In the ridiculous federal election interference case in D.C., President Trump’s attorneys argued to the DC Circuit appellate court that President Trump holds inherent constitutional immunity. In essence, because President Trump was acquitted by the Senate of claims he incited or instigated the January 6, 2021, events, lawyers arguing under the constitution that only impeached and removed presidents can be criminally prosecuted.
The initial 3-judge panel of the court has taken up the appeal, and all subsequent lower court activity was suspended until the constitutional issue is resolved. Again, if President Trump does not have immunity, then all preceding and future presidents can be criminally prosecuted for any/all events and decisions while holding office. This is a core issue, and the DC Circuit Court of Appeals has to tread very carefully with these ramifications at the forefront.
The decision of the 3-judge panel could also be followed by a full en-banc review by all judges in the circuit. Then, depending on their decision, it could -likely will- go even higher to the U.S. Supreme Court. All of this takes time, and the initial 3-judge appeals court have not provided any hints on their timeline.
Apparently, as a consequence, the entire trial of the case has been removed from the lower DC court docket. The removal took place within the last few days, and the Washington Post noticed the removal. This removal means the timing of the case, if at all, is completely unknown now.
WASHINGTON – Former president Donald Trump’s March 4 trial date on charges of plotting to overturn the results of the 2020 election has been dropped from the public calendar of the federal court in Washington, a sign of what has long been anticipated — that his claim of presidential immunity from criminal prosecution would delay his trial while it remains on appeal.
The change did not appear on the official criminal case docket before U.S. District Judge Tanya S. Chutkan, who has made clear since Trump filed his appeal on Dec. 7 that all trial deadlines would be suspended while he challenges the case. On appeal, Trump is arguing that the government does not have authority under the Constitution to bring charges against him for actions he took while president after the 2020 election through the Jan. 6, 2021. These are all issues that surface when Lawfare, the application of twisted legal theory intended to manipulate public opinion, runs into the reality of ever-increasing scrutiny from courts.
Combine these fraudulent legal theories with the reality that President Trump’s status is almost certainly “presumptive presidential nominee” in the eyes of the entire judicial branch, and things change. The pretending justification for the Lawfare claims now hit the non-pretending and visible reality of political intent.
The judicial scrutiny gets even more focused, and the explanations demanded as justifications to target President Trump increase. As the calendar of the November election gets closer Jack, Mary and Andrew will have to rely on ideologically aligned black robes to maintain their Lawfare pretense. The courts will punt this till after the election in which case it will either be moot or Trump will go to jail.
First off, jail is typically where defendants go while the courts decide their fate, PRISON is where they serve their time.

The 9th Circuit just unanimously ruled that the FBI raid of a safe deposit box company in CA was completely unconstitutional.
The FBI raided the place LOOKING for crimes they could charge people with.

There’s more to the CA case, but the FBI did their usual trick of pretending there was a crime as an excuse to raid a place so they could look for a crime. Then they refused to return what they stole or even provide an inventory.
If I was advising Jack, Mary, and Andrew, I would strongly advise them to get out of the country when Trump wins. They are not going to withstand the sunlight that is going to be shining on them.

President Trump has to fire all of the FBI and DOJ leadership down to local levels not just Washington DC staff. Remember, FBI Agents and DOJ Prosecutors are not covered by civil service or union contracts. They are essentially appointed positions!
GS13 and higher federal agents, like FBI agents, cannot be union members or part of a bargaining unit, but they are still civil service employees. Sometimes referred to as career employees. They’re entitled to standard workplace protections, MSPB, et al. They are typically members of FLEO or “associations” that hire lawyers to represent them against adverse actions. They can’t just be fired without cause and due process, even by the President. Only political appointees can be fired without cause.
That must have changed because not too many years ago they not considered civil service employees. They couldn’t easily transfer to Customs or Secret Service because they were considered appointees.
This is a HUGE loss for Trump and MAGA.

The drone killing of that particular American citizen isn’t a useful example for this situation because the citizen who was killed was actively engaged with other terrorists in armed combat against America and Americans. PDJT would have done the same thing had he been president at the time. And the courts would have upheld his authority as president to do it.

Hence, a case can be made that the drone strike was illegal, and murder with no trial, of two american citisens.
The argument is that there is NO Immunity…so what makes it ok? There was not declared war. The citizen was denied all of his rights to constitutional rights, there was not grand jury, the right to counsel, a right to trial and a jury of peers just to name a few… dont think the drone as broadcasting Miranda rights as it blew up him and his family.

I think it was legal for Obama to use drones on US citizens. Starting in 2010, John Brennan played a key role in the evolution of targeted killing for the Obama administration, called Disposition Matrix, that included US citizens.

I don’t agree. I’ve been calling it Operation: Decapitation for many years. You basically fire every single political appointee in Government. Then, you write a new executive order (Trump had this in place in his first term) which makes another wide swath of government employees “at will” employment. About 10% of the SES is put in place via political appointment. They can be fired immediately, too. All the US Attorneys can be fired.
Then you start doing an inventory of the embeds – who are the political appointees who were slotted into regular SES positions. Those are the next group. Fire as many as you can. Use revocation of security clearances to neutralize many others. The idea is that you get as many as you can as quickly as you can. Then you put people in those departments whose primary job is actually to go deeper and root out even more.
In the military, you just have the Defense Secretary do a review of all the War College papers. Anybody writing about DIE topics retires. They will not be considered for promotion. In fact, you look back at the Obama years and see who Obama promoted as he was firing generals. And you get rid of anybody who is left by pushing them into retirement. Then you elevate MAGA officers. You order a removal of all DIE content from military training and just sit back and watch who fights you. Those people are pushed out.
