Newly appointed U.S. Attorney Lindsey Halligan, from the Eastern District of Viginia, has released a criminal indictment of former FBI Director James Comey [SEE INDICTMENT HERE].
The indictment alleges three counts. Counts one and two are ‘false statements’ to Congress on September 30, 2020, [18 U.S.C. § 1001(a)(2)], and count three is ‘obstruction of a federal proceeding’ stemming from the same testimony. [18U.S.C. § 1505]
The first false statement charge surrounds Hillary Clinton’s “approval of a plan concerning” Donald Trump and the 2016 U.S. Presidential Election.

♦ COUNT #1 – James Comey claimed he could not remember being made aware of the Trump-Russia collusion plan, and there is ample evidence from his own previous public statements, from public and sworn statements by former CIA Director John Brennan, from former statements by officials in the January 5, 2017, meeting memorialized by Susan Rice, from statements that remain sealed as recounted by former FBI Deputy Director Andrew McCabe, and from statements under oath by the former Clinton campaign team -including campaign manager Robby Mook- that James Comey was well aware of the plan.
While this first count is based on the tenuous “I don’t remember” aspect, this count holds more material benefit than simply Comey’s recollection. This count could open the door to public testimony by McCabe, Rice, Mook, Brennan and even Barack Obama and Hillary Clinton herself as to Comey’s knowledge; each was a first-hand witness.
This first count holds strong material value in a public trial regardless of the outcome. This first count establishes the baseline for USAO Lindsey Halligan to bring all material witnesses into court and publicly put them on record outlining the Trump-Russia collusion scheme.
You could say, I hope the intent is not just to incarcerate Comey per se’ – but rather to use what Comey represents to indict the entire enterprise around him. The facts behind Count #1 make this possible.

♦ Count #2, involves James Comey falsely testifying he did not direct former his FBI Special Government Employee (SGE) Daniel Richman to leak information to New York Times reporter Michael Schmidt.
This second count is easily evidenced through the prior investigation of Office of Inspector General Michael Horowitz and all prior witness statements therein. Again, that includes testimony to Horowitz given by former FBI Deputy Director Andrew McCabe.
Additionally, the second count is evidenced by the direct testimony of Daniel Richman himself, who was hired by James Comey and given special access privileges to classified information systems. Richman was likely a grand jury witness during the assembly of the case against Comey. Count #2 is the easiest to prove beyond any reasonable doubt.
♦ BIG PICTURE – One of the frustrations felt by many people, who have researched or followed the Trump-Russia collusion nonsense, is the lack of accountability for the internal actors who operated within a highly weaponized DOJ and FBI system. Perhaps this indictment is the first step in holding those to account.
I am often asked about why the second term cabinet members of President Trump do not take action. My response is consistent. They refuse to acknowledge or assert the corruption within the institutions they lead. They are fraught with fear.
The administration of President Donald Trump does not have the same institutional operations in place that Joe Biden visibly deployed post January 6, 2021.
President Barack Obama spent eight years working with Attorney General Eric Holder, Attorney General Loretta Lynch, Deputy AG Sally Yates, former FBI Director James Comey, former FBI Deputy Director Andrew McCabe and former FBI Chief Legal Counsel James Baker, on a process of weaponizing the Dept of Justice and FBI.

The effort to hold James Comey to account is highlighting just how corrupt THEIR SYSTEM is. It’ll be hard for the Biden judge to block evidence from Comey’s false testimony to Congress. And the IC reports which very clearly (for DC) says he’s a liar . “lacked candor”. Basically, everything Comey lied about is a matter of public record short of Richman testifying that Comey gave him the notes and told him to leak the notes.
What the judge will mainly try to do is block the sunlight by denying witnesses who either can corroborate the evidence or whose questioning would reveal too much about the attempted coup d’etat.
The other risk is that he just develops a flimsy excuse to toss the case entirely. Comey’s lawyers will certainly file for a dismissal claiming political persecution.
They will do so without a trace of irony. Everyone on our side will scream “hypocrisy!” and demand justice while Comey goes on TV to publicly laugh at us.
I still think the better play here is to use the Federal Grand Jury to compel testimony from Obama/Clinton/McCabe/Yates/etc. And to specifically target Lawfare leadership like Weissman, McCord, and Eisen.

What might be critical in this case? If Comey takes the stand. His arrogance (“How dare you prosecute me? Don’t you know who I am?”) attitude could convict him. Or his whiny “I’m innocent.”

Hmmm…a few months ago I received notice from the Federal Court in Alexandria that I was being considered for future jury duty, but allowed me to decline if I was over 73 years old…which I am. I live about 40 miles from the courthouse and the commute thru DC morning traffic would likely kill me, so to speak. Of course, upon arrival after a 90 minute commute, I would vote the death penalty for jaywalking, so I might not be the best choice for a juror. But now, with Comey on the docket, I kinda wish I’d left my name in the hat. Hope there are some like me closer to the courthouse who can sit thru what will likely be a madhouse.

Simply means the Grand Jury thought there was not enough evidence to convict on that charge.
It is possible to pursue if more evidence is found, but as a general rule, prosecuting attys do not re-file charges once they have been “No billed” by a Grand Jury.
My prediction.

James Comey’s son in law quit his job at the DOJ shortly after this indictment was announced. This is just a few months after James’ daughter also ended her job at DOJ.
If Kash and Bondi knew how corrupt Comey was, why were his relatives working for the DOJ where they may have had opportunities to tamper with evidence? The son in law quits 9 months in. Really? Why wasn’t he sent packing on Day 1?

While I agree with most of the criticism of Bondi at the Treehouse, I do appreciate that she is working with a DOJ that has had Deep State embeds since at least 2008 (maybe earlier, considering the Bushies and Clinton). Rooting them out at the same time as she turns her focus to critical criminal prosecution is a lot to do.

IIRC law professor Richman tried to claim attorney-client privilege in the past, saying that Comey was his client. Privilege does not apply, however, if the attorney is part of the crime. I’d guess Richman might be singing.

It’s wild to me how President Trump just cannot control himself here. He needs to stop himself from providing live play-by-play commentary. His complaints about the “unfairness” of the selection process could help defense lawyers argue the case is not about Comey lying to Congress, but about Trump using the legal system to settle old scores.

Agreed. Don’t ever, ever badmouth a judge in public. No matter how bad (Merchan, F. Emmett Sullivan, Boasberg)…. The worse they are, the more petty and vindictive they are.
We badmouthed a few judges around my old law firm, but would never say anything in a situation in which it might get back to the judge. And there were some pretty bad judges in Philadelphia – mostly state judges (Democratic political machine tools), but there were one or two federal stinkers.
Judges need there asses handled legally.

My father, bless him, was one of God’s worst drivers. His answer to every protest of my mother and me to his tailgating at high speeds was, “What? You think I don’t have control of this car?” as if he thought he had some miraculous reaction time that other mortals lacked if need be, but I guess he also thought his superpower extended to being able to reverse the laws of physics.
The most hair-raising of all those times was when we were in Yosemite National Park, with my father in the driver’s seat, of course, traveling up the road which takes us through the famed Tioga Pass, the summit of which is just shy of 10,000 feet. The road is open only a few months each year. It’s a winding two lanes, and much of the time you ‘ll look down into cavernous plunges of thousands of feet if you so choose to look, but it offers the most beaufiful views of the high country of Yosemite.
I’ve nevered traveled it since so harrowing was that day. In the 60s, there were only a few short metal railings to your right as you climbed. It was expected that if you so chose to travel it, you had been forewarned of its danger. Go slow, watch out for cars around the bend, and keep your eyes on the road.
My father chose to do one his famous bark and point notifications of Nature’s splendor: “LOOK. LOOK!” As he pointed, he turned and looked himself, and as he did so, the Ford Fairlane was yanked to the right. I yelled simultaneously and Dad slammed the brakes. Luckily, traffic was not heavy that day so no car was behind us. Our car’s right front tire had slid off the asphalt and was on the dirt (one could not accurately call it a “shoulder”). We had stopped.
I grabbed the back of the front seat and strained to see out the now-opened window of the front passenger side. Oh, ohhhh, so close to going over. If that tire had gone another 2-3 inches further right, we were, in the parlance of the day, “goners.”
My dad got out and checked, got back into the car, eased the car back onto the road, remained silent for the rest of the journey through the pass, as did all of us, and I wanted to kiss my aunt, his older sister, for reading him the riot act when we finally reached safe environs.
You’d have thought that would have changed him. No, only for a time.
If I hadn’t yelled, we were going to plunge straight down the valley floor.

This proceeding was apparently filed just to prevent the Statute of Limitations from absolving the specific testimony from accountability. The Counts can be amended for more particularity, and other Counts not barred by the Statute of Limitations can later be filed..
