The judge in the New York City case against Donald Trump and the Trump organization has transparently been a little goofy. From the first day when he posed for the cameras, to the sketchy application of legal review within the case, Judge Arthur Engoron exhibits the classic traits of being weird and unstable.
There is a pattern amid the deployment of Lawfare that deserves some background context. Whenever Lawfare is deployed there are always background characters who are seemingly needed to keep the bizarre interpretations of Lawfare tactics on track.
We saw this play out with Debra Katzenberg, Monica McLean and David Laufman controlling Kavanaugh accuser Christine Blasey-Ford. We saw it again with Mary McCord playing the role in the background of the Trump Lawfare impeachment to guide Jerry Nadler and Adam Schiff. We saw it again with Andrew Weissmann and Norm Eisen guiding Special Prosecutor Jack Smith from the backbench of Lawfare. In each case the principal activity is guided by Lawfare ideologues who use position to influence.
In the Judge Engoron example, court clerk Allison Greenfield has been passing notes and instructions to Engoron as the case has progressed. The activity has become so disconcerting that Trump’s lawyers have called it out in court as it happens {Breitbart Link}. In response to the sunlight upon the visible activity, Judge Engoron has now expanded his gag order to prohibit Trump’s lawyers from drawing attention to the activity of Ms. Greenfield.
NEW YORK — The judge overseeing Donald Trump’s ongoing civil fraud trial issued another gag order on Friday — this time prohibiting all lawyers working on the trial from “from making any public statements, in or out of court, that refer to any confidential communications, in any form, between my staff and me.” (link)
The issuance of the gag order is weird because the entire dynamic of the clerk instructing the judge is weird. The gag order is an effort by Engoron to stop people from noticing it…. Yeah, that’s exponentially weirder.
POLITICO – [Trump Attorney Chris] Kise complained about Greenfield’s habit of passing notes to Engoron during proceedings, suggesting she is improperly influencing his decisions. Engoron reacted sharply to that complaint, telling Kise, “I have an unfettered, absolute right to consult with my law clerks” and saying he wouldn’t tolerate future comments about his staff.
Kise, though, continued to argue that he needed to state objections on the record for the purposes of an eventual appeal. “If notes are being passed at certain specific times or they’re being passed in a way that might indicate some bias,” he said, “that’s a record that needs to be made contemporaneously.” (more)
As noted by Henry Rossof from inside the court today, “Judge Engoron said he will note a continuing objection to his consultation with his clerk but does not want anything more said about her… he will still consult.”
“I have an absolute, unfettered right to consult with my law clerks anywhere, anytime,” Engoron noted. “There’s no more need to make a record” [of it within the court when it occurs] he concluded.
After this series of exchanges today, Engoron then expanded his court order to forbid the Trump lawyers from telling the public about what was happening between him and his clerk in the court.
Yup, weird, sketchy and fitting right in with the pattern of how Lawfare is deployed.

Engoron would appoint a receiver to take over control of the entire Trump Organization. The receiver would then show up with security and sheriff deputies at Trump Tower, and the receiver would then take over the books and executive levers of power, and proceed to destroy the organization.
Remember the line in It’s a Wonderful Life, during the board meeting near the beginning of the film, when the evil Mr. Potter makes a motion to appoint a receiver to take over the Bailey Building and Loan.

I practiced law in the state and federal courts in Philadelphia, but did go to New York a few times for hearings on some New York cases handled by our New York counsel.
I don’t recall ever seeing a clerk sit up next to a judge on the bench, much less pass notes to the judge. I never saw it in state or federal court in Philadelphia.
The bench is for the judge. Law clerks are usually off to the side at a table or desk near the court reporter and courtroom clerk.

This is a public courtroom, and the lawyers can’t say what occurred in public? But a reporter could?
Although, I suppose Leverson might try to bar any reporter who wrote about how many times the clerk passed notes, and what was going on each time it happened. Any gag order would run right in to the First Amendment freedom of the press then.

Clerks do occasionally pass up notes to the judges. It’s probably legal, and the communications would be privileged.
Only a judicial inquiry board could require the judge and clerk to explain what was in the notes.

Trump’s attorneys should formally request that all such communications at least be preserved, if not introduced as part of the record of the proceedings.
The order prohibiting attorneys from commenting on the note passing is even weirder – and possibly more sinister. If she is improperly influencing him, Trump’s attorneys must be allowed to point out EVERY INSTANCE of it during the trial.
When will the judicial review board take this matter up and send this loon packing?

Well, we have now been told that this is going on and it is wrong. Sundance says that “These people are ideologically not stable.” But this goes beyond an unstable ideology. These people are either being paid big bucks for their shenanigans or they are mentally unstable – maybe both.
Justice Engoron should be investigated and removed from the bench. Allison Greenfield should be disbarred for her unethical behavior and misconduct.
Greenfield is a danger to American families.

My name is Brock Fredin and I operate the Twitter account @JudicialProtest. I write with
respect to the blatantly unethical and partisan conduct of Your Honor’s Principal Law Clerk
Allison Greenfield, the Court’s “Gag Order” issued today concerning President Trump’s re-
tweeting of my tweet about Ms. Greenfield and Senator Chuck Schumer taken at a Chelsea Reform
Democrat Club brunch and the overly apparent appearance of impropriety in the above-referenced
matter with respect to Ms. Greenfield’s repeated partisan political and Democrat activities while
employed as a law clerk.
Given that President Trump’s post at-issue today was a re-tweet of my original tweet on
the @JudicialProtest account, the Court’s order directing President Trump to remove it is a direct
attack on my First Amendment rights (as well as President Trump’s), particularly since the Court
asserted on the record that my tweet was a “personal attack” on Ms. Greenfield rather than a post
exposing and criticizing the misconduct of a public official. I am consequently an interested party
and submit this letter as such. To be clear, though, this letter and its contents are not a “personal
attack” on Ms. Greenfield. Rather, this letter contains receipts and raises serious ethical violations
as to her political speech and activities involving the Democrat Party while employed as your law
clerk that undoubtedly create an appearance of impropriety in People v. Trump et al.
The Court’s Gag Order is a clear attempt to paper over the apparent ethical violations by
Ms. Greenfield and Your Honor and redirect animus and negative headlines at President Trump.
Without this letter putting Ms. Greenfield’s misconduct in the record, the Court’s Gag Order of
today will no doubt be the dam that will break causing the issuance of even more Gag Orders in
other cases against President Trump that will unconstitutionally infringe on his First Amendment
rights. I am therefore filing this letter with the Court not just to preserve my First Amendment
rights, but to set forth the facts so that they are publicly part of the record and to ensure that
President Trump and his sons are afforded a fair trial.
Based on the facts below and the clear ethical violations of both Ms. Greenfield and Your
Honor, I am copying the New York Commission on Judicial Conduct, the Attorney Grievance ..

A group/person on Twitter identified as Judicial Protest identified that the clerk had made donations to partisan Dem causes in excess of the amount allowed for Court officials.
$500 is the max allowed for Court officials in NY State and Ms. Greenfield donated 3.3K in 2022 and 1K thus far in 2023. Because the gag order placed on Trump related to JP’s Twitter posting JP’s tweet, JP has become an “interested party” and was able to file a very detailed complaint against Ms. Greenfield related to ethics violations – included in the 72 page filing are the receipts on both financial donations and donations of time/talent to various Dem causes with the NY Bar. Interestingly, it would appear that the complaint landed on the Judge’s desk earlier on the same day he gagged Trump. Which might explain why the Judge took the unusual step of demanding Trump testify on the stand about statements he made to the media that day about the Judge and “the person sitting next to the Judge”. Trump testified that he was referring to Michael Cohen. Judge did not believe him and then hit him with the fine.
Certainly looks like the Judge is triggered by the national publicity PDJT attracts and with it PDJT’s illuminating critiques. As usual, going after PDJT becomes radioactive for everyone who participates.
I suspect that 5 years from now Letitia, Fanny, this Judge, Judge Chutkan, Jack Smith, etc. will disappear from public view and go the way of Stacey Abrams.
