The evidence on this issue is overwhelming.
Daniel Richman, working directly on the instructions of James Comey, worked closely with New York Times journalist Mike Schmidt, husband of MSNBC’s Nicole Wallace, to publish material [ex. Exhibit #8]. Richman then coordinated the FBI director’s message with dozens of national journalists, writing the scripts for them to publish on behalf of James Comey [ex Exhibit #9]. Again, the evidence on this collaborative endeavor is overwhelming.
Interestingly, [Govt Exhibit #12] is the criminal complaint stemming from the FBI investigation which began on July 21, 2025. The investigative summary notes the purposeful use of Room #9582 at FBI headquarters, intended to destroy classified evidence concealed in five burn bags.

Toggle On [recording mode] and place in a hotel room / bedroom / conference room / executive office, the day of a rendezvous / meeting, retrieve the disk that evening / as convenient. Counter-espionage would be hard pressed to find this device, after it exhausts its internal battery, the device goes to machine state zero. People may claim to have complex RF sniffer / RF signature capabilities, but that doesn’t work when the device is fully powered down. You would have to be searching the cleaning people and the security guards for the small disk and may have recorded a wav file for review by outsiders. The person retrieving the recording device can tether to their USB-C phone and ingest the .wav files and re-transmit, without the recording device leaving the premises. A game as old as time. But not a good modern implementation.

The document clearly says the burn bags were in a SCIF. Nothing comes out of a SCIF that isn’t under control. I assume it’s easier to leave the burn bags in the SCIF until some future time.
