Yes, the Alien Enemies Act of 1798 is specifically a jurisdiction stripping legislation. SCOTUS has no jurisdictional power to rule on that and beyond that, the lower courts did not exist when this legislation was passed. The legislation which passed creating the lower courts does NOT create new jurisdictions in the process and therefore, neither the SCOTUS nor the lower courts have jurisdiction over removals under the AEA-1789.
So… the Trump administration knows this CLEARLY. I knew this clearly upon researching this at first mention of the AEA-1789. I assumed SCOTUS would recognize this and pretends to not know about it.
Is Trump establishing cause to remove Roberts for bad behavior? When will Trump’s legal representation spring it upon SCOTUS that under the AEA-1789, SCOTUS has no jurisdiction and neither do the lower courts? How will SCOTUS respond when informed? They SHOULD HAVE ALREADY STATED “we have no jurisdiction over this matter under this law” and so far, none have challenged the constitutionality of the AEA-1789. I have to believe this is part of a plan or are otherwise waiting for this to happen.
So as many have already pointed out, the scheme here is to allow a flood of illegals into the country but then delay removal under color of “due process concerns” as the excuse. The Trump administration cited the AEA-1789 as the legislation granting Trump the power perform his actions and the left SHOULD be challenging the law cited but are instead pretending not to know the law by pretending we are not at war (we ARE…. KOREAN WAR) and that we do not have organized foreign forces operating in the USA, enforcing their drug trade, taking over buildings and trafficking humans for various purposes.
Any speculation on why Trump’s team is waiting to challenge SCOTUS jurisdiction to rule on this at all? Could it be to prevent the legislators from thwarting Trump directly by ending AEA-1789?
In my mind jurisdictional power limits are clear on this matter. What trap is Trump avoiding? Or what trap is Trump setting?
I have my answer. Later the same day, a filling with SCOTUS directly challenged Roberts to take appropriate action to stop the illegal judicial interference. This looks more like Trump trapping them with their own illegal judicial activism.
It’s a funny thing about late 18th century law. It’s concise by design. If the language is read in original meaning and context, it’s not hard to interpret. The left tries but it fails. AEA-1789 is incredibly clear on court interference. It just says “nope!”
This legal strategy of the White House is a kind of marriage of the USA PATRIOT Act, with its rapid deportation measures, and the Alien Enemies Act, Section 23, explicit “Regulations of Court Jurisdiction,” or “Judge Guardrails.” Someone anticipated this brand of judicial activism. What is needed is a streamlining of the 18th Century sentence structure into separate paragraphs conveying the same meaning.
If you read Section 23 of the “Alien Enemies Act” you see that the Congress included the jurisdiction of local/district federal judges. The purpose of this was the exact purpose you assigned to the act, to control courts attempting to apply judicial review. All federal judges must conform any decision about any illegal migrant’s status to the four corners of the President’s Proclamation and any accompanying regulations promulgated by the President. The President’s definition of the Alien Enemy is to be the definition applied by the courts. Note the term “conformably” used in Section 23 below:
“After any such proclamation has been made, the several courts of the United States, having criminal jurisdiction, and the several justices and judges of the courts of the United States, are authorized and it shall be their duty, upon complaint against any alien enemy resident and at large within such jurisdiction or district, to the danger of the public peace or safety, and contrary to the tenor or intent of such proclamation, or other regulations which the President may have established, to cause such alien to be duly apprehended and conveyed before such court, judge, or justice; and after a full examination and hearing on such complaint, and sufficient cause appearing, to order such alien to be removed out of the territory of the United States, or to give sureties for his good behavior, or to be otherwise restrained, conformably to the proclamation or regulations established as aforesaid, and to imprison, or otherwise secure such alien, until the order which may be so made shall be performed.”

Habeas corpus is a court action. The root of this is the courts under all law supporting the removal of illegal aliens and removing all temporary measures allowing them to stay (immigration judges setting hearing dates far into the future by use of Mobile phone apps, etc) does not allow judicial jurisdiction over these actions and decisions by the executive.

I asked myself how and where in The Immigration and Naturalization Act that explicitly state the District Federal Judges jurisdiction.
1329. Jurisdiction of district courts The district courts of the United States shall have jurisdiction of all causes, civil and criminal, brought by the United States that arise under the provisions of this subchapter. It shall be the duty of the United States attorney of the proper district to prosecute every such suit when brought by the United States. Notwithstanding any other law, such prosecutions or suits may be instituted at any place in the United States at which the violation may occur or at which the person charged with a violation under section 1325 or 1326 of this title may be apprehended. No suit or proceeding for a violation of any of the provisions of this subchapter shall be settled, compromised, or discontinued without the consent of the court in which it is pending and any such settlement, compromise, or discontinuance shall be entered of record with the reasons therefor. Nothing in this section shall be construed as providing jurisdiction for suits against the United States or its agencies or officers.
So the Statue clearly says the Federal Courts jurisdiction when the Government brings charges but the courts have no jurisdiction for suits against the Government or its agencies or officers. Now I wonder why the lawyers representing the government haven’t pointed this out to Supreme Court Justice Roberts.
