BOMBSHELL SMIDGEN ALERT – Dept. of Treasury Blocks Release of IRS to White House Emails Because The Content Would Be Illegal To Share With Court…

Dear Readers, the unknown White House motive for distracting people toward all of this racial/Police anxiety stuff just gained exponential sunlight.


As the Daily Caller partly outlines – Secretary of the Treasury Jacob Lew, Obama’s former White House Chief of Staff, who was chief of staff when the illegal IRS/White House scheme was rolled out, took the emails and documents that were set to be released and now refuses to ever turn them over.

His rationale? Secretary Lew claims he cannot release information about improper disclosures of confidential taxpayer information – because, wait for it,…  that would be an improper disclosure of confidential taxpayer information.

PAUSE AND READ SLOWLY => Inherent in this position is the absolute admission the content of the documents, he is now refusing to turn over, contain illegally shared information from the IRS to the White House.

In order for Secretary Jack Lew to claim the content of the documents contain information illegal to share with the plaintiff he is admitting the content was originally, and similarly, illegal to share with the White House.

The documents were found pursuant to a lawsuit that the legal advocacy firm Cause of Action filed against the Treasury Department’s inspector general.

The lawyer for the inspector general, Gregory M. Miller, told Cause of Action this week in a letter that Lew seized the documents.


“All of the 2,043 pages of documents we have determined to be responsive were collected by the Secretary of the Treasury with respect to the determination of possible liability under Title 26 of the United States Code,” Miller wrote.

These pages consist of return information protected by 26 U.S.C. § 6103 and may not be disclosed absent an express statutory exception. Because no such exception exists here, we are withholding those documents in their entirety under FOIA subsection [b][3] in conjunction with 26 U.S.C. §6103.”

According to the letter, there are “Department of Justice attorneys assigned to this matter.”  (link)


I’ve never been so sure of something I couldn’t fully prove – as I am about the IRS targeting instructions coming from political officials to the Eric Holder DOJ and the IRS. We’ve followed the releases closely, researched and cataloged the information and genuinely believe this one scandal is bigger than all other Obama administration scandals combined.

lois lerner 3The IRS illegally sent taxpayer information via Schedule B’s to the U.S. Department of Justice. The Department of Justice then assembled a “Target List” from the entities contained on the schedule B’s (individuals and organizations).

The groups and individuals on the list then came under scrutiny from every regulatory body in the arsenal of the Federal Government. The IRS, ATF (Alcohol Tobbacco Firearms), EPA (Environmental Protection Agency), OSHA (Occupational Safety and Health Administration), EEOC, Banking and Finance etc., all to attack conservative groups and people with overwhelming and destructive regulation, fines and penalties.

Backstory from previous – (Via Daily Caller) The legal advocacy firm Cause of Action sued the Treasury Department’s inspector general for information about further IRS coordination with the White House. The long-stonewalled lawsuit has finally borne fruit.

“[T]he Treasury Inspector General for Tax Administration (TIGTA) informed Cause of Action that there exist nearly 2,500 potentially responsive documents relating to investigations of improper disclosures of confidential taxpayer information by the IRS to the White House,” Cause of Action stated.

The Department of Justice is trying to delay the release of the documents for another two weeks.

“It needs the additional two weeks to deal with the last 500 pages to determine if they are responsive and make any necessary withholdings. We would therefore like to ask the court to permit the agency to issue a response (including production) on December 1 as to any documents it has completed processing by that date, and do the same as to the remaining documents by December 15,” said DOJ lawyer Yonatan Gelblum in an email to Cause of Action.   3. Holy Toledo! What federal judge will accept this contorted defense from the man who had possession of the illegal IRS disclosures while at the White House? Jack Lew needs to step down or recuse himself. What a bunch of thugs!

    • Most any federal judge appointed in the last 6 years. That would be 8 of them
      Clinton appointed three and Bush appointed three. One District Judgeship is vacant.
      Of the Senior Judges, Democrats Carter and Clinton appointed 4 and GW Bush and Regan appointed 3. Of Appeal Judges, more were appointed by Republicans.
      Not that I think it will ever get that far; I’m not sure this isn’t a whole different fight with Treasury now involved.
      And again, with the DOJ… sheesh.

    Cleaver attorney can destroy a person a business or a country! But this goes even beyond anything that has been done before. I’m beginning to see that there is no way to stop what they are doing! We are going to get either a civil war V2.0 or a military coup deta I would prefer neither but the officer corps of the US are “required” to protect and defend the Constitution of the United States. I was a military officer and I know what the oath means and what the responsibility is — we do not swear an oath to defend the government or the president.

    The entire racial animus narrative was a planned and coordinated strategy to keep people from knowing what’s going on with the IRS scandal.

    I have absolutely no doubt the White House (ValJar, and Denis McDonough) worked diligently to formulate this strategy. No doubt. They planned this to a tee. Telling/using Al Sharpton to “stay the course” was all part and parcel of the scheme.

    This IRS scandal is infinite magnitudes bigger than any scandal that has ever existed in the history of our Republic. And what’s worse, my fear is – they’re going to get away with it and pull it off.

      Someone who’s articulate, someone like Trey Gowdy, needs to go before the microphones and make a huge stink.

      Of course, the media is now indulging in the NYC Choke Hold Case. Just what Obama and troops needed–a good ole Cop v. black victim story that takes place in the media capital of the world.

      So, let a few days pass and a guy like Gowdy with a bunch of other GOP leaders behind him, need to call a press conference in which they call out the lawless POTUS and his AG, and there just HAS to be some time and some place during which a major US newspaper cries, “Enough!”

      The key here is an articulate spokesperson for the GOP and I can really only think of one–GOWDy.

Anytime there is a media frenzy (like Ferguson), it’s time to look elsewhere because, guaranteed, there is something else this administration is trying to hide.     Don’t impeach Zero. Impeach every one of his liars, and make it a spectacle that destroys the credibility of the Democrat party. Make 2014 a practice run for the torpedo at midships that they are going to get in 2016.

    After a quick survey, need to sleep soon, I don’t see why they can’t turn over the president’s REQUESTS for the tax information. AND we all need to contact the two R Texas members of the Joint Committe on Taxation. The guy behind has the list and statutes posted.

    I was audited three years in a row (not last year, but the three before) and didn’t have any obvious red flags. I always wondered if I was on a Libertarian Voting Red list.somewhere. All three years they agreed with my math. My friends all laughed about it, but I always have my stack ready to fax over…

      If you read the statute closely, there are distinctions and specific different requirements between disclosures to Treasury [(h) Disclosure to certain Federal officers and employees for purposes of tax administration, etc. (1) Department of the Treasury], DOJ [(h) (2)] and President [(g) Disclosure to President and certain other persons].

      Here is the interesting part:

      Disclosures of confidential taxpayer information by the IRS to the White House would apparently require compliance with:

      (g) Disclosure to President and certain other persons
      (1) In general
      Upon written request by the President, signed by him personally, the Secretary shall furnish to the President, or to such employee or employees of the White House Office as the President may designate by name in such request, a return or return information with respect to any taxpayer named in such request. Any such request shall state—
      (A) the name and address of the taxpayer whose return or return information is to be disclosed,
      (B) the kind of return or return information which is to be disclosed,
      (C) the taxable period or periods covered by such return or return information, and
      (D) the specific reason why the inspection or disclosure is requested.

        I strongly suspect that the White House arranged to receive the protected tax documents from the Justice Department, rather than the IRS/Treasury, in a scheme to evade 26-USC-6103, under the pretense that they were part of a law enforcement matter somehow giving the WH a pass. The JD had Lois Lerner send them the docs so they could share the with the WH. In his letter, Miller says no express statutory exemption exists to allow disclosure of the protected tax documents. The statute certainly gives the WH no exemption for receiving tax documents indirectly, or for the JD to disclose them.

        26-USC-6103 provides no “law enforcement” exceptions for the President to receive tax return information. It seems designed specifically to restrict White House access to tax return information, and forces the President to be directly accountable for each and every document it requests. The subsection g provisions you noted, plus the requirements to notify the Joint Committee on Taxation (and if I read Cornell’s formatting right, the Sec of Treasury must also notify the individual whose record are being sought within 3 days), provide a web of smoking guns. Either the President followed the law and left his fingerprints all over a clear abuse of power, or failed to follow the law on this, in an even clearer abuse of power. We know that conservative groups and their donors were targeted; none of them have admitted being notified. Whether the Joint Tax Committee received any Presidential notifications must be determined. We need a new Special Prosecutor law, and intense Congressional hearings on what looks like high crimes by the President, not some underlings, documented by a paper trail (or lack thereof) and ample evidence of intent to deceive. This is an existential struggle for Obama (and for political freedom in America).

        Miller’s letter mentions 2,509 total pages of responsive data. He says the 2043 are protected and no exemption exists for disclosure. Note that he omits to justify why the other 466 pages are being withheld. Could some of the 466 pages contain Presidential requests or the required disclosures? I doubt it. My guess is that the law was deliberately subverted via the JD routing. This was all about the “Secret Research Project” after all. Once identified, the taxpayer entities would have standing to sue.

I have to give the communists credit, they came out of college in the 60’s and infected all levels of government. And I think Sharpton needs to pay the four million he owes in back taxes, to be paid by April 15th or off to jail you go. Hillary was screaming for the WikiLeaks guy’s head, until he threatened to release hidden offshore accounts held by Americans. What shut her mouth? I’ll bet the Clintons no longer have a Swiss bank account. There are plenty of legitimate collection tasks for the IRS to take care of, I suggest putting an extremely aggressive and hard charging conservative group in charge of collections at the IRS, leftists owe probably way more than their fair share, most of the money they made comes from the taxpayer anyway. All leeches!

Until or unless WE THE PEOPLE, in regard to the DOI I referred to earlier, take back this REPUBLIC from the usurpers regardless of their party or ideology, all is lost. We MUST realize WHO holds the power, and KNOW that it is WE THE PEOPLE!!! We have been lazy, and have naively entrusted our fortunes and futures to individuals and collectives which have in most cases, ignored US and instead cashed in on THEIR own good fortune by getting elected and the never ending process of holding onto that goldmine of personal wealth building. Now, what shall we do about it?

    So, when can we expect Lew to be subpoenaed by a Congressional Committee and made to publicly admit he is in possession of documents illegally sent from the IRS to the White House? Republican committee members can certainly make statements about what’s going on during a Hearing where they grill Lew.

    I would love to see Elijah Cummings, who very reluctanty admitted that targeting by the IRS was wrong, but passionately denied White House involvement, squirm to refute irrefutable evidence that the DOJ was neck deep in this. The Dems have denied and lied to protect Obama (to their own detriment) and I want Repubs to expose them in the same way they’ve been exposed on Obamacare. Drip, Drip, Drip, until the bucket is overflowing on their heads.

    If the civil rights parody is advanced– likening thugs to martyrs and insisting that police abuse is not a cop and civilian issue but a racial one–the POTUS increases his Teflon armor. Al Sharpton is his right hand man and calls his own tax bill racism. If there were a movement toward impeachment our POTUS would angrily insist he was being targeted because of race.

    He has stacked the dry tinder and is holding his lighter aloft.

    Not to offend the non religious among us, but this is both the season of Hanukkah lights and the birth of the Prince of Peace. I don’t think the timing is accidental at all. God is speaking above the chaos and mayhem. We need to heed His counsel.

    ……the national debt has finally passed 18 trillion. Apparently that doesn’t mean a thing to the Soetoro supporters. They are so twisted they think that they can amortise the national debt overnight. oNly one way you can do that…….formally declare all debts paid, print new FIAT money and start over. While it will be a huge pain,it will be a lot less painful than waiting until the national debt is 50 trillion. The lunatics in the drivers seat will never take their foot off the debt accelerator until they are FORCED TO.
