American importers front loaded inventory in February and March with a 50% increase in orders. Now, in addition to those factories going quiet, the de minimis rule kicks in.
(Via CNBC) – Chinese bargain retailer Temu changed its business model in the U.S. as the Trump administration’s new rules on low-value shipments took effect Friday.
In recent days, Temu has abruptly shifted its website and app to only display listings for products shipped from U.S.-based warehouses. Items shipped directly from China, which previously blanketed the site, are now labeled as out of stock.
Temu made a name for itself in the U.S. as a destination for ultra-discounted items shipped direct from China, such as $5 sneakers and $1.50 garlic presses. It’s been able to keep prices low because of the so-called de minimis rule, which has allowed items worth $800 or less to enter the country duty-free since 2016.
The loophole expired Friday at 12:01 a.m. EDT as a result of an executive order signed by President Donald Trump in April. (more)
The de minimis loophole comes from back in the 1930s. The idea back then was, say you went on a vacation to Paris, you shouldn’t have to file customs paperwork or pay taxes if you decided to ship some little Eiffel Tower statues to your friends back home.
Congress in 2015 then raised the de minimis threshold from $200 to $800. However, the e-commerce world exploded, and Chinese companies began using the de minimis loophole to ship cheap goods (ex. Temu and Shein) into the USA direct to consumers without paying any customs duty.
On April 2nd, as part of the global trade reset and tariff structure, President Trump revoked authorization for Chinese goods to transfer to the USA using the de minimis rule. The de minimis exemption was cancelled for all products coming out of China. The rule change only targeted China and Chinese shippers. No one else. [XO HERE]
As part of the modification to Executive Order #14257, President Trump has increased the baseline tariff for product mailed from China [de minimis tariff] from 30 90 percent to 120%.
Mailed products from China now face a 120% tariff. Additionally, minimum tariff amounts increased from $75 to $100 effective May 1st, and from $150 to $2oo effective June 1st. [See Section #4]
Example: If you order a $20 shirt from China effective June 1st, you will pay $220. $20 for the shirt, and $200 minimum tariff.

In my younger days there was a witticism about China, and the magnitude of its population compared to other countries, where if all the adults in China were to jump up in the air at the same time, that upon landing their combined weight hitting the earth all at once would be of sufficient force to knock the earth out of its orbit enough to destroy its ecosystem and all living things.

They just post stuff online, see if they get any orders, then after they get a bunch of orders they figure out how to actually make and ship the stuff. The weeks-long shipping time from China covers for them. It is one reason you see so many low-demand, oddball stuff offered by Chinese companies.
American manufacturers cannot get away with that scam. If they offer something they need to actually be able to deliver. But China pays no attention to complaints about false advertising.

The USPO has been overwhelmed for years with small package shipping. It was never designed to handle this scale of package delivery, at the fixed rates they are required to charge. In turn, they have been forced to beg for more and more money from the federal coffers, while we conservatives ask why they are not self sufficient.
If you think of it, the operating costs of the “de minimus” rule are what has been driving them to the edge of solvency. Yes, they gave away some lush retirement packages, and revenue from physical mail has been slashed by email, but a small number of workers had to take the brunt of early internet shipping, until it all started breaking down and small businesses turned to private delivery. Chinese drop-shippers (import direct to customer) has been out of hand for years, and is the primary fee-based income for Amazon and Walmart’s 3rd party seller platforms.

It was so unfair. The USPS (Postal system) is part of the problem with subsidized China shipping. A China shipper can sell and ship an item the buyer pays less for than it would cost you to ship the same item across your town. Hopefully that ends as well. Ebay type businesses will be booming because of this. They now have the ability to compete with China.

I think this is great and bless our President for being the first CIC in 50 years to tackle this problem. On the other hand, given the economic and political ramifications in China, I hope they do not do something stupid. We know they are eventually going to cave on the tariff issue – it is the unknown about how Xi and the CCP react when 16-60 million of their people are out of work and demanding their bankrupt government take care of them that worries me. We all need to check six, and if you have no prepared for some rough times (just in case) now might be a good time to do so.

I think the De Minimus loophole is the biggest punch in the face to China. Sadly, a good amount of Americans have become addicted to these “5 dollar dress skirts” (bleh) and will need the outside intervention that this proposes.
All the other loopholes should be plugged as well. These countries that serve as proxies for China to push their goods, so that they get another “Made In *****” label. Like Vietnam, Mexico, etc. The relationship that China has with Vietnam is like a love-hate relationship. The Viets only tolerate it to an extent.
Maybe we will go back to teaching our children to sew their own clothing.

Learning to sew (needles are not expensive) is an easy task… I’m male, 89, and sewed patches on my bluejeans, and darned my ‘darn socks’ at an early age… Attitude is the solution to most perceived problems.

I would like to offer this perspective:
The economic situation of many families in this nation is ….maybe dire. A $5 piece of clothing enables parents to clothe growing children or new clothing for themselves while keeping bellies from being empty.
This is going to take time and more people will move to Thrift shops if they aren’t already.
Perhaps Americans will consider donating items unneeded (or actual excess) to these local shops while the rebalancing and restarting of our economic engines begins.
Clothing for ‘practically nothing’ is (I think) available at many of the Food Bank locations.
Much “donating” is, and has been, occurring for ages… if a false sense of pride prevents one from taking advantage of “carefully used” clothing, etc….. then times have been too good for too long here in the great U.S. of A.
I’ve heard about small (1 person) businesses complain about the tariff. Shein and Temu are copyright stealers. And then the product is produced with slave labor cheaply. It’s crap that breaks. When I read from these small businesses whining I have little sympathy.
I know there are other small businesses that actually have production and aren’t importing all this cheap crap where their copyright/intellectual property has been stolen now have a real chance to grow and produce.
Love that PT went after CCP criminals in this way.
These complaining small businesses are not American small businesses. They are Chinese small businesses in America. They invested in wrong country. No sympathy since they are not the first to lose everything in life. It is not end of their world to have to sell house they mortgaged for business and move into cheap aptment and get a job or to for survival.

Your example of a $20 shirt isn’t correct as it’s more like fear porn. The tariff is on the factory invoice price only and not the msrp. The msrp price includes the shipping costs, entry fees, unloading fee’s at the ports unless of course we now have transportation tariffs. So using your example of a $20 shirt has a factory invoice price of $2 + $120% = $4.40. So a msrp priced $20 shirt may increase to $22.40 for a 10% price increase.

Don’t know why people think this will get rid of China goods. Its won’t. It will just make China pay for their shipping in a level way.

Someone is going to have to eat the cost of that tariff: consumer, seller, or manufacturer. NO ONE is going to want to pay it which causes that China-junk pipeline to go out of business. That then enables other countries (with trade deals with the USA) to step in and manufacture the junk or someone in the USA opens a factory in the USA, hires Americans, and uses American made materials. OR, garbage like that stuff stops getting made and Americans learn to live without all of the garbage.
