Rudy Giuliani brought up some good points that were surreptitiously also noted by Victor Davis Hanson. As Giuliani noted in an interview with Newsmax, the core elements of the E Jean Carroll claims never made any sense.
Specifically, Carroll couldn’t even put a date or YEAR on her claims against Donald Trump, but that really didn’t matter in a civil case where the New York state legislature literally wrote a new law that permitted the lawsuit against Donald Trump. WATCH:

It was never clear what were the preliminaries that supposedly (Trump denies meeting her) led both, allegedly, willingly to retreat together to a department store dressing room, where during normal business hours the alleged violence took place.
Moreover, the sexual assault complaint came forward decades post facto—and only after Trump was running for and then president.
Carroll eventually sued him for battery, but well after the statute of limitations had expired and thus the case seemed defunct.
Her claims of defamation injuries arise from being fired from her advice column job at ELLE magazine.
She claimed that Trump’s sharp denials and ad hominem retorts led to her career ruin. But the loss for anyone of a column at 76 does not seem such a rare occurrence, and the absence of a salaried job in one’s late seventies for four years does not seem to equate to a $83 million hit.
And note the allegation that her dispute with Trump led to her firing was strongly denied by the very magazine that cut her loose.
But then another strange thing happened. In 2022, a new law (“The Adult Survivors Act”) was passed in the New York legislature. It also post facto established a twelve-month window (beginning six months from the signing of bill) that permitted survivors of long ago alleged sexual assaults suddenly to sue the accused long-ago perpetrator—regardless of the previous statute of limitations.
That unexpected opening suddenly gave Carroll’s prior unsuccessful efforts a rebirth. And she quickly refiled with the help of arch-Trump hating billionaire Hoffman.
Yet the bill may have been introduced with Trump particularly in mind—given the legislator who introduced it, Brad Hoylman-Siga, was known as another Trump antagonist.
More interestingly, he had earlier introduced and had passed another Trump-targeted bill. That “TRUST” act had empowered particular federal Congressional committees to have access to the New York State once sealed tax returns of high-ranking government officials—such as Trump.
That bill’s generally agreed subtext was a green light for anti-Trump members of Congress to obtain legal access to Donald J. Trump’s tax returns.
So there is an eerie feeling that the New York legislature may have abruptly passed legislation that was aimed at the past conduct of Donald Trump but only after he entered the political arena.
While these are not quite bills of attainder, there is something unsettling if they are post facto laws aimed at targeting the most famous and controversial man in America and the leading candidate for the presidency.
In essence they were targeted statutes designed to make Trump’s prior legally unactionable behavior suddenly quite legally actionable.
Trump will be subject to such special treatment all summer and fall.
Prosecutors Bragg, James, Smith, and Willis will synchronize their court business for maximum effect.
Trump again will face leftwing prosecutors, judges, and juries on charges that are politically driven, involving alleged behavior that is either usually not criminalized or not to the same degree as Trump’s case. (Do we remember the nearly $375,000 federal fine belatedly leveled at an exempt Obama but only five years after his 2008 illegal garnering of, and not reporting, foreign campaign contributions?)
The stakes are higher each day as Trump closes in on the nomination and thus becomes the hope of half the country to end the Biden madness.
Somehow Trump will have to stay calm, give no opening to his legion of hostile prosecutors, while conducting a nonstop campaign against Biden (and for a while Hayley), and while fighting to keep his name on various state ballots.
So what we are witnessing is not even the extralegal efforts of Steele/Fusion GPS, Perkins Coie/DNC/Hillary Clinton in 2016, or the 2020 “Russian disinformation” ruse/change the voting laws/infuse half a billion dollars to absorb the work of the registrar machinations against Trump.
We are way beyond all that. The legal system itself, hand-in-glove with leftwing politicos (compare campaign boasts of James and Willis, or prosecutorial visits to the January 6 committee and the White House) is turning the process of balloting and elections into an embarrassing farce.

It’s really a denial of due process because statutes of limitations are not meant to be general grants of amnesty, but rather they are meant to buttress and protect due process rights.
It’s simply a fact that the accused cannot always gain access to witnesses and or documents long after the events have occurred, nor can witnesses always remember certain events as well, or have in their possession items of evidence they once had.

I don’t know what the remedy will be, once the USSC overturns these judgments, but I’d have to think that the state of NY will be on the hook for Trump’s legal fees, at the least.

On the Denial of Reality
There are many taboo topics like

Russia’s best know epigrammatic fabulist, Ivan Krylov, and one of the greatest novelist, the Russian Fjodor Dostoyevsky, wrote about it. The former in “The Inquisitive Man”, where he went to a museum and notices all sorts of tiny things there but missed an elephant. The latter compared Vissarion Belinsky (Russian literary critic of Westernizing tendency in “Demon” to the museumgoer.
When publishers hire interpreters to translate literary works, even they rely on people with multiple talents, the outcome doesn’t satisfy every reader. Take Rainer Maria Rilke’s, Austrian’s expressive poet and a very significant contribute to German literature, poem “Das Karussell” (The Carousel/The Merry-Go-Round) is an extraordinary work of art that any attempt at translation is bound to suffer. The translator must make painful choices about what to sacrifice. Look at one repeated simple line “Und dann und wann ein weiβer Elefant” that so easily shatters in English: “And now and then a white elephant” or “And now and then an elephant that is white”?
Same goes for the Court Room (where neither Judith Sheindlin is the judge nor the playground of TV opinion shows): The defendant need an attorney who speaks the language of the judge AND is at least so captivated by one juror (like” Juror 8 “played by Henry Fonda in “12 Angry Men”) that create reasonable doubts by other jurors if plaintiffs accusations are plausible. On paper, an alleged rape case 25 years ago, which is said to have occurred in a Bergdorf Go0dman’s dressing room opposite Trump Tower, is hard to win. Especially when the eloquent defendant who is known for being able to convince ordinary people of his views. Why didn’t he forcefully argue IN court room about all of plaintiff’s inconsistencies and motives others talk outside the court room?
However, last year, a jury in a biased NYC court room found a verdict and here is a small part of Judge Kaplan’s 59 pages “Conclusion of Memorandum Opinion” from 7/19/23: [1]
“The finding that Ms. Carroll failed to prove that she was “raped” within the meaning of the New York Penal Law does not mean that she failed to prove that Mr. Trump “raped” her as many people commonly understand the word “rape.” Indeed, as the evidence at trial recounted below makes clear, the jury found that Mr. Trump in fact did exactly that. […] This jury did not award Ms. Carroll more than $2 million for groping her breasts through her clothing, wrongful as that might have been. There was no evidence at all of such behavior. Instead, the proof convincingly established, and the jury implicitly found, that Mr. Trump deliberately and forcibly penetrated Ms. Carroll’s vagina with his fingers, causing immediate pain and long lasting emotional and psychological harm. […] There is no basis for disturbing the jury’s sexual assault damages.” (pp 3-5)

The jury in this case did not reach “a seriously erroneous result.” Its verdict is not “a miscarriage of justice.” Mr. Trump’s motion for a new trial on damages or a remittitur(Dkt 204) is denied. (p 59)
The appellate court will consider these fillings.
After the same Judge Kaplan stripped defense to argue about Ms Carroll’s rape claim merits BEFORE THIS trial started, ruling focused on $ XXM for defamation only.
Hopefully those who still beating a dead horse over and over again, know their reasons.

I have said this from the very beginning. Aside from all the Lawfare antics, ANYONE who has ever been in Bergdorf’s, knows that these allegations are impossible. You cannot even bring in an extra blouse to the changing rooms, much less a man. And as Rudy said Trump would have been swamped with people the minute he stepped into the store.
Trump must have been wearing a wig and false beard and a nose prosthesis. Think Gerard Depardieu. Or Peter Sellers.

Rudy is right. I lived in Manhattan in the 80’s and visited frequently thereafter. When you walked into Bergdorf’s you were greeted by numerous salespeople who were more than eager to help. In my particular case they were more than eager to help me out the door because I was obviously not a Bergdorf customer.
Yes, and all stores of this echelon were the same across the country. It is also a good customer service and theft mitigation management, something that you would teach to any entry level sales rep on day 1. Greet the customer within x seconds. In these stores during this time period you would also have personal shoppers.
If President Trump was going shopping they would have immediately assigned a personal shopper if he did not already have one. Remember what the banks said about him. He’s the whale. We want his money. Go after him.
President Trump does not even remember going shopping at Bergdorf’s. He was not a big in person shopper. My guess is that he never went there, unless he went there for a charity event. They could easily pull their records, if they still have them.
But then again, this is what happens when you shred the law and try a non-case decades after the records have been legally destroyed by the laws at the time.
What this is is their #MeToo win. Any woman must be believed.
Here’s the hope. Where is Bill Cosby after being convicted? Remember they have allegedly 50 women lined up against him. 😉
I was a Bergdorf shopper and it is near to impossible to think this could have happened logistically.
