IMO, Judge Cannon is going to throw out the Documents case based on the appointment of both a Special Counsel’s office and Smith as being an unconstitutional abuse of Executive (The President) authority.
Article II, § 2, cl. 2, of the Constitution provides as follows: “[The President] shall nominate, and by and with the Advice and Consent of the the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments.”
The Special Counsel is an Officer of the United States and not an inferior Officer, so since there was no nomination by the President and subsequent Advice and Consent of the Senate, both the appointment of the Special Counsel’s office and Smith are unconstitutional.
Cannon will incorporate much of what was in Scalia’s dissent in her ruling. Then it would be off to the 11th Circuit since Smith would appeal. They would probably uphold, and then Smith will appeal to the SCOTUS. By the time a final ruling would come down, President Trump will have been long into his term.

Democrat Party in Nevada is suing to keep the Green Party candidate Jill Stein off of the November General Election ballot; guess this is how the Democrat party plans to pull what Macron pulled in France – keep all opposition that might distract getting votes for the democrat candidate off the November ballot so that there will be no other candidates to cut into FJB’s vote totals, so it will look like a huge loss for the Republicans.
