SUPREME COURT – Justice Antonin Scalia on Monday tore into President Barack Obama’s use of recess appointments to staff government agencies when the Senate is unofficially on recess.
During oral arguments, Scalia shot back at an argument by U.S. Solicitor General Donald Verrilli that the Constitution’s recess appointments clause is ambiguous enough to validate Obama’s temporary appointments.
“It’s been assumed to be ambiguous by self-interested presidents,” Scalia said, to “oohs” and laughs in the court room.
Scalia argued emphatically that the text of the Constitution does not permit presidents to appoint individuals to government agencies during pro forma sessions — when the Senate technically gavels in and out to fulfill a constitutional requirement, but does not conduct any business. He suggested the power ought to be restricted to official recesses. (more…)

WASHINGTON DC – Those Democrats who crossed Bill and Hillary Clinton in 2008 must answer for their sins. And the Clinton camp has been keeping a tally.
That’s at least according to a new book by The Hill’s Amie Parnes and Politico’s Jonathan Martin. They’ve co-authored a book together on Hillary Clinton called “HRC: State Secrets and the Rebirth of Hillary Clinton.” And a story cross-published on the websites of both The Hill and Politico has an interesting angle and title: “Hillary’s Hit List.”
After Hillary had officially dropped out of the race in 2008, her campaign still had some work to do — work that involved keeping a detailed record of who had supported, and turned on, the Clintons. (more…)
The stupid is thick with this propaganda spin. Of course most of the enrollees to the ObamaCare exchange would get a subsidy – because ObamaCare itself is more expensive than private plans for people who don’t qualify for subsidy.
The only reason you would use the ObamaCare Exchange is if your income level qualified for subsidy. If your income level exceedes the subsidy limit a person is going to get a better price in a private exchange.

“Disparate Impact” is the actual EEO policy which outlines EEO Law. The policy creates a factual reality that it is unlawful NOT to hire illegal aliens. Employers can be, and are, criminally and civilly liable if they do not hire illegal aliens – I know this from first hand experience.
“Disparate Impact” is also the same federal EEO policy now being extended toward school punishment for anti-social behavior, unlawful conduct, and rule breaking.
WASHINGTON DC – Education experts decried a new memo from the Departments of Justice and Education that instructs public schools throughout the country to cease punishing disruptive students if they fall into certain racial categories, such as black or Hispanic.
The letter, released on Wednesday, states that it is a violation of federal law for schools to punish certain races more than others, even if those punishments stem from completely neutral rules. For example, equal numbers of black students and white students should be punished for tardiness, even if black students are more often tardy than white students.
Here is the relevant section of the letter:
“Schools also violate Federal law when they evenhandedly implement facially neutral policies and practices that, although not adopted with the intent to discriminate, nonetheless have an unjustified effect of discriminating against students on the basis of race.
We knew early last week this was going to be a divisive discussion because the inherent reality is stark and uncomfortable.
From what can be gathered from follow-up media reports the “mother” was 14 when the child was born (she is now 16). The toddler was once injured with shrapnel during a drive by shooting, as the mother was also shot in the stomach. The child’s father was killed by a rival gang at the age of 17.
Child protective services, has been involved on more than one occasion with this family, and as a result of this video, and subsequent investigation, removed four children from the home.
