Michigan attorney Matthew DePerno, on behalf of plaintiff William Bailey, files a motion [pdf available here] with Judge Kevin Eslenheimer for reconsideration of prior rulings given the nature of new evidence discovered by the legal team in Antrim County.
The 42-page brief contains new findings within the data forensics of the county. Two larger items include the remote log-on of the system by someone anonymous who was not at the election office. The implication is that the system was connected to the internet; and the user did not have to enter identifying credentials for their entries.
The second larger item is the identification of modifications, specific irregularities, of the ballots outer markings that led to a rejection of the ballots and the need for adjudication. [Full pdf is here]

A circuit court is limited to making decisions based on current law and prior legal decisions and this judge’s ability to go beyond that is simply impossible. He, his role and the limits of his ability are constrained by his position.
The judge did a really good job of allowing the prior discovery to run all over, way further than most would have allowed. (Which should be a hint on the judges position) Maybe that’s why they are trying to specifically go back to him, simply for more discovery. But in the end his limits will hit the same wall.
When the enviable happens… PLEASE don’t be one of the imbeciles cussing a judge that did history a favor. Learn to read between the lines.

The judge in William Bailey’s lawsuit was clearly prejudiced, so any attempt to breathe new life into that suit will face an uphill battle.
The evidence introduced in this case, even before it was dismissed, clearly shows the votes were manipulated by machine software. To my understanding the Judge dismissed, with the dispositive ruling that relief sought was granted….hopefully, this new Motion with “new” evidence reopens this and the Judge allows further discovery on several more counties, including Wayne county.
