In a landmark court ruling released today, the U.S. Supreme Court effectively ended the use of affirmative action in college admissions. {237-page ruling here}
By a vote of 6-3 (UNC) and 6-2 (Harvard) the court ruled the admissions programs used by the University of North Carolina and Harvard College violate the Constitution’s equal protection clause barring racial discrimination by government entities.
Chief Justice John Roberts writing the opinion of the majority said that for too long universities have “concluded, wrongly, that the touchstone of an individual’s identity is not challenges bested, skills built, or lessons learned but the color of their skin. Our constitutional history does not tolerate that choice.”
Justice Ketanji Brown Jackson, a woman of notoriously activist disposition defined by her self-image and race, sat out the Harvard case because she had been a member of an advisory governing board who constructed the rules the Supreme Court now determined were unlawful.

Justice Sonia Sotomayor dissented, in an opinion that was joined by Justices Elena Kagan and Ketanji Brown Jackson. Sotomayor emphasized that the majority’s decision had rolled “back decades of precedent and momentous progress” and “cement[ed] a superficial rule of colorblindness as a constitutional principle in an endemically segregated society.”
Thursday’s ruling was the latest in a series of challenges to the role of race in university admissions. In both the North Carolina and Harvard cases, the plaintiffs had asked the justices to overrule Grutter. In her opinion for the majority in that case, Justice Sandra Day O’Connor reaffirmed that “student body diversity is a compelling state interest that can justify the use of race in university admissions,” but she warned that race-conscious admissions policies should not last forever. In 25 years, she suggested, “the use of racial preferences will no longer be necessary to further the interest” in diversity. (read more)

In the bigger picture, the need for control is a reaction to fear.
Think in terms or politics and society – the fear behind the leftist worldview is the fear that someone might withhold things (opportunities, money, whatever) from me. Fear that if you live your life in a way I dislike, it might affect my life. Fear that if you get that job, there will be nothing left for me.
A fear that if you make tons of money, it’s means there’s less money out there for me. So, people who believe in leftist ideologies seek control, manipulation and rules as a means of trying to create guarantees and safeguards against those circumstances they fear.
Conservatives believe in equal opportunity. Leftists believe in equal outcomes.
Modern “liberals”, ie leftists, try to control the world and people to enable their comfort and happiness. Which, as we know, is an endless quest. Trying to control others does nothing in the way of making oneself happy. By extension, voting in this mindset so that government can try to control others will also – shocking – not lead to a happier, more comfortable life.
The conservative (and moderate, independent, but for the sake of expediency, the conservative), on the other hand, relies on himself to meet his own needs. And the tradeoff of being free to live his life as he wishes is also understanding that he has to make peace with how you live yours. By extension, aware that he wants to be able to hold onto this liberty and freedom forever, the conservative votes accordingly, so that everyone can remain free and in charge of his or her own life.
But here’s the crucial difference, perhaps, particularly where misery on the left stems: The conservative does not worry, so to speak, about you.
The conservative person knows that you were born with the same access to self-love, self-empowerment, self-determination and self-reliance that we all were, no matter the circumstances into which you were born. (Think about the millions of people this country has allowed to crawl up from poverty into prosperity – the conservative KNOWS this is possible.) And the conservative believes that if you want prosperity, or a good job, or a good education, you can make it happen – but you have to work hard.
The conservative hopes and intends the free markets bring you all of the affordable and positive opportunities and resources that you need. The conservative also knows that on the other side of that hard work is great reward – material and, more importantly, emotional, spiritual and mental.
The conservative understands that not only is it a waste of time to try to control you, but it’s also actually impossible.
Humans were born to be free. And if we put a roadblock in front of you, you’ll find another way around it. So, we see attempts at control as a waste of resources, energy and time at best, and at worst, creating detrimental results that serve to hinder people’s upward mobility or teach dependence. We see much more efficiency, as well as endless opportunity, in leaving you to your own devices. And we want the same in return.
This is where modern democrats’ mis-view conservatives as heartless. But really, the conservative believes that there is one and one path only to sustainable success and independence – and that is self-empowerment. All other avenues – welfare, affirmative action, housing loans you can’t actually afford – ultimately risk doing a disservice to people as they teach dependence on special circumstances, the govt, or arbitrary assistance (that can disappear tomorrow). And the real danger – they will ALWAYS backfire and leave the recipient in equally or more dire circumstances. Any false improvement will always expire.
The conservative believes in abundance. The liberal believes in scarcity.
The conservative believes man is born free and will be who he is, no matter what arbitrary limitations or rules are put on him. The leftist believes man is perfectible, and by extension, believes a society at large is perfectible, and command and control is justified in the quest to a “perfect” utopian society. (Sounds familiar!)
The conservative tends to be more faithful – and not necessarily in God, but in the ability of the individual to find great strength in himself (or from his God) to get what he needs and to be successful. Therefore, the conservative has an outlet for his fear and disappointment – trust and faith in something bigger.
The leftist believes the system must be perfected in order to enable success. Therefore, disappointment is channeled as anger and blame at the system. Voids are left to be filled by faith in the govt, which they surely then want to come in and “fix” things.
And therein lies the roots of love and fear respectively. For the conservative, when life presents great struggles, he knows he has the power to surmount them. Happiness stems from internal strength and perseverance. For the modern leftist, when life presents great struggles, the system failed, therefore they were at the mercy of a faulty system, and they believe that only when the system is fixed can their life improve. Happiness is built on systemic contingencies, which they will then seek to control or expect someone else to.
One blames himself. The other blames anyone and everyone but himself.
And there it is….. There’s where the meanness comes from. The leftist ideology causes that person to cast anger at the world when things go wrong or appear “unfair.” He constantly chooses only to see the “injustices” – and that makes for a very miserable, mean, blame-casting existence.


The only thing disappointing in this case is that this wasn’t 9-0 and 8-0 (as opposed to 6-3 and 6-2) decision/s. I don’t know what ‘loop holes’ or ‘interpretations’ that Harvard and similar minded admissions officers at these Universities may come up with now to continue to discriminate. If they continue discrimination in admissions, etc., moving forward, could there now be serious (criminal?) lawsuits against the Universities and can go after their endowments? I hope they simply stop discriminating based on skin color or any such trait, we have no control on what skin color we are born with. A merit based society would be most moral, ethical and make the most economic and all forms of progress. We should celebrate this day. Thank you.

They will simply DO IT ANYWAY. When SCOTUS had struck down unconstitutional gun laws, the states just wrote another one just as unconstitutional as the previous law. It is wilful to the point that SCOTUS should issue an order that these states gain SCOTUS approval before creating new gun laws. This would be completely within precedent and practice as many US Southern states were bared from creating voter laws which might discriminate against minorities without approval. It took a very long time before those states ordered so could once again have such power.
In any case, we know they will keep doing it. We just need SCOTUS to restrict those who thumb their noses at them.
The House can defund Gubmint money for these so-called institutions who run off the rails, no?
It will take a blizzard of lawsuits from those wrongfully denied admission to the university or school within a university to make this stick. Thus, as is almost always the case with SCOTUS rulings, this one provides very green pastures for the lawyers and courts.

I was class fund agent for my 1960’s era class at one of the Seven Sisters women’s colleges. (It went co-ed in the 1970s.) The so-called legacy “admits” back in the day were not necessarily the brightest bulbs in the class, but they were school-spirited enough to be generous to their alma mater when called upon, as had their female forebears who were loyal alums. The toughest nuts to crack for alumnae giving were those who had received full-boat rides aka 4 yr college scholarships as a result of their high school academic achievements, never to be heard from again after graduation from the college. There’s a word for this kind of ingratitude: USERS! They would report from time to time in the class notes of their success in whatever field they had chosen to continue their education, but rarely if ever, sharing a nickel with their alma mater. So please don’t sneer when you say “legacy”! And guess which “group” is the cheapest of all? Trustees of academic institutions, from independent day schools to the Ivy League, know this but can never admit it, so they aim to limit the financial damage by promulgating A-A policies.

My question is, with this ruling, will large monetary (class action) lawsuits to the size that substantially eat into their large endowments become a reality and also a deterrent to other universities/entities. Most unfortunately, yes, we all know why. I found the classes on Moral Sciences in elementary schools (I didn’t go to a ‘religious school’-it was a public school) were the best, albeit, I was more into PCM (Physics, Chemistry and Mathematics) and ultimately became engineer with Bachelor’s, Master’s and Doctorate degrees in Engineering. I still taught my son those moral science courses via such wonderful stories even though the schools don’t teach them anymore, and I still joyfully teach these to all the younglings in our neighborhood and in our friend’s circles whomever are willing to listen. Son just graduated with a perfect GPA in undergrad in Engineering at a premier STEM world renowned university and now beginning doctoral program at another very top engineering University; despite being born with a ‘wrong/un-preferred skin color’ like me.
I hope plenty of lawsuits will be filed against years of diversity “hiring” too.
Rulings like this are a go forward impact. You can not retroactively sue since the law was on their side previously.
Being said there are so many leftist in higher education that are right now, as I type, working on ways to circumvent this. There WILL be massive lawsuits in the near future as these nuts try and impose their racist views.

It’s changing. But they have been running on momentum before the public eventually caught on. I remember 2-3 years ago telling a co-worker what the colleges and universities were doing to students. He denied what I asserted based on the fact that he attended a university not so long ago and did not experience this. Within 4-6 weeks of that discussion, he came to realize I was correct. That said, it takes even longer for the rest of the people.
It will only take a “pandemic” of transgender mutilations of students coming home for summer before everyone else wakes up.

lol, I went through that with my son and his wife, regarding the higher education of my grandchildren when they came to me and ask for money. I told him go back and do your homework and get back in touch with me and by the way, my son is a graduate of the University of Florida and his wife is a graduate of Florida State. they spent nine months doing their homework, and when I finally spoke to them about what the outcome was, their conclusion was that if they sent their children to these state-funded public universities and colleges, they wouldn’t recognize them in 18 months. I got my checkbook out as they went to the front of the line. critical thinking skills at this point are mandatory.
Certain colleges and universities will continue to reject White Christian students.

Opportunities are out there; it is up to each individual to use their GOD given skills and pursue their goals. Does it take hard work; of course. Anything worthwhile takes hard work. The problem with affirmative action always has been that it takes away from the accomplishments of those who have worked really hard to get where they are and rewards others based on the color of their skin.
To work hard and accomplish your goals gives a sense of accomplishment; to accomplish goals based on anything other than hard work only leads to that person expecting more and more entitlements based on entitlements they got in the first place.

Retired Magistrate here: Yes; however, someone will have to file an action specifically with regard to a new hire, promotion, etc. within a government entity other than a college or university. I don’t think the lower courts will apply this particular decision to the actions that you have mentioned. I think this decision will be narrowly applied to taxpayer funded universities and colleges.
However, a caveat: I am pleasantly surprised they ruled 6-3, 6-2 this time so I don’t pretend to know what the Supreme Court will do in the future.

Now suits need to be filed against hospitals and medical facilities, who receive taxpayer funding through Medicare and Medicaid and grants from NIH, et al, for their discriminatory hiring policies.

Hello Colkitto, I can assure you that in University admissions (and now in many private industries too), being a US citizen of Asian descent faces the worst skin-color discrimination. This was the key basis of the law suite. This doesn’t mean white Caucasian straight males aren’t discriminated against solely based on skin color, they very much are. Lot’s of job lost to H1 visas are purely on a monetary basis, especially by the ‘tech’ industry. Thank you.

Yawn!!! The Supreme Court ruled in Bruen that gun control laws were unconstitutional. Then they ruled in the Dobbs Decision that states could ban abortion and both decisions have been largely ignored by the states and federal courts. In fact, even the Supreme Court has failed to step in to support Bruen and Dobbs. Colleges will either totally ignore this decision or simply rename Affirmative Action and call it something else!
But it is a start. This way white and Asian students who have been denied admission because of racial quotas at least have legal grounds to sue the Universities that are discriminating against them. Jim Crow did not end overnight after Brown vs the Board of Education neither will reverse discrimination.
Asians have lots of numbers and work ethic, with worse discrimination cases.

As hard as it was for me to stomach what I saw, I have to admit the basis for their ruling was actually consistent with the constitution. The states run their elections. While it would have been perfectly within the constitution for VP traitor to send EC votes back to the states in question, SCOTUS had established a heavy blow against the concentration of Federal power which is at the heart of so many garbage laws and policies.
And since that time, they have continued on this path striking down unconstitutional laws and unconstitutional SCOTUS rulings along the way.
We are in a better position now than we have seen in a long time.

I got over any residual respect for affirmative action when I hung out with a bunch of upper middle class college-age and early 20’s black women around 15 years ago in Washington, DC and New York City. They were among the most unmotivated, entitled, snotty, l-a-z-y and r-a-c-i-s-t prima donnas I had ever met. Even some of the middle class-raised upper middle class black women who weren’t lazy or snotty were racist. I concluded that all affirmative action had done was create more dysfunction in blacks and society in general, and perpetuate the problems it purported to redress. The notion that the black upper middle class, or even middle class, had to work ‘harder’ than whites was the 2=2=5 doublethink that galvanized me. All I saw and lived was the exact opposite.

Unfortunately, many–if not all–Ivy League schools have been preparing for this ruling by dropping ACT and SAT scores as core admission standards are switching to vague and malleable standards that will skirt the law and allow for continued racist admissions acceptance.
It just means the nation’s “premiere” schools will continue to churn out ill-qualified and questionably competent graduates in all academic disciplines; medical professions, engineering, law schools, you name it.

They have been accusing Thomas of being unethical in accepting vacations from wealthy friends. Thomas is one of the most ethical justices on the court.
