So the math is: the core conduct occurred August 2019 through February 2020. Five years from the latest possible overt act lands at February 2025. Trump was inaugurated January 20, 2025 — roughly two weeks before the window closed.
Even in the best case, Trump’s DOJ would have had days to secure indictments on charges that required years of investigation to develop from scratch, investigation that Ratcliffe could have laid the groundwork for starting in May 2020 when the material was sitting in his office.
Unfortunately, Atkinson and Ciaramella will never be prosecuted.

In that case, they can be charged with misprision of felony (18 U.S.C. § 4) — good luck with that. Silence alone is not enough. The classification of the documents afterward is concealment. And the case law on this is clear: concealing a conspiracy whose objective has been attained is not a conspiracy in and of itself and does not prolong the length of the conspiracy for purposes of the statute of limitations.
The courts have drawn this line repeatedly because if concealment counted as furtherance, every conspiracy would have an infinite statute of limitations; you could always argue the cover-up was ongoing.
Now, there is one narrow path where this argument might have legs. If the DOJ could establish that the concealment was not just hiding past crimes but was part of a continuing conspiracy with a broader objective, say, preventing Trump from being reelected in 2020 by suppressing exculpatory evidence, then we have a different conspiracy with a different objective and a different timeline. The overt acts in furtherance of that conspiracy could extend well beyond February 2020.
But proving that requires establishing agreement, intent, and overt acts tied to the broader objective. It is a much harder case to make, and no prosecutor has laid the groundwork for it.

Im not versed on miltary law but Vindman was active service when he coordinated with the IC and Schiff to manufacture a complaint and remove a sitting president. Is he not under DoWar jurisdiction and cannot Hegseth bring him to milirary court?
