The Constitution does not give the Supreme Court the authority to “redefine natural born citizenship.”
Words have meaning. The Constitution says what it means and means what it says.
Just as America is not an “idea,” the Constitution is not a “living document” for the Supreme Court or anyone else to mold like Play-Dough.
Marco Rubio is perhaps the greatest Secretary of State we have ever had. He is not, however, a natural born United States citizen. Period.
Bruce the question of Natural Born citizen has been argued a couple of times in history. I agree with you it couldn’t be clearer what a NBC is. But I wouldn’t take a bet if it ended up before this SC as to how they would rule.
The Constitution doesn’t define Natural Born Citizen either.

The Supremes just said any child born on US soil is “subject to the jurisdiction thereof;”. As per the code above and the recent ruling any child born on US soil is a citizen at birth.

Have you read the opinion itself? Because the Framers drew heavily from Frenchman Emmerich de Vattel’s excellent book, “Law of Nations”, applying Natural Law (a product of the Enlightenment) on ALL MATTERS OF CITIZENSHIP ….
The Framers were very afraid of foreign influence in the new gov’t, so for the NBC requirement, Vatell favored a 2 US-citizen parent home, so BOTH mother’s & father’s citizenship could be passed to a Prez candidate at birth (not just one parent). This stipulation was to assure that any presidential candidate would as completely American-allegiant as possible. Hence 2 parents for NBC status, and no candidacy without it.
That was NOT the issue under examination in the birthright case recently. It did NOT ADDRESS the unique lineage requirements for presidential candidates. Two entirely separate issues.

The usual analysis of the attitude among the colonial population is that 1/3rd was in favor of Independence, 1/3rd was against it, and the last third did not care one way or the other.
Another example of how a motivated minority can be successful against a majority…in this instance successful for something wonderful!
In other cases (French, Russian, Chinese Revolutions)…one would have wished failure upon the minority (in some cases a very small minority)!
It was extraordinarily fortuious that the Declaration of Independence came before everyone could vote.

Rush used to repeatedly explain that claiming that America was an exceptional country wasn’t arrogance or pride. It was pointing out that until the United States existed no country was ever established with the citizens in charge. The United States has it stated very clearly that the government serves the people and not the other way around. I wish Marco had made that point because it is very important. Of course, if you’re paying close attention, you know that what the country was supposed to be is no longer what it is, sadly.

“America is not an idea, it is a nation of people”. Fundamentally disagree. It is very much founded on an idea. That was the unique characteristic that makes America “exceptional”. As the second great awakening swept across the country in the 1820s, the notion of America as an idea was taken to mean an express gift of God. That’s why men eagerly volunteered in 1861 in defense of the “union” — a pretty abstract idea otherwise.
Europe did move to define a nation in terms of its people. That’s what gave rise to fascism – that man didn’t exist outside the state so the people and state were one (Ein Volk, ein Reich).
As Abraham Lincoln would ask “whether that nation, or any nation so conceived and dedicated, could long endure”.
Don’t forget, among other things the grievances of 1776 included:
“He has endeavoured to prevent the population of these States; for that purpose obstructing the Laws for Naturalization of Foreigners; refusing to pass others to encourage their migrations hither, and raising the conditions of new Appropriations of Lands.”
