It seems to me that is the case here. The FEC said there was no Federal Election Crime committed by President Trump. Now we find out in the prosecution’s closing arguments that was the underlying crime.
The defense didn’t even know what the final charge was until closing arguments. They learn after they rested that it was a Federal Election crime. Alvin Bragg didn’t have the jurisdiction to even bring that charge. They just kept saying he was trying to conceal another crime…

This is an interesting statement that I keep hearing, though the Constitution does not say that at all in the Pardon Clause. We did not have the existing state/federal court hierarchy when the Constitution was written: the Constitution only says “crimes against the United States”. If the founders wanted to leave it open to states to persecute the political opposition with no hope for Pardon, they would have explicitly allowed for it. They didn’t, so this whole “you can’t pardon for state crimes” seems like liberal spin to me… SCOTUS needs to be challenged on this on strict Constitutional grounds.

I think Trump will get the Supreme Court to intervene and review this trial. Roberts is compromised, so we have no idea where he stands, but the other five Constitutionalist Justices can override him, should he balk at reviewing this sham trial. We should all give as we can to the Trump Campaign, but we have to let the Supreme Court work as the founders intended them to.
In cases that have violated the defendant’s rights to a speedy and fair trial and a jury of his peers in an unbiased venue, SCOTUS has been and should be called upon. If they won’t do that, they will all be losing the Country they were appointed to protect in matters of legality.
We will have to let this play out at the SCOTUS level. I think it will and I will pray for God to save our Republic from this tyranny. The USA has come back from the brink of disaster before.
