Whoops, San Jose Democrat Mayor Admits “The Ferguson Effect” is Real…

Folks, we’ve been waiting almost 30 years for a national politician to draw out the inherent hypocrisy of the professional left, and Trump’s candidacy is doing just that.

sam liccardoFor the past ten months the professional left, including all elements of the MSM, have been telling everyone that Donald Trump is opposed by all Hispanics.  Now the same group is saying a Hispanic Judge can be supportive of Donald Trump.

Which is it?

I digress….

Because today it gets even better.

The professional left (including President Obama) have continually said the existence of the “Ferguson Effect”, a principle outlining law enforcement’s reluctance to engage violent offenders based on political correctness, as non-existent.  They say the escalating violence amid inner-cities has nothing to do with police being fearful of carrying out their duty.

However, today Democrat San Jose Mayor Sam Liccardo says this:

[…] One thing is certain, the mayor said: “I can say if there’s a single excessive baton blow on anyone in that crowd, that would have made national news. Our police officers are in a very difficult position, but I think they performed admirably to make sure this violence didn’t become more widespread.” (link)

D’oh.  That’s exactly the argument the FBI and Law Enforcement have been making to describe the “Ferguson Effect“, yet the Democrats say it’s non-existent.

Which is it?

No wonder Mayor Liccardo was quickly dispatched to Washington DC for a debriefing.

    Well Mayor, they are YOUR police. If they are prone to making excessive baton strikes, what does that say about you, the chief, and your officers? If you do not think they are properly trained in use of force, then perhaps you should turn over the San Jose law enforcementl function to the Santa Clara Sheriffs Dept

Conservatives would not waste the time protesting Hillary. We have a life to live. Seeing these people wave their damn Mexican flags in MY country while they burn the US flag just grinds my gut. I will tell you this ,, may God forgive me… Whatever I may have felt for people coming to this country trying to find a better life here is GONE. They live off the taxpayer and they have become parasitic. The US taxpayers have become indentured servants and our money is extracted by force. Here is my solution GET OUT !!!!!! My “give a damn” for these people is busted and beyond all redemption.

        Say How many illegals are in our country? How many patriotic Americans are in our country that support legal immigration? If one were to do the math, I be willing to bet it is a 10 to 1 ratio. So it is not hard to figure out who has the numbers. That being said, would other countries tolerate us Americans illegally immigrating to another country waving our flags and protesting in their streets? Of course this is just hypothetical, but I can’t think of one single country in the world that would tolerate this behavior. So in other words the climate in which this is allowed is a narrative that has been supported by the cultural establishment, media, governors, mayors, etc. You see the problem here? Niki Haley of all people, who BTW in her state recently having voting down sharia law, but 42 democrats in her state voted in favor of it is telling of itself what we true Americans are facing in our country these days. So this grand display of the left is very telling of the polarization our country has become. We allowed it to happen as we were asleep at the wheel, as our apathetic disposition got hoodwinked in allowing and voting for neo-cons such as Haley get elected, and now we are dealing with the consequences. Progressivism is destroying the world like a plague of cancer with no end in sight.

The fact they would even contemplate this is mind boggling. These 42 Dems are beyond stupid….and are in power….we wonder why the country is in such a mess.

Just think what might happen if a throng of say one or two thousand Americans suddenly and quietly gathered in Mexico City in some significant location, unfurled Old Glories along w/ anti Mexican signage in Spanish and marched around. (I know it’s somewhat of a repeat performance).

      • I have to agree with MVW on this. To begin with, no security person at a rally will allow you to carry a baseball bat into the rally. And, if you watch the videos of the violence, this was typical pack animal hunting. They caught people that were by themselves, or in very small groups. Leaving a rally, people should form groups of at least 20, which will deter the pack animals. Carrying a weapon into a mob is just an invitation for them to take the weapon away, and use it on you, and on your family members.

        There are no really good solutions, if people or vehicles are forced to go through where the pack animals are. If you have been at the rally, you won’t have a weapon. If you use your car as a weapon, you will be committing a crime. It really comes down to allowing the police to do their jobs. Which then shines a spotlight on the politicians who control the police. We are watering the Tree of Liberty.

          In my dream of creating order, I see a quiet, calm person with some, er, device in his or her hand and something in her ears.. She detects danger – the pack animals – and without changing her demeanor in any way, an excruciatingly loud noise/shriek emanates from her. Animals disperse. Problem averted.

          For any and all attending a rally: a lot can be done by simply coordinating everyone’s departure — go out as a group, stay in your group, don’t get separated, link arms if you have to, get everyone to their cars…and maybe carry some air horns (don’t be afraid to put it right against the “protestors” ears). If this spitting continues, maybe ponchos and safety glasses (sounds stupid, but you can’t be too sure). And take cameras that shoot videos — get some of the cops too if they aren’t doing their job!
          Anything more than that will be used against you and Trump I’m afraid.

    I feel bad for citizens who want to participate in legal peaceful protests. Their rights are being taken away by the thugs too. I was trying to find out what rights exactly immigrants have in this regard. Read one clause that police could ask for ID’s , but don’t know all the in and outs. Lots of amendments made with the Patriot Act, Dream Act and so forth.
    Would it be too outrageous to define protests as a right to law abiding legal citizens. Could police departments have a designated area for protesters at Mr. Trump’s rallies. So many yards from the venue. Could they then also have protesters show ID to enter that space ? Could the police pre-state that anyone with an outstanding warrant or illegal status , etc could be arrested on the spot? Could they kill two birds with one stone. It may deter the wrong kind of elements from attending. Just trying to find a solution.

The “good guys” and the “bad guys” (if it was ever that clear) have LONG since passed into history. Yeah. Lay them out quickly.

        In February … when the levers of power and the legal and police apparatus are back in American hands.

        Until then, keep your powder dry. It’s exactly a violent pushback that they’re looking for so they can turn the narrative around, paint Trump and supporters as “violent”, and thereby possibly steal the election.

        We need to keep our eyes on the prize and muster the patience required to seize it. Not sabotage ourselves by playing into the enemy’s hands.

        Long view, not immediate gratification.

        There’ll come a time. It’s just not yet.

      Regardless of what any Trump supporter dealt with on the receiving end, the lying media won’t report it truthfully. Mr. Trump understands this. I’m fairly sure most of his rally-goers do also. We’re stronger both in size and fortitude and we know it; Mr. Trump knows it too (did you hear his shout out to that end tonight?)

      Imagine, just for a moment today, a president who has YOU in mind when he makes decisions for America.

      God bless Donald J. Trump.

    Reginald Dennie did not have a suit under CIVIL RIGHTS ACTIONS—42 U.S.C. § 1983

    Democrat San Jose Mayor Sam Liccardo actions in withholding police protection and blaming Trump rally attendees for the violence afterwards was an official ratification of a CIVIL RIGHTS ACTIONS—42 U.S.C. § 1983.

    This is from the Federal 9th Circuit Court web site:
    http://www3.ce9.uscourts.gov/jury-instructions/node/137

    Every person who, under color of any statute, ordinance, regulation, custom, or usage, of any State or Territory or the District of Columbia, subjects, or causes to be subjected, any citizen of the United States or other person within the jurisdiction thereof to the deprivation of any rights, privileges, or immunities secured by the Constitution and laws, shall be liable to the party injured in an action at law, suit in equity, or other proper proceeding for redress, except that in any action brought against a judicial officer for an act or omission taken in such officer’s judicial capacity, injunctive relief shall not be granted unless a declaratory decree was violated or declaratory relief was unavailable. For the purposes of this section, any Act of Congress applicable exclusively to the District of Columbia shall be considered to be a statute of the District of Columbia.

    This chapter is organized to provide separate “elements” instructions for 42 U.S.C. § 1983 claims against individuals (Instructions 9.3–9.4) and against local governing bodies (Instructions 9.5–9.8) because there are different legal standards establishing liability against these two types of defendants. Instructions 9.9–9.29 provide instructions to establish the deprivation of particular constitutional rights. An elements instruction should be used only in conjunction with a “particular rights” instruction appropriate to the facts of the case at hand.

    Mayor Sam Liccardo by opening his mouth as he did ratified the torts committed against Trump rally attendees by forfeiting any 11th Amendment immunity claims.

    See also same 9th Circuit web site — :

    <b.Eleventh Amendment Immunity,/b>

    Despite the language of § 1983, “every person” does not have a universal scope; it does not encompass claims against a state or a state officer because the Eleventh Amendment bars such encroachments on a state’s sovereignty. Doe v. Lawrence Livermore Nat’l Lab., 131 F.3d 836, 839 (9th Cir.1997) (citing Will v. Mich. Dep’t of State Police, 491 U.S. 58, 70 (1989)) (“States or governmental entities that are considered ‘arms of the State’ for Eleventh Amendment purposes are not ‘persons’ under § 1983.”). Nonetheless, a state official sued in his or her official capacity can be a § 1983 person if only injunctive relief is sought:

    As the Supreme Court explained in Will [v. Mich. Dep’t of State Police, 491 U.S. 58 (1989)], “a state official in his or her official capacity, when sued for injunctive relief, would be a person under § 1983 because ‘official-capacity actions for prospective relief are not treated as actions against the State.’”

    Bank of Lake Tahoe v. Bank of America, 318 F.3d 914, 918 (9th Cir.2003). Even if a plaintiff seeks only injunctive relief, a state that has not waived its Eleventh Amendment immunity cannot be sued in its own name under § 1983. Will, 491 U.S. at 64, 71, n.10. But the Eleventh Amendment does not bar suits against state officials in their individual capacities. See Hafer v. Melo, 502 U.S. 21, 26 (1991).

    The Ninth Circuit applies a five-factor test to determine whether a government entity is a state agency for Eleventh Amendment purposes:
    (1) whether a money judgment would be satisfied out of state funds;
    (2) whether the entity performs central governmental functions;
    (3) whether the entity may sue or be sued in its own name;
    (4) whether the entity has the authority to hold property in its own name; and
    (5) whether the entity has the corporate status of a state agency. Beentjes v. Placer Cnty. Air Pollution Control Dist., 397 F.3d 775, 778 (9th Cir.2005) (citations omitted).

    All of the above is why Mayor Sam Liccardo flew to Washington DC to be debriefed by the DoJ after the Mayor ratified the civil rights torts committed at the riots in San Jose.

        A class action suit for injunctive relief under 42 U.S.C. § 1983?

        Absolutely!

        This is not only money for those hurt in the rioting.

        You can also get a settlement that forces San Jose PD plus other elected and appointed San Jose city government officials to attend training in 42 U.S.C. § 1983 requirements annually for years.

        The lawyers who win the law suit will be the over seers of this training and would get a percentage of the annual training costs to administer it.

    So what do we know about the violent black Somali Muslim who carried out the assault on a skinny young white kid at a Trump Rally and then stomped in the roof of a car he does not own?

    “Houdini @sizzle_seyf” Real world name: “Seyfudin Mohamud”. He appears to be Somali, having lived or still lives in Minnesota.

    Screen capture shows “Houdini” saying he was “coming home” to Minnesota over an image of a round trip plane reservation from San Francisco to Minneapolis-St. Paul.

    So, cops and DOJ now have what they need to indict, apprehend, and move to trial this violent Somali Muslim. If he is not a US citizen he should be deported after serving time for assault and damage to the vehicle he jumped up and down on.

    Evidence: http://www.thegatewaypundit.com/…/muslim-nevertrump…/

    San Jose Mayor Sam Liccardo responded to the violence by criticizing Mr. Trump (not the violent criminal protestors). “At some point Donald Trump needs to take responsibility for the irresponsible behavior of his campaign,” he told the Associated Press.

    No Mayor, the violence did not come from Trump nor Trump supporters – it was the thugs YOU encouraged with your words and actions.

    Now, after massive backlash, this idiot Mayor says the city will prosecute the violent thugs assaulting citizens. Well Mayor, here is your first prosecution case right before your eyes.
