Thanks to Anthony Fauci’s insistence that the “Fifth Amendment” prevents him from saying what day it is today . . .
The Constitutional validity of his auto-penned “pardon” (whether or not it had actually been “wet-signed” …) is finally coming into question.
The “pardon” said this: “For any offenses against the United States which he may have committed or taken part in during …”
Whereas Article 2, Section 2, of the US Constitution says this (in part): “and he shall have Power to grant Reprieves and Pardons for Offences against the United States.”
The obvious problem that the two English words, “reprieve” and “pardon,” necessarily refer to punishments. In other words, the President can let you out of jail. But, quite logically, he can only do this after(!) you have been lawfully placed in jail!
The “may have” phrase – autopen-inserted by people who knew damned well that they were guilty as hell – is now the Constitutional issue. This phrase attempts to use the “pardon” power to prevent someone from even being accused and then tried, by pre-emptively declaring the party to be innocent … of “whatever, whenever.”
The US Constitution does not grant, nor contemplate, any such power. And well it shouldn’t. Otherwise, on the first day in office, the President could engage his auto-pen to systematically empty every Federal prison of all its inmates, and(!) to declare that they can now do whatever they want, without fear of ever again being arrested. (In fact, it would now be “a violation of their Constitutional Rights” to ever attempt it – even if you just watched them murder somebody.)
The “reprieve and pardon power” quite clearly does not negate the entirety of “Article 3.”
The President, exercising his prerogative to excuse and commute previous offenses, does not possess the power of preventing accusations and prosecutions of wrongdoing – past, present, or future – from occurring at all.
The Constitution does not grant you a “Get Out Of Justice Free!” card.

Once again, the “Constitutional Question before the SCOTUS” is literally going to pivot around a single English word: “May.”

In due time, the Supreme Court will produce approximately 130 pages of new text. Guess that’ll be about 43 pages per letter. (Plus “a few hundred(?) pages per letter in the media,” announcing the decision.)
“May” is the Subjunctive Mood verb which indicates a likelihood of above 50%.
“Might” is used when the likelihood is less than 50%.
The pardon is therefore invalid: neither “may” nor “might” indicates Reality!
But idiot Communists will scream that the pardons are valid because, because, because they are valid!
From the University of Cornell School of Law Website …. “The word “may” is an expression of possibility, a permissive choice to act or not, and ordinarily implies some degree of discretion. This contrasts with the word “shall,” which is generally used to indicate a mandatory provision. As explained in this case from Texas, the word “may” in a written instrument is generally construed as permissive, but it can be interpreted as mandatory depending on the context in which it is used. Usually, only where it is necessary to give effect to the clear intention of the legislature that it can be construed in a mandatory sense.”
I draw your attention to the last 2-sentences.
There is plenty of wiggle room in the LEGAL PROFESSION’S definition of the term “MAY” for a good lawyer and corrupt courts to declare the term “MAY” used in the auto-pen pardons was used in the “context” demonstrating and defining a mandatory sense.
That means the only way to undo the auto-pen pardons is to prove Joe Biden had no role in issuing the pardon.
