The judge in the New York City case against Donald Trump and the Trump organization has transparently been a little goofy. From the first day when he posed for the cameras, to the sketchy application of legal review within the case, Judge Arthur Engoron exhibits the classic traits of being weird and unstable.
There is a pattern amid the deployment of Lawfare that deserves some background context. Whenever Lawfare is deployed there are always background characters who are seemingly needed to keep the bizarre interpretations of Lawfare tactics on track.
We saw this play out with Debra Katzenberg, Monica McLean and David Laufman controlling Kavanaugh accuser Christine Blasey-Ford. We saw it again with Mary McCord playing the role in the background of the Trump Lawfare impeachment to guide Jerry Nadler and Adam Schiff. We saw it again with Andrew Weissmann and Norm Eisen guiding Special Prosecutor Jack Smith from the backbench of Lawfare. In each case the principal activity is guided by Lawfare ideologues who use position to influence.
In the Judge Engoron example, court clerk Allison Greenfield has been passing notes and instructions to Engoron as the case has progressed. The activity has become so disconcerting that Trump’s lawyers have called it out in court as it happens {Breitbart Link}. In response to the sunlight upon the visible activity, Judge Engoron has now expanded his gag order to prohibit Trump’s lawyers from drawing attention to the activity of Ms. Greenfield.
NEW YORK — The judge overseeing Donald Trump’s ongoing civil fraud trial issued another gag order on Friday — this time prohibiting all lawyers working on the trial from “from making any public statements, in or out of court, that refer to any confidential communications, in any form, between my staff and me.” (link)
The issuance of the gag order is weird because the entire dynamic of the clerk instructing the judge is weird. The gag order is an effort by Engoron to stop people from noticing it…. Yeah, that’s exponentially weirder.
POLITICO – [Trump Attorney Chris] Kise complained about Greenfield’s habit of passing notes to Engoron during proceedings, suggesting she is improperly influencing his decisions. Engoron reacted sharply to that complaint, telling Kise, “I have an unfettered, absolute right to consult with my law clerks” and saying he wouldn’t tolerate future comments about his staff.
Kise, though, continued to argue that he needed to state objections on the record for the purposes of an eventual appeal. “If notes are being passed at certain specific times or they’re being passed in a way that might indicate some bias,” he said, “that’s a record that needs to be made contemporaneously.” (more)
As noted by Henry Rossof from inside the court today, “Judge Engoron said he will note a continuing objection to his consultation with his clerk but does not want anything more said about her… he will still consult.”
“I have an absolute, unfettered right to consult with my law clerks anywhere, anytime,” Engoron noted. “There’s no more need to make a record” [of it within the court when it occurs] he concluded.
After this series of exchanges today, Engoron then expanded his court order to forbid the Trump lawyers from telling the public about what was happening between him and his clerk in the court.
Yup, weird, sketchy and fitting right in with the pattern of how Lawfare is deployed.

This NY trial gives new meaning to the term “kangaroo court”. It’s beyond ridiculous. While there are numerous avenues for appeal I don’t know that any judge in the state (they’re all Democrat appointed) will be any better. Trump really should have known better after the first impeachment attempt and after the Mueller Russia nonsense what was going on and moved his business out of NY State to Florida.

Retired Magistrate here: The Supreme Court only reviews cases from lower courts, if the Supreme Court decides to take the case. The percentage of cases the US Supreme Court takes is very small compared to the ones that are submitted to the Supreme Court.
The Supreme Court cannot act independently and insert itself into a case.

I saw an episode of Law & Order many years ago of a judge in advanced dementia, his court clerk was feeding him what to say by a computer during trials and at hearing giving him info about legal issues. Of course the prosecute was the one who caught on to the clerks scam, she was trying to keep her position.
I tell you right now, this is the first court clerk I have ever seen sitting up next to the judge. Judge Gordogone should take a cognitive abilities skill and function test.

In California courtrooms that I have been in (helping others with lawsuits), the clerks sat at desks adjacent to the barrier that separates the courtroom from the audience, media, etc. They were physically located there, so they could communicate with lawyers, plaintiffs, defendants, expert witnesses, etc. and deal with paperwork and to OK people for entry into the court area.
I never saw a court setup where a clerk was seated right next to a judge, where they could pass secret notes to the judge during a trial.
This is weird. It appears that the real judge is the clerk and the fake judge is a puppet sitting in the judge’s seat.

There are court clerks and law clerks.
Court clerks announce cases, keep the file, mark the exhibits that have been received, administer oath, etc
Law clerks are generally chosen by the judge to work with them in researching case precedents, researching the law on a particular matter, perhaps keeping notes on witness testimony.
Neither clerk should be sending the judge a note that says, “Say this” or “Sustain an objection” or “Overrule an objection.”
This idiot judge was placed there because that’s what corrupt States and cities like New York City do. If they’re elected, the people of NYC need to wake up.

Really hard to wrap my head around this, literally a threat to receive punitive measures for speaking up as necessary to save the issue for appeal. This judge is insisting that President Trump’s attorney stay silent – thus forgoing having anything on the record.
Anything not on the record is not appealable. It would be impossible to not butt heads with this judge if you were going to be an effective advocate for your client.
Being a natural wise ass, I would have to ask, “Is that YOUR ruling, Your Honor, or do you need to confer with your clerk?”

Fact findings, minute weaknesses, scraps of anything that will allow them either to keep President Trump out of the white house or control him once inside. Greenfield has a long history of donating to Dems. While the court is supposed to be ‘apolitical’ and court employees have a different ceiling of contribution to political parties (I believe it’s $500), she has consistently surpassed this annually.
This reminds me of an episode of Law & Order in which the judge (Ned Beatty) suffered from dementia so, unbeknownst to everyone, his law clerk fed him his ‘script’ via his laptop.

Is there not an avenue to appeal in that if the judge continually needs to be prompted, that he is being steered down one ideological path or, for the sake of argument, taking that he is impartial then he must be incompetent.
