moral compass. “Snitches get stitches.”

    Sydney Powell is hip (to use a 60’s – 70’s vernacular) to their treachery and knows that their con only works if you participate and perhaps this is the reason for the move.

We know this because the KGB files were released after the fall of the Soviet Union. And we also learned the US State Department was heavily compromised by the KGB and for some reason nothing was actually done about it once compromised parties were outed and identified.

        We need to go back to Senator McCarthy and all his evidence and start from there. Pres O, his family, his grooming in Hawaii and in Chicago (the Chicago way) is one example to hold up to every American. Real back Americans, real African-Americans will welcome not having that horrid stain held up to them as “their responsibility.”

        The turn to communism away from the goodness of America happened to one large tradition of black Americans after they became disgusted with the vicious racism contuining in our country. Republican President Teddy Roosevelt tried to end that tradition; he invited Booker T. Washington to the White House as a first step.

They eventually found no goodness for themselves in communism; they were simply tools of communism’s anti-Americanism.

        The Civil Rights movement of the late 1950s on (until marxist take-over in the 1970s) righted these wrongs in a huge way. Let all black and African-Americans learn that history.

        Let all Americans learn that Constitutional Republicanism comes from Classical Liberalism of the Judaeo-Christian tradition, the Enlightenment, the scientific method, and limited government traditions of British background. These are the traditions to conserve and to honor in American Conservatism.

        All those who continue to use “liberal” like a swear word are making it difficult, maybe even impossible, to sort out that “liberal” today only means “communist.” Like the stealthy takeover of our government, they attempt to takeover our minds and our values. Make them (both Dems and Repubs) define what they mean when they use the label “liberal.” Neither mean the values of the American Constitutional Republic.

    As this matter unravels, it shows another reason why I believe the 2020 election will be worse/ bloodier than 2016. Those behind these acts will have need to string events out, then do anything to win. Riots, racial and class warfare assured, all paid for by those behind this. Scary.

      That’s why you and me and everyone else needs to a) vote for Trump and b) give him House and Senate GOP majorities. People voted very stupidly in 2018. We can’t keep doing that and expect MAGA to happen. Trump is only one man, he needs proper support from Congress and the Supreme Court.

    Obama and his Thugs set out to destroy anyone that was against them and they clearly used governmental powers to do just that. What we see now is ‘HOW’ they did it! I don’t want just ‘Justice’, I want Hangings and Executions!

      All lawfare, and the illegal surveillance that makes it possible, must be stopped along with creating penalties so severe that few will take the risks again. Like our magnificent President Trump has said, this must never happen again to any candidate or president. Nor must it ever happen again to any citizen.

      Furthermore, there must be some way not only to exonerate Gen Flynn, but to restore to him all the wealth he has had to squander to fight the slimy bastards. My wish is that they be required to pay for it all – from behind bars.

    Pursuant to the last paragraphs, I somehow suspect Flynn is acting in cooperation with the swamp cleaning crew in order to trap and expose the people behind the entrapment scheme.

    It would be consistent that they used foreign governments in order to entrap political adversaries. Flynn was a political adversary. And they have done this in order forms with Popoudopolis and Carter Page.

    I read Sidney Powells’s brief in its entirety, and boy, does it contain shades of “License to Lie” and the upending of DOJ prosecutors withholding evidence from Flynn’s Defense team. I won’t come close to legalese in my takeaway from the briefs of the 2 cases (Flynn, Bijan), but here goes:

    FLYNN: SP, without casting blame (professional courtesy) against Flynn’s former atty (Covington), alludes Flynn, was advised by former attys (pressure on Flynn’s son, legal fees) to file FARA under duress by Laufler, “who resigned a few days later”. It appears DOJ/FARA Division “worked in an advisory capacity/pressured” with Flynn’s legal team to determine if he was required to even register. IOW, Flynn/attys complied a draft of FIG/Inova (Flynn Intel Group/Inova-Bijan) contractual work and sought advice from DOJ/FARA to flesh out if FIG’s activities warranted FARA reg. SP noted, a woman within FARA Div was “unusually active in pressuring Flynn to hurry up and get FARA submitted”.

    SP, also submitted “Exhibits” to the Court (which she “found/uncovered” and transcribed herself), DOJ “hand written notes”, in which she noted she discovered various pertinent “possibly exculpatory” info had been curiously omitted by the prosecutors. It was difficult to follow given the number of players – Flynn’s FIG attys/Flynn’s Covington attys/DOJ interviewers etc.

    Here’s where it gets suspicious, and I’m wondering if DOJ/NSD has pulled a Pappadopulous/Mifsud/Page/Halper set up……
    Flynn’s contractual work for Inova (40K report/proposed campaign anti-Gulen) appears to be on the up & up….no foreign govt/Turkey involvement. The detailed scope of the proposal was included in the Brief. The caveat of implied-suspected Turkey govt seems to hinge on a meeting in NY (sometime in Sept/16?) where Flynn took a meeting with Bijan and “two foreign minsters from Turkey”. Both Flynn and Bijan stated nothing was discussed pertaining to FIG/Inova contract (Gulen). It’s implied that Flynn was taking this meeting as a favor to Bijan, and as he (Flynn) was actively involved with the Trump campaign at the time, was a quick courtesy hello/goodbye/off to the next campaign stop.

    IS IT POSSIBLE FLYNN WAS SET UP VIA DOJ/NSD ala Pappa/Page? Food for thought.

    It should be noted, Flynn canceled his contract w/Inova shortly thereafter, as it appeared he was going to be tapped for the Trump/NSA position. He also partially refunded Inova (20K?), and it appears DOJ was implying “questionable FIG financial accounting”, to no avail.

    Bijan: it’s curious, although standard DOJ shenanigans, DOJ prosecutors in the Bijan case are trying to get Flynn’s testimony (co-conspirator?) in via a “document” no one has seen vs. calling Flynn to personally testify.

    Apologies for the winding length, but just wanted to highlight 1) Flynn couldn’t be in more capable hands than Sidney Powell. After all, she literally wrote the book on the corruption that is DOJ, and 2) the possibility Flynn was set up in NY mtg.

      To answer your question, yes, Flynn was set up. It’s all a set up, everything from the very beginning. It has taken this long because of Special Counsel shield. Bit now things are unraveling because there is now no “ongoing investigation” for them to hide behind. There never really was an investigation, just the appearance of one that allowed The Obama Co-conspirators to dodge accountability and sunlight. PS I’m not that smart. I’ve just been following this from the beginning with Sundance.

        It’s plausible the govt was dangling the FARA reg in two ways to nail Flynn.
        1) to suggest he falsified by claiming he had no interaction w/foreign govt, i.e., acting as agent for Turkey. When Flynn pled to lessor charge of lying to FBI, that appeased the govt FOR NOW. Kept him gagged throughout Mueller fiasco.
        2) Now that he has new counsel (SP) fighting back and uncovering DOJ malfeasance, they want to waltz in with the “insurance policy”, w/claims he’s a co-conspirator in the Bijan case.

        What is the “treason” insurance policy? The setup-NY mtg. They hoped to not have to use that, as the implications of conspiring with foreign govt to setup Flynn, (two birds, one stone) triggered FISA, as well as “proof” he lied on FARA.

    I am not one hundred percent sure but it looks like Emmet G. Sullivan reports to Chief Judge Robert E. Morin appointed by Bill Clinton. So, if Sullivan is part of the resistance then it’s likely that the Chief Judge is too since he would have to turn a “Blinds Eye” to the actions of Sullivan.

    Read all this this morning. Haven’t researched the fine points, since doubt Sidney Powell needs any assistance. But for Treepers, will sketch out how IMO this likely will play out for Flynn.

    The EDVA developments will open Sullivan’s eyes when Ms. Powell brings them to his attention. Likely sufficient grounds for Flynn to withdraw his plea under FRCP 32(e) because still pre sentencing. That presents two possibilities. DoJ folds and done. DoJ does not fold.

    In the latter possibility, gives Ms. Powell the ability to conduct pre trial discovery. Like, was there a FISA warrant on Flynn? Like deposing Lauffer based on the turn of events in EDVA and Sundance’ analysis here.

    And based on that, she will get Sullivan to dismiss the indictment with prejudice for prosecutorial misconduct. And that is her direct slap at Weissmann.

    Guess I am an optimist at heart.

  49. As I have commented before, everything in this trial (and the one in which “the DOJ” — but where is Barr? — wants to paint Flynn as a “co-conspirator”) is a lie. In other words, Sundance and his tipster(s) are wallowing in the weeds put out by the Obamanites and cronies. It’s all “what a tangled web” they are weaving, to fake you out of seeing where the pea actually is: Obama is pro-Muslim and Flynn is anti-Muslim. Period. Now, that last sentence leaves out all the connections that prove it, but that is basically it — the buck stopped with Obama, and it was and is a Muslim buck, working against America and the West in general (in revenge for past slavery, inability of blacks to get over it, and of course 1400 years of Muslim jealousy and religious bitching in their heart of hearts, because their religion is a lie that cuts off their manhood even as it literally, and insanely, screams for them to show their manhood by believing in it).

    What is going on here is, I think, entirely in line with what is going on with the attempted coup against President Trump. In that “debate”, Sundance and others keep going over the FISA warrants (of Summer/Fall 2016) instead of the much earlier FBI political and criminal collusion with the DNC and Fusion-GPS, in the FISA “queries” runaround (late 2015 through early 2016). In the present case(s), they’re delving into the weeds put out about the second Flynn-associated case, instead of the falsity of the original premise, that Flynn “treacherously” talked to a Russian after Obama had already made known the Russians were “bad” by expelling 35 of them from the USA.

    I understand that Sundance and others want to unravel every thread of this fibrous ball of fertilizer; but the truth is that Obama sicced Comey on Flynn for Flynn’s anti-Muslim positions and actions. The underlying threat to America here is the Muslim subornation of the Federal government, just as Black Muslims suborned Martin Luther King’s Christian-inspired “civil rights” movement, turning it into a determinedly revenge-minded attack on America — all, in the end, to justify and empower Muslim jihad of the Judeo-Christian West.
