People have asked me why I have remained relatively quiet about the legal issue and targeting of Peter Navarro by a weaponized DOJ and Congress. I will explain in greater detail after the news from today.
Peter Navarro was a former adviser to President Trump and the lead of the coronavirus task force. Yesterday, Chief Justice John Roberts issued a short opinion rejecting Navarro’s effort to have the Supreme Court intervene and stay his sentence.
Mr. Navarro was charged with contempt of Congress, and was prosecuted by the DOJ and convicted in September of two counts of contempt of Congress for refusing to provide testimony and documents to the J6 House Select Committee investigating the protest at the U.S. Capitol. [Note, most of you know I received a similar subpoena from them, so I have a slightly different perspective than most.]
[…] Navarro spoke Tuesday morning in a strip mall in West Miami near the prison where he will serve four months. “I will walk proudly in there to do my time,” Navarro said. “I will gather strength from this: Donald John Trump is the nominee.” Navarro called the case an “unprecedented assault on the constitutional separation of powers.” (media story) WATCH:

I have a great deal of sympathy for Navarro. I firmly believe he was unfairly targeted by the J6 committee and a weaponized DOJ who were looking for any opportunity to target people in Donald Trump’s orbit – including Navarro and Steve Bannon. I regard Navarro as a really awesome ally, and functionally very smart and apt at the responsibilities he held in the White House. Navarro is a good man.
Navarro was charged with failure to provide testimony and documents to Congress. Navarro argued that executive privilege covered his refusal to provide testimony and documents.
The executive privilege that covers private conversation is held by President Trump and cannot be, should not be, waived by any advisor to the president. However, there is a key element in the executive privilege aspect that is mostly overlooked by righteous pundits and conservative analysts as it pertains specifically to Navarro.
Notice how there has been no report of Peter Navarro asking President Trump or his legal counselors if they would agree to waive privilege in regard to his conversations and communication with the office of the president. Apparently, Navarro never asked POTUS or the legal team if compliance with the subpoena was diligent from the perspective of the executive. The absence of this approach is key and is part of my angst with the Navarro targeting.
Navarro never held any information, content, communication with, or conversation with President Trump that represented a threat to the president. There simply wasn’t any conversation that would put the office of the presidency at risk, nor Donald Trump himself, if he gave testimony about conversation, while being represented by his lawyers and the legal representative of President Trump’s stood by to monitor the testimony and guard the executive privilege.
Secondly, the documents could be -and likely were- obtained by the J6 committee through electronic retrieval on their own. On the document issue, it’s almost certain the committee issued subpoenas to email providers, cell phone providers, etc. and had the documentary information anyway. The J6 lawyers would be looking for Navarro to filter, delete, hide or ¹change a document…. not as much the content therein. The legal risk within documents, assuming that Navarro never advocated for anything illegal, is simply a risk from non-production. That’s it. [SEE, Trump #1 RULE: If you don’t want documents used against you, don’t create them.]

Again, the J6 people can -I would guarantee did- retrieve every document they wanted; the non-production by the target is a silly hill to die on. The truth has no agenda, nor can the truth be a weapon, if the truth of the documents did not present a legal threat by themselves. Considering that Navarro is *not* the principal holder of the privilege, this non-production is like shooting yourself in the foot.
Had Navarro simply asked the White House and President Trump legal counsel about whether he should comply or not, and then put the burden of executive privilege on them, it would be the White House and the full weight of the Office of the Presidency defending Navarro from testimony and representing Trump’s legal interests.
I hope people can grasp what I am saying.
Ask the principal, that’s Donald Trump, if he wants to apply executive privilege. If he does not, then give honest testimony about facts, conversations and events that present no legal threat to the principal. The only reason to avoid this simple process is – I believe in this instance – the pride, ego and a willingness to enter into a fight where all the power is aligned against you.
I understand why being targeted by a weaponized government makes a person feel intensely angered and would trigger the fight instinct. However, prudence, calm thoughts and reasonable intelligent thinking can ensure that BRUTAL HONESTY, which is to say carefully applied and strategic “extreme compliance,” is the best weapon against the bastards.
Peter Navarro is a good man, a very good man, who unfortunately made some strategic legal mistakes. I have a great deal of sympathy for Peter Navarro and feel he has been very unjustly targeted.

Regarding issues of PRIVILEGE the federal courts have systematically destroyed the concept of executive privilege for the President of the United States. Time and time again federal judges have found “end runs” around the privileges enjoyed by the President. On the other hand, you can be certain that the same federal courts will defend and preserve the legal rights and privileges of:
A: Federal Judges
B: Prosecutors
C: DOJ Officials
D: FBI Agents
C: FBI Officials
D: Congressmen
E: Senators
G: State Attorney Generals
When any of the above officers and officials violate the Constitutional Rights of Americans via clearly sponsoring illegal legislation, unjustifiable court decisions, wrongful arrests, illegal targeting of citizens etc, no matter how agregeious they are protected by privilege from lawsuit but the President of the United States isn’t!

Navarro was a brilliant trade negotiator. It seems what he is doing is anything but being a hothead. His track record is playing the long game well. Maybe even a longer game than Sundance is looking at?

I put this case in the same category as Mike Flynn, when he agreed to meet with the FBI without an attorney present. Even someone like me, a lowly pedestrian understands that anything I say can and will be used against me.
In his defense, Mike Flynn said he was not told it was a formal FBI interview and was led to believe they had stopped by for a friendly chat.
We can roll our eyes and call that naive –but Flynn was one of the first dominoes to fall at the sword of the weaponized government. We didn’t yet know about the full weaponization being organized against the Trump administration.

Flynn was the National Security Director of the US. He was interviewed by the head of counter-intelligence for the FBI, Peter Strzok. Both participants have in their job description, “Hey, try not to let an American City go up in a giant mushroom cloud”. He had no reason to suspect that Strzok was investigating him under the 220 year old Logan act as a predicate.

It was a Republican (Trump appointed) federal judge in Washington DC who sentenced Mr Navarro to prison. We remember that Judge Boasberg gave the FBI Attorney who falsified the search warrant application (a felony) probation and no prison time.
I see no reason why Navarro wasn’t given three months probation for what’s basically a misdemeanor contempt charge. Republican appointed judges are simply cowards!
Obviously most republican judges are keeping their heads down so hopefully they won’t be noticed. If any of them had a spine, they would be calling out this carp that is going on with PDJT and people who worked for him.

But, in the absence of a direct assertion of executive priviledge by former President Trump, a far better use of Peter Navarro’s time and energy would have been to appear before the J6 committee investigators and to keep a record of what it was he said for later use in the predictable event that the J6 staff would delete every bit of testimony contrary to their version of January 6th.
If Peter Navarro had done it this way, he himself would have had the last word on what happened on January 6th once his testimony had been deleted. More than that, he could be spending the spring of 2024 working on the Trump 47 personnel recruiting effort, rather than rotting in jail for no good purpose.

Here’s Peter Navarro’s interview with Don Jr. from last night.
At the 23:00 mark of this clip, Peter mentions how after getting called to testify he called President Trump and asked how he wanted Peter to proceed. He said President Trump still claimed Executive Privilege so Peter couldn’t testify. Doing so would have been a violation of his oath.
Looks like the J6 committee has some splainin’ to do. It certainly is a Constitutional head to head. He is saying his testifying is a violation of the Constitution. The J6 committee is putting him in jail for his failure to violate his oath to the Constitution.

Oh, so he’s going to jail not because the President didn’t claim Executive Privilege but because Peter did not get that in writing.
Sounds like he’s going to jail because he did not call dibs. If he called dibs, then he wouldn’t be going to jail. But he didn’t call dibs so off to jail he goes.
It’s not Peter Navarro’s Executive Privilege. Its the President’s. The decision to testify does not lay with Peter Navarro. It lies with President Trump.
It’s not Peter’s place to prove Executive Privilege.
He mentions later in the interview that the Jan 6th committee should have reached out to the President and asked him to waive Executive Privilege in order for Peter to testify but they didn’t.
It would appear that if a letter was needed, the letter would have been for the President consenting to waive his Executive Privilege, not a letter indicating he is claiming Executive Privilege.
If SCOTUS decided to let this be decided based on the major appeal, not this emergency one, then I’d expect a quick turn around there.
Otherwise they are allowing an injured party to rot in jail unnecessarily while they deliberate.

Depends on who the enforcers favor. They are the most exigent disease threat, individually and collectively. It’s nothing new. We can examine Germany a century ago for similarities in how the laws and enforcement were warped to serve ideology. There’s also plenty of other historical examples.
Watch who they take a knee to and who they put in jail. Reality.

If “teammate” is literal, as in the “thin blue line”, yes, that makes sense. I fully expect enforcers to follow their unified chain of command regardless of reality, equity or the law. They’ve already proven that up in history. It’s unremarkable to me.
If “teammate” is figurative, then we’ve seen examples of that with the Communist mercenaries, where enforcers are attacked and their chain of command orders them to literally take a knee. We’ve seen the pictures and video.
We’ve also seen them ordered to stand by when mercs are attacking citizens and patriots.
The bottom line is history has shown them, uniformly throughout the ranks of uniformed enforcers at all levels, to follow their unified chain of command. If that command wants you, or I, or Pete Navarro gone, they’ll carry out those orders. Expect it.

Peter did what I would have done. Congress has been way out of control for a long time. They had no right to attack those of January 6 unless they had proof that they were there to break the law. Instead of looking at what took place, they made it what they wanted it to be. I would not have complied. As for the government looking at our ever word and deed then do so. Maybe I am not fully understanding Sundance’s point but there were 2 points Navarro put front and center. First it was the fact that He considered the J6 committee illegitimate. No house rules were followed when setting up this committee. Navarro therefore felt he should not add credence to such. Second ….that if he hadn’t followed the general precedence of Executive Privilege he would be opening a door for the dems to abuse “Privilege” in the future.
I also think if he had testified before the committee they would have found a way to twist things (set up)….if he got one fact wrong …then it would have been “lied before Congress” and possible gotten a much harsher prison term. J6 prisoners come to mind.
That’s what I was thinking, too, regarding if he testified, they would determine he lied about something.
I find no fault with Peter. I respect him. I think he did nothing wrong…and certainly does not need to go to a fed prison over a misdemeanor.
I read both parts you provided. I understand what you are saying. I think regular Americans need to stop boasting about their possessions and mouth off idly about how to handle things. For me, it is a time to prepare, watch, listen, be smart, be wise, and keep your plans close…stop telling them every move you plan to make. That is just me. I am a contrarian by nature. I do not trust everyone, all the time…and that includes some members of my family.

I have little doubt that prayer played a role in his surviving the war. Faith is important.

After the revelations of the J6 committee no one should be in jail or, at the very least, they should all have their sentences reduced or overturned. Instead, she gets to keep her job and continue to steal from hard-working taxpayers. My consolation is that God will sort her out.

Ironically, regarding choices, its director is still vertical, breathing and will be 91 this year and still a fugitive of the U.S. justice system, a system that hasn’t had my faith and confidence for quite some time so old cases like his are open to re-examination. BTW, his mother was murdered in Auschwitz, he maintained.
Future historians may examine Navarro’s choices, and the results, through a lens markedly different from those we use today. Such are the vagaries of time and life.
