I think the best possible outcome from this is that IF anyone at DOJ finally arrests somebody (a big IF), and IF that person is covered by an autopen pardon that is not backed up by statements directly from Biden’s mouth, then prosecutors have some ammunition to void the pardon.
There are probably some pardons which Biden made public, on camera, remarks about. Autopen or not, that shows intent. Much higher bar to clear (mental fitness) than the wave of Autopen pardons signed but not supported by Joe Biden contemporaneously announcing the pardon specifics publicly.
Anyway, I don’t expect much to come of this beyond some negative press. Maybe we get lucky and DOJ actually arrests someone so that the autopen pardons, the “preemptive” pardons, and the very broad pardons, can be challenged in court.
No more legislation. Even the judges don’t know the laws or don’t care what the law says so how is more law doing anything but wasting paper?
