In a landmark court ruling released today, the U.S. Supreme Court effectively ended the use of affirmative action in college admissions. {237-page ruling here}
By a vote of 6-3 (UNC) and 6-2 (Harvard) the court ruled the admissions programs used by the University of North Carolina and Harvard College violate the Constitution’s equal protection clause barring racial discrimination by government entities.
Chief Justice John Roberts writing the opinion of the majority said that for too long universities have “concluded, wrongly, that the touchstone of an individual’s identity is not challenges bested, skills built, or lessons learned but the color of their skin. Our constitutional history does not tolerate that choice.”
Justice Ketanji Brown Jackson, a woman of notoriously activist disposition defined by her self-image and race, sat out the Harvard case because she had been a member of an advisory governing board who constructed the rules the Supreme Court now determined were unlawful.

Justice Sonia Sotomayor dissented, in an opinion that was joined by Justices Elena Kagan and Ketanji Brown Jackson. Sotomayor emphasized that the majority’s decision had rolled “back decades of precedent and momentous progress” and “cement[ed] a superficial rule of colorblindness as a constitutional principle in an endemically segregated society.”
Thursday’s ruling was the latest in a series of challenges to the role of race in university admissions. In both the North Carolina and Harvard cases, the plaintiffs had asked the justices to overrule Grutter. In her opinion for the majority in that case, Justice Sandra Day O’Connor reaffirmed that “student body diversity is a compelling state interest that can justify the use of race in university admissions,” but she warned that race-conscious admissions policies should not last forever. In 25 years, she suggested, “the use of racial preferences will no longer be necessary to further the interest” in diversity. (read more)

In the bigger picture, the need for control is a reaction to fear.
Think in terms or politics and society – the fear behind the leftist worldview is the fear that someone might withhold things (opportunities, money, whatever) from me. Fear that if you live your life in a way I dislike, it might affect my life. Fear that if you get that job, there will be nothing left for me.
A fear that if you make tons of money, it’s means there’s less money out there for me. So, people who believe in leftist ideologies seek control, manipulation and rules as a means of trying to create guarantees and safeguards against those circumstances they fear.
Conservatives believe in equal opportunity. Leftists believe in equal outcomes.
Modern “liberals”, ie leftists, try to control the world and people to enable their comfort and happiness. Which, as we know, is an endless quest. Trying to control others does nothing in the way of making oneself happy. By extension, voting in this mindset so that government can try to control others will also – shocking – not lead to a happier, more comfortable life.
The conservative (and moderate, independent, but for the sake of expediency, the conservative), on the other hand, relies on himself to meet his own needs. And the tradeoff of being free to live his life as he wishes is also understanding that he has to make peace with how you live yours. By extension, aware that he wants to be able to hold onto this liberty and freedom forever, the conservative votes accordingly, so that everyone can remain free and in charge of his or her own life.
But here’s the crucial difference, perhaps, particularly where misery on the left stems: The conservative does not worry, so to speak, about you.
The conservative person knows that you were born with the same access to self-love, self-empowerment, self-determination and self-reliance that we all were, no matter the circumstances into which you were born. (Think about the millions of people this country has allowed to crawl up from poverty into prosperity – the conservative KNOWS this is possible.) And the conservative believes that if you want prosperity, or a good job, or a good education, you can make it happen – but you have to work hard.
The conservative hopes and intends the free markets bring you all of the affordable and positive opportunities and resources that you need. The conservative also knows that on the other side of that hard work is great reward – material and, more importantly, emotional, spiritual and mental.
The conservative understands that not only is it a waste of time to try to control you, but it’s also actually impossible.
Humans were born to be free. And if we put a roadblock in front of you, you’ll find another way around it. So, we see attempts at control as a waste of resources, energy and time at best, and at worst, creating detrimental results that serve to hinder people’s upward mobility or teach dependence. We see much more efficiency, as well as endless opportunity, in leaving you to your own devices. And we want the same in return.
This is where modern democrats’ mis-view conservatives as heartless. But really, the conservative believes that there is one and one path only to sustainable success and independence – and that is self-empowerment. All other avenues – welfare, affirmative action, housing loans you can’t actually afford – ultimately risk doing a disservice to people as they teach dependence on special circumstances, the govt, or arbitrary assistance (that can disappear tomorrow). And the real danger – they will ALWAYS backfire and leave the recipient in equally or more dire circumstances. Any false improvement will always expire.
The conservative believes in abundance. The liberal believes in scarcity.
The conservative believes man is born free and will be who he is, no matter what arbitrary limitations or rules are put on him. The leftist believes man is perfectible, and by extension, believes a society at large is perfectible, and command and control is justified in the quest to a “perfect” utopian society. (Sounds familiar!)
The conservative tends to be more faithful – and not necessarily in God, but in the ability of the individual to find great strength in himself (or from his God) to get what he needs and to be successful. Therefore, the conservative has an outlet for his fear and disappointment – trust and faith in something bigger.
The leftist believes the system must be perfected in order to enable success. Therefore, disappointment is channeled as anger and blame at the system. Voids are left to be filled by faith in the govt, which they surely then want to come in and “fix” things.
And therein lies the roots of love and fear respectively. For the conservative, when life presents great struggles, he knows he has the power to surmount them. Happiness stems from internal strength and perseverance. For the modern leftist, when life presents great struggles, the system failed, therefore they were at the mercy of a faulty system, and they believe that only when the system is fixed can their life improve. Happiness is built on systemic contingencies, which they will then seek to control or expect someone else to.
One blames himself. The other blames anyone and everyone but himself.
And there it is….. There’s where the meanness comes from. The leftist ideology causes that person to cast anger at the world when things go wrong or appear “unfair.” He constantly chooses only to see the “injustices” – and that makes for a very miserable, mean, blame-casting existence.

Colleges are still going to use essays by applicants to circumvent this ruling. It is only reinforces the idea that people of certain races are not qualified to attend college so liberal admissions have to virtue signal by using AA to admit those not qualified over Asians or Whites who are qualified. The AA Nazis are not only destroying useless degrees such as liberal arts and law but are infesting STEM degrees with their communist DIE AA nonsense. Remember the walkway over an interstate/major highway being built in the Miami metro area that collapsed due to structural engineering negligence by the AA engineers? Expect more of that in the future in all fields. This ruling will make colleges stop using merit methods such as SAT and MCAT exams.

Read that quote carefully. Then read it again. Especially the “other means the regime we hold unlawful today” part. In other words, it can’t be explicitly based on race. That was held unlawful today. But they can use the essays to say they are not admitting based on race but on “disadvantage,” and admitting based on disadvantage wasn’t held unlawful today. Even if it means only favored races get in based on disadvantage.
I think you are stretching things quite a bit with that. Essays have already been a part of the admissions process. The”or other means” doesn’t mean what you think it does.
If colleges end up having the same admissions outcome and claim they were admitting based on essays and scores, yet the discrimination is clearly evident in who and who is not getting admitted, then it will be patently obvious that they have ignored the SCOTUS ruling.

Probably! Just like states and federal judges have ignored the Bruen and Dobbs decisions on the 2nd Amendment and abortion. The Supreme Court has done nothing to enforce it’s decisions!
But states are getting shot down now by the courts expressing the meaning of the Bruen decision, since that falls under 2nd Amendment protection.
As for Dobbs, there is no Federal constitutional protection for abortion, so state courts can rule without the hammer of the SCOTUS coming down on them, especially in blue states or in states that have state constitutional protections in place.

there is no doubt that race based measures have given non white minorities a chance to succeed. I don’t think anyone disagrees that that it has not. But the issue is clearly about fairness….and it really brings the entire skin of your color argument to the very surface. I graduated from HS in a majority black high school. At the top of my class. against all the odds. I see things differently..I never complained things were going to be an uphill battle. I just worked my ass off. It was not easy. That’s life. That’s how it goes. There is no free lunch. And you know what made me feel most proud? being congratulated by my peers who could see with their own eyes that I would never be held back by circumstance….I cannot be the only person who has experienced this. When I attended university..it was exactly the same thing. A minority…barely scrapping by…a different color….and in a town that was extremely racist in every way. Then later in my freshman year…Carl Malone…yes, that Carl Malone, started to do things unimaginable on the baseketball court…a son raised by a single mother.
let me tell you something about great athletes with great values.

and he didn’t get there because he was black…or tall…he got there because he was raised by a solid christian mother.
In a short period of time…Carl gained national recognition and he helped shaped a small town in north louisiana.

The problem with AA is that it has a “hidden assumption of inferiority”, that is, the recipient of AA is somehow inferior and couldn’t possibly attain their goal without a handout/advantage over others. It’s insulting and a horrible way of thinking. People of all stripes are capable of anything they put their mind to. Blacks, in particular, have shown themselves to rise to the top in 2 of the most cut throat businesses, that being Entertainment and Athletics. Any group of people that are challenged and have high expectations will step up to the plate and become a success. Enough with hidden assumptions of inferiority.
No, there are major differences on standardized tests and on IQ tests between the races. Not everyone is capable of getting an engineering degree legitimately or being a physicist. That’s why they use AA. Almost zero favored minorities would be admitted to the top schools if it were done based on grades and test scores.
And they shouldn’t be. Universities are not to be representations of diverse racial makeup because it’s “just”. They are to prepare intelligent, hardworking students to advance the nation and improve the lives of their families and their communities. Race should have nothing to do with it.

In 2003 I was interviewed for a professorship at Delta College in Stocton, CA. The interview with the math department went very well. I was then told that I had to talk one-on-one with the vice president of diversity. This went terribly as I based my answers upon the notion that everyone should be treated equally, with dignity and respect. This didn’t compute with him. I didn’t get the job, and I am convinced that I would have if not for this one interview.
Jordan Peterson is right when he states that STEM people have no idea what’s coming for them. I sure didn’t. I didn’t get a job because I couldn’t BS my way through the DEI interview.
That’s about typical. I interviewed for a job (federal) and was called back, told they wanted to hire me, but a minority applied and they “had” to give them the position instead. Nothing in writing of course.

The original sin of the civil rights movement was the Civil Rights Act of 1964. This law separated us into classes, some of which were “protected”. The protected classes were permitted rights not available to members of unprotected classes. It is sad to say, but we need to return to the basic principle that the law applies equally to all. We didn’t need this act, only a Supreme Court that would apply laws equally.

Years ago my husband was courted for a high paying job by a major manufacturer which sells world-wide. They wanted him badly for a job they knew he could do. He wanted the job, too.
Then the headhunters learned the company was at their limit of white folks; apparently the next person they hired needed to be of some ethnic minority. They called my husband and asked if he had any minority blood in him anywhere back in his history. He knew the answer was ‘no,’ but he called his mom and asked her, just in case the mailman might have been involved. Of course he was joking, and she said ‘no.’
Then they called and without outright saying it asked him to lie about his heritage in order to get the job. He said ‘no,’ and both sides were disappointed to say the least.

Back in the mid ’70s, when Affirmative Action was becoming a factor in hiring, I was home from college for the summer, and the summer job I had lined up fell through. And I needed to find work to save up for the next fall’s semester.
(And in our area, there were so many college kids competing for summer jobs that you had to line one up during spring break, or it was too late if you waited till June.)
So I went to a Kelly Girl’s temp agency to see if I could get anything there.
The guy interviewing me asked all kinds of questions about my work history, skills, education, etc. Then he paused, saying, “No, I don’t think that applies…”
And when I asked, “What?” he said, “I was going to ask if you qualified as a minority, but I can see that you aren’t…”
I looked at him and said, “That’s not true — I AM a minority!”
Looking at me — pale, brunette, blue eyes, he said hopefully, “Really??”
I shot back, “Sure — I’m unemployed! There are only 7% of us in the entire country.”
It didn’t land me a job with them, but the interviewer got a good laugh…
My mother left my abusive father in 1975. Blood and bruises. She had to work 3 jobs to support us 3 girls. She went to apply for food stamps until the 3rd job checks started coming in. The lady at the desk, and I remember it clearly, said she was sorry, but my mom was the wrong color. We ate eggs every night for two weeks for dinner until the 3rd job $ came in. My mom was 28 at the time. She never asked for another hand out again. She’s an ornery 77 now.

Sears also made the interesting point that too many students have to take out a year’s extra loans for a five-year degree because they have to take remedial courses for the first year to catch up in subjects that their high schools did a crappy job of teaching.

But SCOTUS wrote a loophole into the decision that provides a way to continue the racist admissions:
Colleges can consider essays explaining how applicants demonstrated courage and determination in overcoming obstacles “because of their race”.
Minority applicants will know by tomorrow how to craft essays with these code phrases to get preferential treatment because of their race.
Bonus: It is now impossible to prove racism in the racist admissions as they continue.
