DOJ Admits FBI Never Saw Crowdstrike Report on DNC Russian Hacking Claim…

The foundation for the Russian election interference narrative is built on the claim of Russians hacking the servers of the Democrat National Committee (DNC), and subsequently releasing damaging emails that showed the DNC worked to help Hillary Clinton and eliminate Bernie Sanders.

Despite the Russian ‘hacking’ claim the DOJ previously admitted the DNC would not let FBI investigators review the DNC server.  Instead the DNC provided the FBI with analysis of a technical review done through a cyber-security contract with Crowdstrike.

The narrative around the DNC hack claim was always sketchy; many people believe the DNC email data was downloaded onto a flash drive and leaked.  In a court filing (full pdf below) the scale of sketchy has increased exponentially.

Suspecting they could prove the Russian hacking claim was false, lawyers representing Roger Stone requested the full Crowdstrike report on the DNC hack.  When the DOJ responded to the Stone motion they made a rather significant admission.  Not only did the FBI not review the DNC server, the FBI/DOJ never even saw the Crowdstrike report.

Yes, that is correct.  The FBI and DOJ were only allowed to see a “draft” report prepared by Crowdstrike, and that report was redacted… and that redacted draft is the “last version of the report produced”; meaning, there are no unredacted & final versions.

Whiskey-Tango-Foxtrot!

This means the FBI and DOJ, and all of the downstream claims by the intelligence apparatus; including the December 2016 Joint Analysis Report and January 2017 Intelligence Community Assessment, all the way to the Weissmann/Mueller report and the continued claims therein; were based on the official intelligence agencies of the U.S. government and the U.S. Department of Justice taking the word of a hired contractor for the Democrat party….. despite their inability to examine the server and/or actually see an unredacted technical forensic report from the investigating contractor.

The entire apparatus of the U.S. government just took their word for it…

…and used the claim therein as an official position….

…which led to a subsequent government claim, in court, of absolute certainty that Russia hacked the DNC.

Think about that for a few minutes.

The full intelligence apparatus of the United States government is relying on a report they have never even been allowed to see or confirm; that was created by a paid contractor for a political victim that would not allow the FBI to investigate their claim.

The DNC server issue is foundation, and cornerstone, of the U.S. government’s position on “Russia hacking” and the election interference narrative; and that narrative is based on zero factual evidence to affirm the U.S. government’s position.

      Been saying that for a long time now. Everyone pushing the Russia narrative has rested on the Crowdstrike findings. There is enough in the Mueller indictment of the 12 Russian names to overturn the thing. No, that doesn’t prove Seth Rich did it, but it sure punches holes in the Russia narrative.

      This also proves Comey a liar/perjurer again, since the FBI relied on a report they never read.

          “Shares in cybersecurity company CrowdStrike Holdings Inc. soared in their first day of trading Wednesday, closing up 71% from the IPO price and highlighting continued investor interest in fast-growing business-software firms. The results would value the company at roughly $11.6 billion if underwriters exercise all their options to purchase shares.”

          It would be interesting to see who bought the offering, which could be the payoff to Crowdstrike for its crackerjack job for Hillary/DNC.

          Probably not a good time to own CrowdStrike stock, since its brand is going to take a hit. Being a cybersecurity firm that specializes in racketeering and corrupt practices . . . well, I’m sure the FBI will investigate. /s

        Whenever the media publishes or broadcasts opinion as fact, I consider it fake news. “Then Russians hacked the DNC servers” is such opinion. Another one is that “Julian Assange is a Russian agent.” Many on “our side” have particpated in spreading this, including Hugh Hewett who repeats it ad nauseam as if it is fact.

          Don’t you see? The “contractors” were, at the very least sending raw 702 search results to DNC. Seth Rich found out, was in process of leaking, then wakes up dead. CrowdStrike? They’re in the game, too. With Seth dead, the DNC needs someone to blame, so they blame Russia. Who would know otherwise? This fits into the already existing narrative because Trump makes a joke. It is treated as serious, because they use THAT as the hook to show collusion. He wasn’t joking, he was serious! AND, the FBI knows it wasn’t the Russians, because, quite frankly, they were probably in on the Seth Rich hit. They don’t need to review a report, because the report is bogus anyway, and they know it. See how big this is? It’s scary.

        If there is a possibility that keeping quiet will improve her client’s outcome, she is obligated to pursue that better outcome. And as much as the government has been hiding everything, that is still a strong possibility.

        We will benefit from her research, if revealing the information in court is the best way to obtain the best outcome for her client.

          She was the choice I opted for Flynn when most interpreted Joe D’s remark as signaling that he might be taking the case.

          I really like Joe and his wife, but opine Sidney is better sorted out about Andrew Weissmann should he become a factor in court.

          Yes, she will do Flynn right. He couldn’t have chosen better. I bet, JMO, that some other good players were in on getting Sidney and Flynn linked together.

          We won’t see her here much, but that’s okay considering the more important mission. She reads because you can see her icon when she “likes” a CTH blog.

          I can’t help but think and hope some new dynamics are going to develope with her now actively engaged as a lawyer in this case.

      The alleged dnc ‘hack’ is the entire foundation for the case against Stone, so now they are admitting that the entire foundation is based on little more than hearsay from the dnc and their privately hired contractor meaning that there is no evidence to proceed against Stone in a criminal trial…LOL

      The metadata on the dnc emails released by wikileaks proves that it was a leak, not a hack, and the current charges against Assange are only for his alleged conspiracy to hack restricted areas of DoD servers with bradley manning. They have not and will never bring charges against Assange for the dnc servers because there isn’t any evidence since the servers were never analyzed by law enforcement, which is why the case against Stone should be dismissed.

      Their admission that they have no evidence that the dnc was ‘hacked’ is a really BIG development imo…:)

        Remember when it was a good thing that people had as much information as possible before casting votes in an election? However this information got to Wikileaks, they are allowed to publish it as long as they didn’t participate in it being obtained illegally. But the left/deep state has succeeded in criminalizing journalists who do the job the MSM used to do and if they can’t criminalize them, then they de-platform them, censor them, and even cut off their means of financial transactions.

    This is corruption at the highest levels. This means that not only the 12 or so FBI officials already implicated, and the 10 0r so DOJ attorneys were part of the cabal to frame Trump and his campaign staff and family, but likely hundreds of others.
    Clearly Wray, Rosenstein, Sessions, Comey, Lynch and many more, such as Yates, Rice, Powers, Jarret, Rhodes and dozens of others were involved in a coup.

        What if their recommendations involved *preventing access to USB slots without authorization* ? In other words, taking steps to prevent an insider from stealing the info.

        To my mind, that would undercut the theory the Russians did it over the internet, if their preventive measures were about preventing USB downloads.

          Meanwhile, Bill Binney says he has filed an affídavit in Stone’s defense laying out the forensic case against hacking and for an internal download. Ultimately, by affidavit in support of a pretrial motion or live testimony at trial, Binney could finally get his argument into a forum where it won’t be easily brushed aside.

      At this point, I want to hear and see their evidence. I want them to prove what they have based all of this nonsense on. I’m sure they would love to just have the case dismissed right now, because it would save their hide!

      This could be what Barr and Wray are fighting about. This could be the whole enchilada. If we have to admit WE were wrong about Russia?!!! Sad as it is, now it makes us all, as a country, look foolish. This will have to be handled very carefully.

        They asked for this fight and did it so publicly and in concert with CNN with one purpose—to shame and indict Roger Stone in the court of public opinion. IF there is justice, Roger Stone will have sweet revenge. Maybe Stone can close the cells on the lot of them in a ceremony required to be broadcast by CNN and featuring Stone’s tormentors (at least the ones he doesn’t close the cell door on)!

A fool saw right through her bs and Putin toyed with her made her look even more idiotic than she really is.       The Steele Dossier was not the Opposition research stolen in the DNC Data Loss/Data Leakage Incident of 2016 (I’m using this designation for the fake hack now). That opposition research was written on the Word program registered to Warren Flood when he worked at DNC. That Opposition Research was not as potentially damaging as the Steele Dossier, but your usual negative campaigning stuff. It was tame in comparison to what we have lived with for almost three years.

      When the WAPO article was published claiming the Russian hack for the first time, it was claimed by Crowdstrike and DNC executives providing WAPO the information that only that opposition research was stolen. Emails were not stolen. Donor information was not even accessed. The Russians stole the opposition research because sanctions like the Magnitsky Act sanctions made it difficult for the Russians to find out what Trump would be like to deal with as a politician. The hack was a ho-hum affair, almost like a fraternity prank. Nothing like what we have lived with since the story changed in about 24 hours after Guccifer 2.0 appeared.

      Comey started contacting the DNC about Russian hackers in their network in September 2015 or earlier. All they did was have a couple of meetings and make telephone calls. No one went to the DNC HQ with warrants or National Security Letters to force access to the network.

      As to the forensic image of the affected servers and workstations on the network. Investigators perform analysis of a cyber incident by analyzing the forensic images, not accessing the server or workstation itself. The affected computer is the original evidence and must be protected. You use the image (copy) to perform analytical, investigative procedures so that nothing alters the original from the way it was when it entered the evidence pool. For example, the DNC’s Microsoft Exchange (Email) server has to be preserved in the state it was when the incident took place. You image the server onto a flash drive (If it was a virtual server, you can load an entire virtual server onto a flash drive) or portable hard drive. You conduct the investigation on the image.

      The system logs are the most important matter in the entire DNC hack story. The system logs are most important because:

      1. In 2015, when the FBI first claimed there were Russian hackers in the DNC network, DNC IT personnel and cyber consultants like Yared Tamene could not find any evidence of their presence in the network on the system logs. This could mean there were no hackers on the network, or it could mean any hackers who were in the network carefully eliminated the evidence of their activities in the network by deleting or altering the system logs.

      2. The claim in the Mueller Indictment of the 12 Russian names indicates that 2016 hackers rarely, if ever, deleted the system logs. In fact, after the indictment claims the Russians knew Crowdstrike had them under surveillance on the network, the Russians persisted in attempting to erase logs that they had apparently ignored for weeks or months. Since the Russians knew a cybersecurity firm (Crowdstrike by name) was watching them, they had to know their operation was blown, particularly since Shawn Henry was supervising the Incident Response at DNC. This would mean the FBI knew the Russians were in the DNC network. Erasing the logs would be futile at this point.

      3. The system logs can be imaged and taken off the network so that it would not matter if the Russians erased them. The Russians would know that, so continuing to attempt to erase them is just ludicrous in its face.

      If the FBI relied on the Crowdstrike report, the FBI would have to have read the report. We now know they did not. How could they prepare for testimony under oath, such as in Congressional testimony, if they did not read and discuss the Crowdstrike report?

When it was discovered that the wound patterns of the photos did not match the wound patterns on the X-rays, the X-rays became “Best Evidence.” Why? Because they matched the wound patterns for a shot coming from the School Book Depository.

          Now comes Trump-Russia-Assange, and here we go again.

      If you scroll through the 3 page embedded filing, it also says they don’t even have the evidence (proof of hacking) that Stone is requesting.

      Doesn’t no proof of hacking mean they weren’t really hacked?

      I guess that’s why the FBI never asked for it.

        No proof of hacking means we do not know if the servers were hacked (very carefully to not leave clues) or not.

        But it does mean there is *reasonable doubt* that the servers were hacked (the other possibility being it was an “inside job”). If there is reasonable doubt that the Russian’s hacked the server, then there is reasonable doubt that Roger Stone conspired with the Russians, and finally, there can be no “guilty beyond a reasonable doubt” i.e. Stone is innocent.

      Indeed! There is no chain. It was not seized, it was given to them by a private company.
      Without the original it cannot be verified! IMV it is evidence of a conspiracy. Any reasonable judge would throw it out. However, in refusing to provide the original server, and then wiping it, it is evidence of obstruction.

      Server drives are relatively cheap. The only reason to wipe it clean is to hide any evidence on it and to dead end any investigation. In a business like that there would be piles of new unused drives ready to be plugged into the network.

      The whole thing is a lie and not a very convincing one at that. These people need to set in a maximum security prison until their memories clear up a bit.

I’m reminded of Erik von Kuehnelt-Leddihn’s observations about how politically and culturally westernized Russia was prior to the Bolshevik seizure of power (Leftism Revisited) — he was there and he remembered!     This technique of framing a case is called BOOTSTRAPPING. You take an allegation and run it through successive steps wherein the allegation is morphed into a fact. Each time the allegation is relied upon to produce another false conclusion, it looks like an indisputable fact.

    First you have Crowdstrike claiming the Russians hacked the DNC.
    Congressional Testimony on television, plus media reporting, build from that allegation.
    The JAR and the ICA build it up some more.
    Then comes the Special Counsel “investigation” producing indictment of the alleged Russian perpetrators that everyone starts using as evidence when indictments are only the allegations.

    This is the essence of “Bootstrapping.” Each use of the allegation to “prove” something makes the allegation become a kind of AXIOM that is accepted a true without proof, and is now buried under all the government documents, reams of newsprint, hours of televised claims, and digital noise. When pressed, just call any skeptic a “Russian Bot” or “Putin Shill.”

    You have to appreciate the sophomoric level of legal intellect that cites the WaPo in a brief filed in a court of law.

    Of course, the prosecutors argue that the Crowdstrike report isn’t Brady material (exculpatory) because Stone isn’t charged with anything to do with the report. However, a decent lawyer would at least try to make the case that the material is needed to show that the entire case against his client is as phony and manufactured as the Crowdstrike report.

    Good luck to Mr. Stone. With that judge, he’s going to need it.

    From your comment and the June 2016 NY Times article “…gained access to emails, chats and a trove of opposition research against Donald J. Trump, according to the party and a cybersecurity firm.” So in June 2016 the NY Times is saying the DNC had this information. It did not say the “Trump Dossier”. Was this hack the birth of the Trump Dossier and the method used to get it to others for later discovery? Is this the CIA hacking the DNC and then feeding the Dossier to others to purport it coming from Russia or foreign sources? Create the entire narrative but let’s not look closely at the origin? If this was the source data and the FBI never dug into it, there is a reason. They knew what would be found and it implicates the DNC and the Obama government. It never made sense that the FBI did not take the server and investigate the hack. Why would they “ask”? If the FBI cannot use its own forensics, what good are they. If they were not allowed because it blows the story wide open, we see the origin that Barr wants investigated.

    Being a Florida guy I am sure Roger Stone knows there is evidence in this case that relates to his. I know I’ve heard Comey say Crowdstrike verified it was the Russians. That would be a flat out lie.

        Bill, they DID see a report, and a shadow server. So your statement is not accurate. however a shadow server can be altered and, ans the original that alteration not detected. Incredibly it is reported that Crowdstrike did a HRC on the original, like “wiping it with a cloth or something.” So the DOJ got a meaningless shadow server and a redacted preliminary report, and incredibly called it good.
