Judge William Sullivan declared a mistrial after the 12-member jury could not reach a unanimous verdict in the murder trial of Lindsay Clancy.
The defense counsel of Ms Clancy violated every form of judicial ethics in his effort to expose and pressure the one male juror who refused to accept a not guilty verdict and stood his ground. We should not know the identity of the jurors; however, the female foreperson worked with defense lawyer Kevin Reddington to assemble pressure against the juror who would not acquit Clancy.
What took place in this Massachusetts courtroom and jury deliberation undermines the foundation of the system of trial by jury. During actual deliberations defense counsel was openly pressuring Judge Sullivan to remove the juror who would not change his position. A mistrial had to be declared, and Attorney Reddington then went outside and publicly called for retaliation against the male juror who would not accept the position of the female jurors. This is quite remarkable.
Massachusetts – After seven days of deliberation, the judge in Lindsay Clancy’s murder trial declared a mistrial because the jury was unable to reach a unanimous verdict, with one juror refusing to join the eleven others.
Defense attorney Kevin Reddington asked Judge William Sullivan to remove the holdout juror, but Sullivan refused. However, Sullivan granted Reddington an hour to request an emergency stay from a higher court on the mistrial declaration. This would delay the start of a new trial.
Clancy’s case will likely be re-tried with a new jury; until then, she will remain in a psychiatric facility in northeastern Massachusetts. (more)

Not quite, but if a crime requires intentionality of acton then sanity becomes an issue.
Homicide is just causing the death of another human being. Intentionality not needed but guilt and punishment still applies. Recklessly endangering the lives of others would be the weakest charge of all, but it is still culpable.
Only if she killed in “self-defense” would she be excused. But there are still three dead children she admitted killing. She just got off not “intentionally” killing them, so homicides remains chargeable in a later trial. Maybe the prosecution did not present the scale of the alternative charges well enough?

No, they need to prove beyond a reasonable doubt that the defendant is either unable to judge right and wrong OR can judge right and wrong but is compelled (by illness or drugs) to do the act anyway. This is not technically deciding that someone is insane.
In other states, there is a presumption of sanity, and the defense must prove insanity. Apparently not MA.

A 7 week trial would cost me $20K since I own and work my business. That is more than “inconvenience”. Many small business owners are financially punished for serving on a jury. According to my lawyer friends, business owners are rarely chosen.

Why was the defense attorney not held accountable for identifying the juror? Only three men and he identified “he” as the holdout.

After reporting thousands of jury trials, one of the charges to the jury from the judge is as follows: “As jurors, it is your duty to consult with one another and to deliberate with a view to reaching an agreement if you can do so without violence to individual judgment.”
Then the instruction is to decide the case for yourself, listen to what the other jurors have to say… but, “In the course of your deliberations, do not surrender your conviction as to the weight or effect of evidence solely because of the opinion of your fellow jurors or for the mere purpose of returning a verdict.”
This juror stood by what he saw as “his” correct vote. It would have done violence to his own conscience to vote differently.
