The professional political left, newest version from the Chicago spawn of Dohrn/Ayers, has been waging full combat Lawfare via a weaponized government for the past 16 years. However, Obama/Plouffe were defeated, “their kind” rose again and won the 2024 U.S. Presidential election.
What we see in this “preemptive pardon” narrative, is a repeat of the victim narrative. This time the White House discussion boils down to ‘Lawfare agents must be protected from any retaliation for their action’. Pardons presumably provide the mechanism to protect the victims. In the big picture of ideology, this is a continuation of the same mindset.
Politico started the narrative with an outline {SEE HERE} saying the White House was having an internal debate as to whether Joe Biden should preemptively issue pardons to members of the J6 committee, members who constructed false impeachment accusations, members within the DOJ who fabricated political cases using the Special Counsel process, or generally people on the political left who supported/facilitated all the aforementioned false attack fronts.
As the narrative is told, all those who supported the attacks against President-Elect Trump and his allies, now need to be protected from “retribution.” Inherent in the argument, and within the use of pardons, is the baseline that some form of illegal activity was taking place. Heck, if it wasn’t unlawful conduct, then no pardon would be needed. This is the political catch-22 created by the preemptive pardon narrative.
Various congressional people, DOJ insiders, White House liaisons, State Dept officials and underling staff are all possible recipients if Joe Biden decides to take this unprecedented approach. However, if you look at the expressed approach indicated by President Trump and the assembly of cabinet members who would be in place to carry out such “retribution,” you will not find any indication of intent. Quite the opposite is true.
President Trump does not appear to be in alignment with any approach that would lead to legal indictments, arrests, charges or other legal accountability measures. Beyond the public release of hidden, perhaps classified information that might put sunlight on the previous activity by those who weaponized their offices, there is nothing. Sunlight on prior events, while moving forward to restore functioning law and order, appears to be the most likely approach.
WASHINGTON DC – […] The White House officials, however, are carefully weighing the extraordinary step of handing out blanket pardons to those who’ve committed no crimes, both because it could suggest impropriety, only fueling Trump’s criticisms, and because those offered preemptive pardons may reject them.

The appointments to White House legal counsel positions and Main Justice legal offices by President Donald Trump all appear to have one common denominator, to protect the President. I strongly doubt there will be any effort beyond that.

The McGinley move makes a lot of sense. DOGE and the Office of Management and Budgets (OMB) are going to be joined at the hip. They are going to have to navigate the Impoundment Control Act, challenging the system that places limits on a president’s ability to unilaterally withhold funding.
Inside that legal battle, deciding what DOGE can do without legislative approval, the OMB is going to be the execution part. McGinley will be the legal liaison focused on what technical approaches DOGE/OMB can execute. In essence, can they stop funding XXXX, thereby eliminating it?

The language President Trump is using to describe the role of David A. Warrington, the switched White House Counsel, is something entirely new.
Donald Trump says: “to serve as Assistant to the President and Counsel to the President. Dave will lead the Office of White House Counsel and serve as the top attorney in the White House.”
Normally the White House Counsel does not represent the interests of the President, the WHC represents the interests of the office.
I would appear to me, at least as I review the details, that President Trump is now fully aware how his Presidential interests can sometimes conflict with the interests of the White House Counsel, and he is making a move to ensure that conflict doesn’t happen.
An example of the conflict I have explained repeatedly in the “declassification of information.”

A parson does not expunge the record. In fact, it doesn’t prevent the individual from being questioned. It only lifts the punishment.
Does a pardon forgive unspecified crimes not yet discovered (e.g. poisoning a city water supply to cause the deaths of thousands). Surely that is not what the pardon power was intended for,. Usually it is applied to convictions where there is a record of a crime.
Seems Congress, in pursuit of legislation to identify and prosecute the selling of influence and hiding the gains from taxation, has a credible claim on all pardoniers to get the facts. Also applies to public officials to conceal or destroy pertinent records.

Seems to me power to pardon is being confused with a power to confer immunity. While the power to pardon is granted the president via Article II. Sec 2 “. . . he shall have Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment.” there is nothing in Article II that grants the President the power to confer blanket immunity.

If there is a broad grant of pardon(s) to people who have not been charged or investigated for any criminal activity, and action is later taken against any of them, the legal issue will be whether the pardon was simply a grant of immunity for past actions; and I suspect that the highest court (because it will get appealed all the way up to the Supreme Court) will rule that a broad grant of immunity is not permissible. If I’m wrong, that might mean that a President can possibly give broad grants of pardons to thousands of people, and that just doesn’t make sense.

A more interesting thing about pardons, is that they apply to criminal acts, NOT civil acts. A lot of justice can be accomplished through the implementation of civil penalties. Ask some of our compatriots who have been targeted.
That and a criminal pardon can be used to compel testimony in a civil matter.
Certainly civil actions may perpetrate vile miscarriages of justice, as we have recently seen. But that’s not new. Check out Civil Asset Forfeiture. No one, regardless of what crime is suspected, should ever be deprived of money or property without due process–being convicted of a crime.

‘Lawfare agents must be protected from any retaliation for their action’.
Odd that they should feel the need for any protection from their actions, righteous as they feel they are. If they truly fear being persecuted by the Big Bad Evil Trump Monster, then they should have no fear if they are truly innocent of any wrongdoings. They should, in fact, be welcoming the threat of any prosecution, as it would afford them the opportunity to prove, out there in the public arena, just how Big and Bad and Evil their supposed Monster Trump really is.
Various congressional people, DOJ insiders, White House liaisons, State Dept officials and underling staff are all possible recipients if Joe Biden decides to take this unprecedented approach.
The end result of a string of preemptive pardons might not make a substantial difference in the world of DC silos and hives, but it could bring solace to at least one person. If he is still of conscious mind, it could help allow Jimmy Carter the opportunity to finally rest in peace, with the comfort of knowing history will have relieved him of that ominous title of worst president we’ve ever known.

This pre-pardon idea could actually be a godsend, as it paints the pardoned as criminals in need of protection. So nobody will even bat an eye when they get re-arrested for new crimes.
I see the SC decision on immunity as the game changer. The Office and the actions of the occupant of The Office can no longer be decoupled. It makes sense that this appointment should protect both Office and occupant as one. The sole constitutional remedy remains impeachment.
…but SCOTUS determined only the PRESIDENT has immunity. He can’t extend that to underlings in his administration.
1) if justice isn’t meted then no lesson learned for the bad guys.

I would think that “Preemptive” pardons would not be within the purview of any president’s power. Issuing blanket pardons for individuals not even charged with anything let alone being tried for some crime would not be within the power pardon. There’s an interesting possibility, try these pardoned individuals. Have them testify, introduce evidence, have witnesses testify against them and then after they’ve been drug through the mud state publicly that they can’t be sentenced because they’ve been pardoned and drop the charges.

And the others with “security” provided by secret service…and others in the company of some very bad Russian drug dealers.. I continue to hold hope that every DOJ and FBI person associated with Jan 6 prosecutions is removed from the govt, even if this outcome is unlikely. To me, this institution is failed, and removing these people is the minimum acknowledgement needed to restore the dignity of those jailed for non-lethal, incited acts of violence and very ordinary acts of civil disobedience.
