A three-judge panel for the 9th U.S. Circuit Court of Appeals voted 2-1 to stay a district court order that had prevented the deployment of National Guard troops to the city. The majority opinion found it was likely that the president had lawfully exercised his statutory authority.
(Via Politico) – A federal appeals court panel has backed President Donald Trump’s authority to send National Guard troops into Portland, Oregon, concluding that though the president’s claims on social media “may exaggerate” the violence in the city, he may still have had a valid basis for the deployment.
The 2-1 ruling, endorsed by two Trump appointees to the 9th Circuit Court of Appeals, is the latest win for Trump’s effort to deploy the military into cities across the country over the fierce objections of state and local leaders. Trump has cited violence outside immigration facilities as a basis for the deployments, saying it has impeded his ability to enforce the law, but governors and mayors say there has been minimal unrest and Trump is using largely peaceful protests as a pretext to expand his power. The appeals court ruling is preliminary, and the Lawfare fight is expected to continue. The state of Oregon and city of Portland may seek further review from a larger appeals court panel or appeal directly to the Supreme Court.
A similar Lawfare battle is taking place in Illinois, where a judge has blocked the deployment of National Guard troops. The Trump administration has also appealed that ruling.

Of course the Leftist activists knew it would be overturned, that’s how they had the motion to demand an en banc review already queued up and ready to file. They have all the steps in the process pre-planned with responses pre-scripted.
Their goal is not to win but to delay. They know they cannot win permanently because the law is not on their side. But they know they can delay because their actions are submitted seamlessly – hours from the order for National Guard until the judge issues a TRO, hours from when a 3-judge panel allows mobilization of the NG until the original judge extends her order against actual deployment for the Guard, minutes from when the appeals panel overturns until they file the motion demanding the en banc review. They steal temporary wins with every delay and every news cycle.
The delay for the Left to respond is negligible. Meanwhile they can delay for weeks while the legal processes churn. During all those weeks the administration’s hands remain tied. Justice delayed is justice denied. All that time lost is gone and can never be recovered.

My husband’s employer decided to relocate us here between the two; at his age trying to find another decent job where we were was not going to happen. The educational system here was about 18 months behind where we left (kid was in second grade where we were, completed 6th grade here 2 years 2 months later…). Critical thinking skills are sorely lacking and not prized, “social and emotional” garbage instead.
I was talking with the guy servicing my heater last week (also not from here). We were joking that it is easy to tell who is from elsewhere because when you smile and say “hi” to them they smile back and respond pleasantly, and most (not all) natives ignore you, tell you to shut up, curse at you, or flip you off. Like me, this encourages him to smile and say hello to everyone!

I asked my retired judge neighbor, a political independent, about the efficacy of lawfare against PDJT, and he said the anticipation of the left is not to win most terminal decisions.
Instead, creating Dem talking points and delaying implementation of MAGA inspired actions/policies/laws is the objective.
Moreover, there is a legion of leftist, ideologue federal judges who eagerly provide judicial roadblocks until SCOTUS overturns them.
The rule of law is too often merely a passenger in the justice bus until the end of the line is reached.

This is why I suggested several months ago that the GOP start sending subpoenas to Federal judges. The GOP did a good job during Trump45 with getting good judges on the bench (and fixing the 9th Circus). A good step would be to start hauling them in to testify as part of a broader agenda to use the power of the Legislative Branch to shrink both the total size and jurisdiction of the Federal courts.
Simply remove 30% of the judges by eliminating entire courts. Then, restrict the kinds of rulings they can issue.
9th Circuit is heavily leftist so they may go en banc. But SCOTUS will rule in about 10 minutes to uphold the President on this. The Constitution is clear and there are several precedents for the President sending National Guard to enforce federal law.
These law suites are just a delaying tactic by the Democrats.
The 9th is not reliably leftist any more. In the 80’s-10’s, Democrats could count on them to push a hard Leftist agenda. If there was a bat shit crazy ruling coming, it was coming out of the 9th Circus, as I think El Rushbo called them.
Trump and the GOP gutted it in PDJT45, and it hasn’t been the same. A 2-1 ruling for a Republican would have been unheard of 20 years ago.
Looks like a pretty good beat-down of the district court. First use of a TRO as a way to get around preliminary injunction appeals was given a “sorry, not happening”. Then the idea that a judge could second guess the President as to the degree of unlawfulness required to federally activate the guard was also dismissed.
Guess somebody told them about the US Constitution. There aren’t too many subjects about which the text is perfectly clear, but this IS one of them.
Congress sets the ground rules, but the President has sole command. He can nationalize the militia at his discretion. And, he is REQUIRED to defend against domestic violence.
The role of Governors is also clear, but the Constitution anticipates that they can’t – or, as in this case, that they won’t. The President has no choice.
Simply read this one-page handwritten document. It is quite clear on these points, and it gives the courts no say in the matter at all.

The word, “unconstitutional,” does not appear in the Constitution, nor is it contemplated. Very early on, the Court simply appointed that power unto itself.
